It is intimated that the industry has applied for fresh ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, under Green Category for production of Turbo Ventilators SS @ 90000 Number/Year and Turbo Ventilators AL @ 55000 Number/Year, along with requisite document under Green Category.
The industry has establish its unit without obtaining ‘Consent to establish’ from PPCB and has directly applied for obtaining ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
The industry has deposited consent fee Rs. 14300/- vide R no. KKBKH24173918670 dated 21.06.2024 under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 12100/- vide R no. KKBKH24173915529 dated 21.06.2024 under the Air (Prevention & Control of Pollution) Act, 1981, which is adequate upto 31.12.2028 against the assets of Rs. 28.39 lakhs dated 31.03.2024.
Suitability of Site:
The industry has submitted a copy of land use classification letter issued by DTP SAS Nagar vide letter no. 821 dated 31.05.2024 to Sh. Sandeep Goyal, properitor, Euphoria Industries, wherein, it has mentioned as under:
“ਉਪਰੋਕਤ ਵਿਸ਼ੇ ਅਧਿਨ ਹਵਾਲੇ ਤਹਿਤ ਪ੍ਰਾਪਤ ਪੱਤਰ ਦੇ ਸੰਬਧ ਵਿੱਚ ਸੂਚਿਤ ਕੀਤਾ ਜਾਂਦਾ ਹੈ ਕਿ ਪਿੰਡ ਸੁੰਡਰਾ (ਹ.ਬ. 363) ਤਹਿਸੀਲ ਜ਼ੀਰਕਪੁਰ, ਜਿਲ੍ਹਾਂ ਐਸ.ਐ.ਐਸ ਨਗਰ ਵਿਖੇ ਪੈਦੇ ਖਸਰਾ ਨੰਬਰ 73//25/1/1(2-1-1.5) ਅਤੇ 16/2(7-12) ਰਕਬਾ 9 ਕਨਾਲ 13 ਮਰਲੇ 1.5 ਸਰਸਾਹੀ ਵਿੱਚੋ ਕੁੱਲ ਰਕਬਾ 3 ਕਨਾਲ 16 ਮਰਲੇ 7 ਸਰਸਾਹੀ (ਲਗਭਗ 0.48 ਏਕੜ) ਦਫਤਰੀ ਰਿਕਾਰਡ ਵਿੱਚ ਉਪਲੱਬਧ ਰਿਜਨਲ ਪਲੈਨ, ਗਮਾਡਾ ਅਨੁਸਾਰ ਐਫ.ਈ.ਜ਼ੈੱਡ ਜ਼ੋਨ ਅਧਿਨ ਪੈਂਦਾ ਹੈ। ਕਿਉਜੋ ਆਪ ਵੱਲੋ ਸਾਈਟ ਦਾ ਮੰਤਵ ਸਪਸ਼ਟ ਨਹੀ ਕੀਤਾ ਗਿਆ ਹੈ, ਇਸ ਲਈ ਸਾਇਟ ਦੀ ਪ੍ਰਮਿਸੀਬਿਲਟੀ ਸਬੰਧੀ ਟਿਪਣੀ ਨਹੀ ਕੀਤੀ ਜਾ ਸਕਦੀ। ਸਾਈਟ ਵਿੱਚ ਕਿਸੇ ਵੀ ਤਰ੍ਹਾਂ ਦੀ ਐਕਟੀਵੀਟੀ ਕਰਨ ਤੋ ਪਹਿਲਾ ਉਸ ਸਬੰਧੀ ਮੰਨਜੂਰੀ ਸਬੰਧਤ ਸਰਕਾਰੀ ਅਦਾਰਿਆ ਤੋਂ ਪ੍ਰਾਪਤ ਕਰਨ ਦੇ ਅਤੇ ਰਕਬੇ ਦੀ ਮਾਲਕੀ/ਕਬਜ਼ੇ ਸਬੰਧੀ ਵਖਰੇ ਤੌਰ ਤੇ ਮਾਲ ਵਿਭਾਗ ਪਾਸੋ ਤਸਦੀਕ ਕਰਵਾਉਣ ਦੇ ਆਪ ਪਾਬੰਦ ਹੋਵੇਗਾ। ਇਸ ਤੋਂ ਇਲਾਵਾ ਉਕਤ ਕਲਾਸੀਫਿਕੇਸ਼ਨ ਆਪ ਵੱਲੋ ਪੇਸ਼ ਕੀਤੇ ਗਏ ਦਸਤਾਵੇਜਾਂ ਦੇ ਸਨਮੁੱਖ ਜਾਰੀ ਕੀਤੀ ਗਈ ਹੈ।
ਇਸ ਪੱਤਰ ਨੂੰ ਵਿਸ਼ੇ ਅਧੀਨ ਸਾਈਟ ਦਾ ਲੈਂਡ ਯੂਜ਼ ਕਲਾਸੀਫਿਕੇਸ਼ਨ ਸਰਟੀਫਿਕੈਂਟ ਹੀ ਸਮਝਿਆ ਜਾਵੇ। ਇਸ ਲੈਂਡ ਯੂਜ਼ ਕਲਾਸੀਫਿਕੇਸ਼ਨ ਨੂੰ ਸਾਈਟ ਦੀ ਮਾਲਕੀ ਦਾ ਸਬੂਤ, ਸੀ.ਐਲ.ਯੂ ਦੀ ਪ੍ਰਵਾਨਗੀ ਜਾ ਕਿਸੇ ਕਿਸਮ ਦਾ ਐਨ.ਓ.ਸੀ ਨਾ ਸਮਝਿਆ ਜਾਵੇ।”
As such, as the site falls under F.E.Z Zone, thus, site is suitable.
The industry has submitted a copy of lease deed dated 18.03.2024 executed between Ms. Shweta Goyal and Euphoria Industries. The said lease deed is for 15 years and is valid upto 28.02.2039.
The industry has also submitted a copy of building plan signed by Er. Ashok Tayal, Competent Person, under the Factories Act, 1948.
Visit:
Accordingly, the industry was visited by AEE of this office on 01.07.2024 and during visit, it was observed as under:
1. The industry is engaged in manufacturing of exhaust industrial fans, i.e. Turbo Ventilators SS and Turbo Ventilators and was in operation.
2. The industry has not installed any boiler or furnace in its premises.
3. The industry is not carrying out spray painting or powder coating in its premises.
4. The industry is not carrying out any trade effluent generating process in its premises.
5. The industry has constructed septic tank in its premises, after passing through which, domestic effluent shall be discharged onto land for plantation along the boundary wall.
6. The industry has provided 01 no. of DG set 45 KVA, which are equipped with canopy and stack of adequate height.
From above, it is clear that the industry is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
Recommendations:
In view of above, if may approved, the industry may be granted ‘consent to operate’ granted to the industry under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, upto 31.12.2028 with usual conditions & with following special conditions:
1. The industry shall not start any new process within its unit which may change its category from Green to Orange or Red category, without the prior written permission of the Board.
2. The industry shall not generate and discharge any kind of trade effluent from its premises. The industry shall generate only domestic effluent, which shall be discharged onto land for plantation within premises.
3. The industry shall not carry out any metal surface finishing process in its premises.
4. The industry shall not carry out any activity in its premises, which is covered under the ambit of EIA notification dated 14.09.2006.
5. The industry shall not install any boiler or furnace in its premises without prior permission of the Board.
6. The industry shall not carry out spray painting, powder coating or any other air polluting process in its premises.
7. The industry shall comply with the by-laws of the Master Plan, Derabassi and stipulation of Department of Town and Country Planning, at all times.
8. The industry shall not discharge the effluent into any drain/choe/nallah, in any case.
9. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation at any time, under any circumstances.
10. The industry obtain permission from PWRDA for abstraction of groundwater (if required) and shall comply with the guidelines issued by PWRDA from time to time.
11. The industry shall get its final building plan approved from Director of Factories within 02 months and shall submit a copy of the same to the Board within 15 days thereafter.
12. The industry shall ensure that due to operation of the project at the site, no nuisance for general public is created at any time and no public complaints are received.
13. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time.
14. The unit shall ensure that no nuisance is created in the vicinity of its premises from the operations of its service station. In case, any complaint is received against the unit, the Board shall be at liberty to revoke/ cancel this consent without giving any opportunity of hearing to the industry.
15. The adequacy/ efficacy of the pollution control and disposal arrangements shall be the sole responsibility of the project proponent and the project proponent shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time.
16. The Consent is being granted to the industry based upon the undertaking/ documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time.
17. In case the industry fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the industry.
