Patiala Reference: Industry's online application ID 25980363 (W) & 25977844 (A) It is submitted that the subject cited establishment is a marriage palace and was granted consent to establish (NOC) under Water Act, 1974 and the Air Act, 1981 vide no. CTE/Fresh/PTA/2020/14041943 dated 23/11/2020, valid up to 16/11/2021 for establishment of marriage palace of capacity 250 peoples + guests in rooms under orange category. Now, the establishment has applied for obtaining fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 with requisite documents under orange category for operating its marriage palace of capacity 250 peoples + guests in room and for discharge of domestic effluent @ 21 KLD. The establishment has deposited Rs. 8400/- vides online receipt no. 708233936 dated 29.02.2024, Rs. 56000/- vide UTR No. POD025544137 dated 19.06.2024 as water consent fee & Rs. 25200/- vide UTR no. POD025548173 dated 19.06.2024 as 300% penalty fee under Water Act, 1974. Further, the PP has also deposited Rs. 8400/- vide online receipt no. 659565992 dated 29.02.2024, Rs. 56000/- vide UTR No. POD025544214 dated 19.06.2024 & Rs. 25200/- vide UTR no. POD025548101 dated 19.06.2024 as 300% penalty fee under the Air Act 1981 against the fixed assets of Rs. 196.00 lakh as on 28.02.2024 as per CA certificate dated 28.02.2024, which is adequate upto 30.06.2029 after considering date of commissioning as expiry of the NOC. Accordingly, the marriage palace was visited by the officer of this office on 28.06.2024 and it was observed as under: 1. The marriage palace was found not in operation due to off season. 2. The marriage palace has also provided 1 no. banquet hall and 3 no. rooms. 3. The marriage palace has provided 1 no. of kitchen for preparation of food in marriage palace. 4. The marriage palace has provided additional land around 1.0 Acre adjacent to marriage halls on lease, which is being used for parking and other purpose, as informed by the representative. 5. The domestic effluent generated from toilets is being discharged onto land for plantation after passing through septic tanks. 6. The wastewater generated from the kitchen / washing area is being passed through oil & grease trap followed by septic tanks and then discharged onto land for plantation. 7. The marriage has also provided adjacent land on lease measuring around 1 bigha for plantation purposes, to utilize treated waste water. 8. The marriage palace is disposing off its inorganic waste for recycling purpose through local rag pickers. 9. The marriage palace has installed 1 no. DG set of capacity 62 KVA equipped with canopy and stack of adequate height. 10. The marriage palace is disposing of its kitchen waste through Hari Bhari NGO. The point wise compliance of the Board’s circular no. 64 dated 2/2/2021 is as under: 1. Water Pollution 1.1 Effluent Treatment Plant a) The Marriage Palace is discharging its domestic effluent onto land for plantation after passing through bar screen, oil & grease trap followed by septic tank. Further, the wastewater generated from the kitchen / washing area is being passed through screen bars followed oil & grease trap and then discharged onto land for plantation. i) The establishment has provided screen bars followed oil & grease trap for treatment of wastewater generated from the kitchen in compliance of the Board’s Office Order vide its notification no. 271 dated 10/10/2011. ii) The establishment is discharging its domestic effluent onto land for plantation after passing through bar screen, oil & grease trap followed by septic tank iii) Same as mentioned at Sr.no. (ii). iv) NA being small scale. b) EP Rules specify effluent discharge norms i) Not applicable. ii) The project proponent is yet to submit analysis report. c) The establishment is discharging its wastewater onto land for plantation. d) The establishment has provided water meters at the source of fresh water supply. e) NA, as no STP has been installed. f) Same as (c). g) The project proponent is yet to submit analysis report. h) Same as (c). i) Not applicable. 1.2. Air Pollution a) The establishment is using charcoal for tandoor and PNG gas for other cooking purpose. b) Complying, the establishment has provided chimney followed by ducting system for exhaust emissions. c) The establishment has installed 1 no. D.G. set of 62 KVA, which is equipped with canopy and stack of adequate height. d) NA. 2.2. Energy Conservation a) The establishment has provided solar system for producing hot water. b) The establishment procures silent DG set from the market on rent basis during functions only. c) The establishment has used only LED bulbs in its premises. 3.0. Consent to establish / Consent to operate a) Complying, / CTO obtained. b) Not applicable. c) Not applicable. 4.0. Solid Waste Management a) The kitchen waste (eatable items) is being disposed off through Hari Bhari NGO Recyclable/plastic waste is being lifted local rag pickers. Moreover, the establishment is using re-useable crockery and glasses during functions to minimize plastic waste generation. b) Not applicable. Does not fall under the list bulk generators. c) Same as mentioned at 4.0 (a) d) The establishment has 1 no. D.G. set of capacity 62 KVA with canopy and stack of adequate height. e) The plastic / re-recyclable waste is being lifted through local rag pickers f) Same as above. g) Same as above. h) Same as above. 5.0. Noise Pollution a) The establishment uses only indoor loudspeakers as permitted upto 10.00 p.m. only. b) Same as above. c) Same as above. d) The establishment has installed 1 no. D.G. set of capacity 62 KVA with canopy and stack of adequate height. e) The representative of the establishment informed that no burning of crackers are allowed within the premises. f) The establishment uses only indoor loudspeakers as permitted upto 10.00 p.m. only. 6.0. Infrastructure issues and other requirement i) Does not relates to PPCB. ii) Does not relates to PPCB. iii) Does not relates to PPCB. iv) Does not relates to PPCB. v) Does not relates to PPCB. vi) Does not relates to PPCB. Moreover, the Hon’ble NGT while disposing of the matter of O.A. no. 400/2017 titled as Westend Green Society V/s UOI and others has passed orders dated 4/2/2021 and the relevant part of which is reproduced as under: ”ETPs need to be installed by all the big units, not connected to the sewer line.” However, the subject cited establishment is a standalone Small Scale marriage palace, which only operates seasonally and has provided screen bars followed by oil & grease trap for treatment of kitchen wastewater. In view of above, it is found that the establishment is complying with the guidelines for control and enforcement of environmental norms as notified by Board’s circular no. 64 dated 2/2/2021. Therefore, keeping in view of above mentioned facts and submissions made by the project proponent, this office is of the opinion that the establishment may be granted fresh consent under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981 up to 30.06.2029 under orange category for operating of marriage palace by name & style of The Grand Palms by M/s R. K Enterprises with usual conditions and special conditions that: - (Competency- Senior Environmental Engineer, ZP-1) 1. The consent is issued only for land for which CLU is obtained from Directorate of Town & Country Planning vide its Memo no. 5994 dated 18.11.2019 for land measuring 1.2 Acres ( 5 Bigha 15 Biswa) 2. The project proponent shall get its effluent samples analyzed from Board’s / Board’s approved lab in compliance to the Board’s office order dated 10/10/2011. 3. The project proponent shall maintain the record of water meter on the source of its fresh water. 4. The project proponent shall comply with the guidelines of Punjab Water Regulation and Development Authority (PWRDA), issued for the abstraction of ground water from time to time. 5. The project proponent shall not use any unauthorized mode for disposal of treated/untreated wastewater. 6. The project proponent shall regularly get cleaned the oil & grease trap, so that the wastewater can be effectively treated in the septic tank and the Oil & Grease so removed shall be disposed of in an environmentally sound manner. 7. The adequacy & efficacy of the waste water treatment system will be the entire responsibility of the establishment. 8. The establishment shall conform to the standards for treated waste water as laid down by the Board in circular vide no. SEE (HQ-1)/F.244/2011/271 Dated 10.10.2011. 9. The project proponent shall continue to comply with the provisions of the Solid Waste Management Rules, 2016 for disposal of solid waste generated from the marriage palace. 10. The industry shall ensure segregation of the solid waste at source, facilitate collection of segregated waste in separate streams, handover recyclable material to either authorized waste pickers or authorized recyclers as prescribed in Solid Waste Management Rules, 2016. The bio-degradable waste shall be processed, treated and disposed of through composting or bio-methanation within the premises as far as possible. The residual waste shall be given to the waste collectors or agency as directed by the local body. 11. The project proponent shall comply with the Mechanism/ guidelines prescribed by the Board vide officer order no. 64 dated 02/02/2021 in true letter & spirit. 12. The establishment shall comply with the provisions of Noise Pollution (Regulation & Control) Rules 2000. 13. The consent is granted on the basis of submissions / undertakings submitted by the project proponent, if in future any information provided by the project proponent found to be wrong / false, the consent granted shall be deemed cancelled / revoked. 14. The establishment shall be bound to comply with the bye-laws of Local Planning Area (LPA) notified on 04.05.2011. 15. The establishment shall obtain necessary permissions / NOCs from the concerned departments wherever and whenever required. 16. The establishment shall be bound to shift its unit whenever asked by the competent authority, if the validity of the consents is more than the time period afforded by the authority than the validity of the consent shall be curtailed. 17. As per orders of Hon’ble NGT in the matter of OA no. 606 of 2018 titled as Compliance of Municipal Solid Waste Rules, 2016 in para 16 of the order dated 31.08.2018, the project proponent shall provide mechanical composter for management of organic solid waste.
