It is submitted that the project is a small-scale orange category marriage palace. Earlier, the marriage palace was granted 'Consent to Establish' (NOC) for an industrial unit u/s 25 of Water (Prevention & Control of Pollution) Act, 1974 and u/s 21 of Air (Prevention & Control of Pollution) Act, 1981 vide no. O15SASCTE2721070 dated 22.06.2015, valid upto 21.06.2016 for marriage palace having 500 persons/function with subject to suitable conditions mentioned therein.
Thereafter, a complaint was received from the residents of Village Rampur Kalan, Banur through DC office, Mohali regarding lot of noise pollution being caused due to music played by the marriage palace and accordingly, the marriage palace was visited by the officer of the Board on 19/01/2024 and it was observed as under: -
1. The STP was not in operation and physical conditions showed that it was not being operated since long. Some of the components of the STP was found damaged.
2. No record is being maintained regarding operation of STP.
3. The untreated effluent is being discharged onto land for stagnation in the adjoining area.
4. The solid waste is not being managed as per MSW Rules.
5. The representative of the project proponent informed that the DJ system is being played upto 2 AM in the morning.
6. The stack height of DG set was found inadequate.
7. The project proponent is operating its marriage palace since 2018, without obtaining consents of the Board under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
Therefore, the marriage palace was given personal hearing before the Senior Environmental Engineer (P) of the Board on 12.02.2024 and it was decided as under: -
1. The project proponent shall comply with all the observations earlier made by the visiting officer of the Board on 19/01/2024 within 10-days and thereafter submit the compliance in the O/o Environmental Engineer, Punjab Pollution Control Board, Regional Office, SAS Nagar.
2. The project proponent shall take adequate and appropriate measures for the management and handling of wet waste being generated after the function i.e. shall install composter, execute and agreement with piggeries, adopt burning composting etc., within one month.
3. The project proponent shall apply consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and of Air (Prevention & Control of Pollution) Act, 1981 alongwith requisite documents, within 15-days.
4. The project proponent shall comply with the guidelines of the Hon’ble Punjab and Haryana High Court as well as the Noise Pollution (Regulation and Control) Rules, 2000 w.r.t operation of DJ system in the marriage palace and shall not operate after 10.00 pm under any circumstances.
5. The project proponent shall submit bank guarantee amounting of Rs. 2.0 lakhs as an assurance to comply with pollution control laws at all the times as well above-mentioned decisions.
Now, the marriage palace has applied for obtaining fresh Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for marriage palace having 500 persons/function along with requisite documents and fee.
The marriage palace has deposited Rs. 1,40,400/- vide R. No. 427144476 dated 18.04.2024 (Rs. 10,800/- under Water Act, 1974, Rs. 10,800/- NOC regularization fee, Rs. 54,000/- Penalty/Late Fee & Rs. 64,800/- Previous Fee) and Rs. 1,30,100/- vide R. No. 180791212 dated 18.04.2024 (Rs. 10,800/- under Air Act, 1981, Rs. 54,000/- Penalty/Late Fee & Rs. 64,800/- Previous Fee, against the value of fixed assets is Rs. 4.82 crores. The consent fee deposited by the project proponent is adequate upto 30.06.2025 under both acts after adjusting NOC fee & late fee.
The marriage palace has obtained the CLU from the Senior Town Planner, SAS Nagar vide memo no. 3144 STP(S)SP-36(S) dated 14/07/2014 for land measuring 5.746 acres. However thereafter the CLU has been corrected for land measuring 4.08 acres vide no. 290 STP(S)/SP-36 dated 16/01/2015.
The marriage palace was visited by the officer of the Board on 02.07.2024 and it was observed as under:
1. The marriage palace was not in operation during the visit.
2. The marriage palace having capacity of 500 persons/function.
3. The marriage palace has provided STP of capacity 40 KLD based on MBBR technology to treatment of the wastewater generated in its premises.
4. The treated effluent is being discharged onto land for plantation and in green lawns within the premises after treated in STP. The marriage palace has adequate arrangements for utilisation of treated wastewater.
5. The marriage palace has installed one no. borewell for fresh water abstraction and now water meter has been installed.
6. The marriage palace is sourcing the food from outside vendors and only reheating is being done in the kitchens. The left-over food and solid waste are collected by the vendor only.
7. The marriage palace has now provided compost pits for composting of wet waste, if any and horticulture waste.
8. The marriage palace has installed two nos. D.G sets of capacities 300 KVA & 125 KVA, both are equipped with canopy and adequate stack height.
9. The marriage palace has submitted approved site plan from Senior Town Planner vide letter no. 2753STP(S)SP-36 dated 17.07.2015.
10. The marriage palace has agreed to comply with the guidelines of the Hon’ble Punjab and Haryana High Court as well as the Noise Pollution (Regulation and Control) Rules, 2000 w.r.t operation of DJ system in the marriage palace.
11. The marriage palace has submitted Bank Guarantee of Rs. 2.0 lacs vide BG No. 11830ILG000824 dated 28.05.2024 having validity upto 27.05.2025 in compliance of the personal hearing decisions earlier issued to it.
The marriage palace is complying with the mechanism/guidelines for control of pollution and enforcement of environmental norms at individual establishments and the area / cluster of restaurants / hotels / motels / banquets etc. framed by the CPCB and adopted by PPCB vide letter no. SEE(HQ-2)/2021/64 dated 02.02.2021.
The marriage palace is now complying with the decisions of personal hearing earlier given to it.
In view of the above, it is recommended that consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention &Control of Pollution) Act, 1981 may be granted to the marriage palace upto 30.06.2025 with subject to suitable conditions and additional conditions that: -
1. The marriage palace will operate its STP adequately and efficiently and will maintain daily record regarding operation of the same.
2. The marriage palace shall submit effluent analysis results from Boards lab within one month.
3. The marriage palace shall maintain record regarding utilization of fresh water on daily basis.
4. The marriage palace shall apply for obtaining authorization under the Hazardous and Other Wastes (Management and Trans-boundary Movement) Rules, 2016 within one month.
5. The marriage palace will comply with the mechanism/guidelines for control of pollution and enforcement of environmental norms at individual establishments and the area / cluster of restaurants / hotels / motels / banquets etc. framed by the CPCB and adopted by PPCB vide letter no. SEE(HQ-2)/2021/64 dated 02.02.2021.
6. The marriage palace shall comply with the provisions of the Noise Pollution (Regulation & Control) Rules 2000.
7. The marriage palace shall not allow to play the DJ/ music system outside the hall and not beyond 10.00 PM in any case in compliance to directions issued by the Board vide no. 196 Dated 30.04.2018.
8. The marriage palace shall comply with the guidelines of the Hon’ble Punjab and Haryana High Court as well as the Noise Pollution (Regulation and Control) Rules, 2000 w.r.t operation of DJ system in the marriage palace and shall not operate after 10.00 pm under any circumstances.
9. The marriage palace shall comply with the provisions of the Solid Waste Management Rules, 2016.
10. The marriage palace will be bound to comply with the zoning regulations of the Master Plan in force and the grant of consent by the Board will not vest any right on the industry w.r.t other stipulations by any authority or the zoning regulations of the master plan.
11. The marriage palace shall not carry out any activity in its premise, which can change the category of unit from Orange to Red, without prior permission from PPCB.
12. The marriage palace shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances.
13. The marriage palace shall ensure that the activity of unit does not create any nuisance in the surrounding areas and no public complaints are received.
14. The Consent is being issued to the marriage palace based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time.
15. In case the marriage palace fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the industry.
