It is submitted that the industry has applied for obtaining ‘Consent to Establish’ (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, for establishment of a new industry unit for surface coating of Aluminum/SS/MS Parts @ 600 Numbers/day as raw material.
Fee detail:
The industry has deposited Rs. 14400/- vide R. no. 672286410 dated 23.03.2024 including application form fee, against the cost of the project of Rs. 309.29 lakhs (as per project report). The NOC fees deposited by the industry is adequate for one year.

Suitability of Site:
The industry has submitted a copy of land use classification letter issued by DTP SAS Nagar vide letter no. 861 dated 11.06.2024 to Sh. Parkash Singh, wherein, it has mentioned as under:
“ਉਪਰੋਕਤ ਵਿਸ਼ੇ ਅਧਿਨ ਹਵਾਲੇ ਤਹਿਤ ਪ੍ਰਾਪਤ ਪੱਤਰ ਦੇ ਸੰਬਧ ਵਿੱਚ ਸੂਚਿਤ ਕੀਤਾ ਜਾਂਦਾ ਹੈ ਕਿ ਪਿੰਡ ਭਗਵਾਨਪੁਰ (ਹ.ਬ. 199) ਤਹਿਸੀਲ ਡੇਰਾਬੱਸੀ, ਜਿਲ੍ਹਾਂ ਐਸ.ਐ.ਐਸ ਨਗਰ ਵਿਖੇ ਪੈਦੇ ਖਸਰਾ ਨੰਬਰ 109 ਕੁੱਲ ਰਕਬਾ 1 ਬਿੱਘਾ 4 ਬਿਸਵੇ (ਲਗਭਗ 0.25 ਏਕੜ) ਦਫਤਰੀ ਰਿਕਾਰਡ ਵਿੱਚ ਉਪਲੱਬਧ ਰਿਜਨਲ ਪਲੈਨ, ਗਮਾਡਾ ਅਨੁਸਾਰ ਐਫ.ਈ.ਜ਼ੈੱਡ ਜ਼ੋਨ ਅਧਿਨ ਪੈਂਦਾ ਹੈ। ਕਿਉਜੋ ਆਪ ਵੱਲੋ ਸਾਈਟ ਦਾ ਮੰਤਵ ਸਪਸ਼ਟ ਨਹੀ ਕੀਤਾ ਗਿਆ ਹੈ, ਇਸ ਲਈ ਸਾਇਟ ਦੀ ਪ੍ਰਮਿਸੀਬਿਲਟੀ ਸਬੰਧੀ ਟਿਪਣੀ ਨਹੀ ਕੀਤੀ ਜਾ ਸਕਦੀ। ਸਾਈਟ ਵਿੱਚ ਕਿਸੇ ਵੀ ਤਰ੍ਹਾਂ ਦੀ ਐਕਟੀਵੀਟੀ ਕਰਨ ਤੋ ਪਹਿਲਾ ਉਸ ਸਬੰਧੀ ਮੰਨਜੂਰੀ ਸਬੰਧਤ ਸਰਕਾਰੀ ਅਦਾਰਿਆ ਤੋਂ ਪ੍ਰਾਪਤ ਕਰਨ ਦੇ ਅਤੇ ਰਕਬੇ ਦੀ ਮਾਲਕੀ/ਕਬਜ਼ੇ ਸਬੰਧੀ ਵਖਰੇ ਤੌਰ ਤੇ ਮਾਲ ਵਿਭਾਗ ਪਾਸੋ ਤਸਦੀਕ ਕਰਵਾਉਣ ਦੇ ਆਪ ਪਾਬੰਦ ਹੋਵੇਗਾ। ਇਸ ਤੋਂ ਇਲਾਵਾ ਉਕਤ ਕਲਾਸੀਫਿਕੇਸ਼ਨ ਆਪ ਵੱਲੋ ਪੇਸ਼ ਕੀਤੇ ਗਏ ਦਸਤਾਵੇਜਾਂ ਦੇ ਸਨਮੁੱਖ ਜਾਰੀ ਕੀਤੀ ਗਈ ਹੈ।
ਇਸ ਪੱਤਰ ਨੂੰ ਵਿਸ਼ੇ ਅਧੀਨ ਸਾਈਟ ਦਾ ਲੈਂਡ ਯੂਜ਼ ਕਲਾਸੀਫਿਕੇਸ਼ਨ ਸਰਟੀਫਿਕੈਂਟ ਹੀ ਸਮਝਿਆ ਜਾਵੇ। ਇਸ ਲੈਂਡ ਯੂਜ਼ ਕਲਾਸੀਫਿਕੇਸ਼ਨ ਸੀ.ਐਲ.ਯੂ ਦੀ ਪ੍ਰਵਾਨਗੀ ਜਾ ਕਿਸੇ ਕਿਸਮ ਦਾ ਐਨ.ਓ.ਸੀ ਨਾ ਸਮਝਿਆ ਜਾਵੇ।”
As the site of the industry is located in F.E.Z Zone. Thus, the proposed site of the unit is suitable.
The industry vide online reply dated 24.06.2024 has submitted a copy of lease deed dated 19.06.2024 executed between Sh. Parkash Singh and MRS Coating Solutions LLP for land bearing khasra no. 109 (2-8), which is valid for 05 years 06 months, i.e. upto 31.10.2029.
The industry has submitted a copy of LLP agreement dated 13.02.2024, as per which following are the partners in the unit namely MRS Coating Solution LLP:
a) Sh. Shubit Nandwani.
b) Sh. Rajneesh Kalia.
c) Sh. Mohit Manchanda
Water Pollution:
As per the application form, trade effluent at 0.5 KLD shall be generated from the process of surface treatment and anodizing process. The industry has proposed to make an agreement with operator of CETP at Chanalon, for lifting of the said trade effluent.
The domestic effluent @ 0.4 KLD to be generated from the unit and the industry shall be discharge onto land for plantation within premises after passing through septic tank.
Air pollution:
The industry has proposed to install 01 powder coating booth which will be equipped with cyclone separator along with the stack of suitable height. The industry has also proposed to install 01 no. DG set having capacity @ 125 KVA are equipped with canopy and stack of adequate height.
Visit:
Accordingly, the proposed site of the industry was visited on 01.07.2024 and it was observed as under:
1. The proposed site of the unit is located in revenue estate of village Bhagwanpur, Barwala road, Derabassi, SAS Nagar. The proposed site is located on the back side of the industrial unit namely M/s Jai Parvati Forge Ltd.
2. There is an existing built up building at the proposed site. some of the machinery (i.e. anodizing tanks) have arrived at site and the industry is yet to install any plant & machinery at the site.
Recommendations:
In view of above, if may approved, ‘consent to establish’ (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry for one year, with usual conditions & with following special conditions:
1. The industry shall not carry out any activity which is covered under the ambit of EIA notification dated 14.09.2006.
2. The industry shall not start any operations at the site, without obtaining consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981.
3. The industry shall make agreement with the operator of CETP at Chanalon, Kurali for lifting of trade effluent to be generated from its process, before starting any production activity at site.
4. The industry shall comply with the guidelines issued by PWRDA and shall obtain permission from PWRDA for abstraction of ground water.
5. The industry shall not discharge the effluent into any drain/choe/nallah, in any case.
6. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances.
7. The industry shall submit the final approved building plan under the Factories Acts, 1948, at the time of obtaining consent to operate under the Water Act, 1974 and Air Act, 1981.
8. The industry has been approved by the Board from pollution angle and the industry shall obtain the statutory clearances / permissions from all other concerned departments.
9. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time.
10. The industry shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time.
11. The NOC is being issued to the project proponent based upon the documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing.
12. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent.
