It is submitted that:-
1. Both the warehouse units – ASAP logistics and Swift Logistics LLP have applied separately for obtaining CTOs/CTE and have not escaped the mandate of operating/establishing the warehouse units .
2. The whole area containing both the warehouse units have common road between both sheds.
3. Both the warehouse units have mutually consented to use common road between these sheds for easy movement of vehicles, hence no boundary wall is required to separate both units.
4. Both the warehouse units have different identities and have mutually consented to share a common area of land between them as common vehicle movement area.
Therefore, the condition imposed by AEE that both the warehouse units shall provide a boundary wall between them so that built up area shall remain less than 20,000 sq meter does not have substance. It is accordingly recommended for grant of CTOs to the warehouse unit ASAP logistics with amended condition that except use of roads for movement area, this common area shall not be used for storing/warehousing purpose please.
