It is submitted that earlier the industry was granted consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/SAS/2023/21785147 dated 21.04.2023 valid upto 30.09.2028 and under Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/SAS/2023/21785144 dated 21.04.2023 valid upto 30.09.2028 subject to certain terms and conditions mentioned therein.
Now, the industry has applied for fresh consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 alongwith requisite document. The industry has applied for fresh consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 due to death of old proprietor of the industry.
As per record, the consent fee deposited by the industry is adequate upto 30.06.2029 under both the Acts.
The industry has submitted compliance report of the previous granted consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 as well as code of practice framed for such type of units.
The industry has submitted “WILL” of Sh. Vishnu Bhagwan Mittal, in which it is stated that Sh. Gaurav Mittal will be inheritor and successor of the above rice sheller after death of Sh. Vishnu Bhagwan Mittal. The industry has submitted death certificate of Late Sh. Vishnu Bhagwan Mittal.
The industry has submitted affidavit in which, it has been mentioned that:
“I, Gaurav Mittal, Son of Vishnu Mittal, aged 39 years, residing at #3438, Ward no. 15, Near Arya College Kharar, my aadhar no. is 5165 3410 3547, do solemnly affirm and declare as follows:
1. That my father, Vishnu Mittal, was the sole proprietor of M/s Kharar Rice Mill, situated at village Tripari Tehsil- Kharar Distt. SAS Nagar, until his demise on 12/05/2024.
2. That Subsequent to his passing, as per the last will and testament of my father, he has designated me as the inheritor and successor to the said rice mill.
3. That I hereby affirm my acceptance of the responsibility to operate and manage M/s Kharar Rice Mill in accordance with the terms and conditions laid down by the department and accepted by my father through the agreement with the department. Furthermore, I am the sole proprietor of Said rice mill.”
The site of the industry was visited by undersigned on 02.07.2024. During the visit, it was observed as under:
1. The above rice Sheller plant was not in operation due to off season.
2. The rice sheller is complying with code of practice laid down for such units.
3. The Rice Sheller is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
4. Further, there is no complaint/ court case pending against the rice sheller as per record file of this office.
In view of the above, may if approved, it is recommended that consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 30.09.2028 subject to suitable terms and conditions and following additional conditions that:
1. The industry shall comply with the code of practice for the rice shellar vide notification issued by Punjab Government vide no. 10/48/2004-STE(4)1932 dated 11.10.2013.
2. The industry has been approved by the Board from pollution angle and the industry shall obtain the statutory clearances / permissions from all other concerned departments.
3. The industry shall not start any other new process within its unit which may change its category from Orange to Red, without the prior written permission of the Board.
4. The industry shall obtain permission from other concern departments, if need be.
5. The industry shall ensure that there are no usages of single use plastic- thermocol disposable items such as water bottles / water pouches/water cups, plates, forks, spoons, straw etc. and single use decorating material made of plastic-thermocol or any other non-biodegradable material in the premises.
6. The consent is being issued to the industry based upon the undertakings/documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time.
7. The industry shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time.
Competency: Environmental Engineer, Regional Office as per policy of the Board.
