It is intimated that the industry was granted ‘Consent to Establish’ NOC under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/SAS/2023/22283153 dated 13/07/2023, having validity upto 14/07/2024 for manufacturing of Gymnasium Products/Sports Goods @2300 Kgs/day.
Now, the industry has applied for ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for production of Gymnasium Products/s ports goods @ 2300 Kgs/day, alongwith a requisite documents.
The industry has deposited consent fee Rs. 54500/- vide R no. 185109314 dated 28.06.2024 under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 54500/- vide R no. 352921131 dated 28.06.2024 under the Air (Prevention & Control of Pollution) Act, 1981, which is adequate upto 31.03.2029 against the assets of Rs. 395.54 dated 05.03.2024.
The industry has also submitted a copy of building plan signed by Er. Rishi Garg, Competent Person, under the Factories Act, 1948. The industry has also submitted a building plan vide no. PB/SAS/DERBS/171309 dated 23.01.2024, digital signed by Varinder Kumar Jain, MC Derabassi.
Visit:
Accordingly, the industry was visited by AEE of this office on 01.07.2024 and during visit, it was observed as under:
1. The industry is engaged in manufacturing of Gymnasium Products and sports goods.
2. The industry has installed 01 no. tubewell in its premises and flow meter is to be provided with the same.
3. The industry has installed one no. short blasting machine in its premises, which is equipped with in-built bag filter house as APCD.
4. The industry has installed 02 no. powder coating booths, which are equipped with separate cyclone followed by bag filter as APCDs with them.
5. The industry has installed one no. LPG fired oven in its premises.
6. The industry shall not be carrying out any trade effluent generating process in its premises.
7. The domestic effluent shall be discharged onto land for plantation along the boundary wall after passing through septic tank.
8. The industry has provided 01 no. of DG set 125 KVA, which is equipped with canopy and stack of adequate height.
From above, it is clear that the industry is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
Recommendations:
In view of above, if may approved, the industry may be granted fresh ‘consent to operate’ granted to the industry under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, upto 30.09.2028 with usual conditions & with following special conditions:
1. The industry shall not carry out any activity in its premises which can change the category of unit from Orange to Red.
2. The industry shall apply for obtaining authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016, within 07 days.
3. The industry shall not generate and discharge any kind of trade effluent from its premises.
4. The industry shall generate only domestic effluent and shall discharge the same after onto land for plantation within its premises, after passing through septic tank.
5. The industry shall maintain proper record of the freshwater to be consumed in its process at all times.
6. The industry obtain permission from PWRDA for abstraction of groundwater (if required) and shall comply with the guidelines issued by PWRDA from time to time.
7. The industry shall not discharge the effluent into any drain/choe/nallah, in any case.
8. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation at any time, under any circumstances.
9. The industry shall develop its project strictly in accordance with the layout / building plans approved / to be approved by the Competent Authority.
10. The industry obtain permission from PWRDA for abstraction of groundwater and shall comply with the guidelines issued by PWRDA from time to time.
11. The industry shall get its final building plan approved from Director of Factories within 02 months and shall submit a copy of the same to the Board within 15 days thereafter.
12. The industry shall ensure that due to operation of the project at the site, no nuisance for general public is created at any time and no public complaints are received.
13. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time.
14. The unit shall ensure that no nuisance is created in the vicinity of its premises from the operations of its service station. In case, any complaint is received against the unit, the Board shall be at liberty to revoke/ cancel this consent without giving any opportunity of hearing to the industry.
15. The adequacy/ efficacy of the pollution control and disposal arrangements shall be the sole responsibility of the project proponent and the project proponent shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time.
16. The Consent is being granted to the industry based upon the undertaking/ documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time.
17. In case the industry fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the industry.
