File Note: It is submitted that the subject cited establishment is a Dhaba-cum-Restaurant-cum-Banquet Hall-cum-Hotel and has established without obtaining consent to establish from the Board. Now, the project proponent has applied for obtaining fresh consent to operate under the Water Act, 1974 and Air Act, 1981 for operation of its hotel (36 rooms), restaurant of capacity 100 persons and 1 no. banquet hall of capacity 100 persons under orange category i.e. 2038-Hotels (< 3 star) or hotels having > 20 rooms and less than 100 rooms or having waste water generation > 10 KLD and less than 100 KLD. The establishment has been issued CLU from Deptt. of Local Govt. vide no. PB/CLU/PTA/RAJPU/641 dated 21.05.2021 for land measuring 5102.82 sqr mts for hotel purpose. The project proponent has submitted approved building plan from the Deptt. of Local Govt. vide no. PB/PTA/RAJPU/105874 dated 03.01.2022. The project proponent has submitted NOC obtained from Municipal Council, Rajpura vide letter no. 446 dated 09.08.2023 for discharge of domestic effluent into sewer after treatment through septic tank. The project proponent has obtained NOC from Punjab Water Supply & Sewerage Board vide letter no. 606 dated 25.10.2023 regarding adequacy of the terminal STP of capacity 7 MLD to take the load the of the wastewater generated from the said hotel (copy attached). The establishment has deposited Rs. 108000/- (Rs. 90000 as Water Consent Fee + Rs. 18000/- NOC regularization Fee) deposited through online vide UTR No. N164243091738573 dated 12.06.2024 under Water Act, 1974 and Rs. 90500/- (Rs. 90000/- as Air Consent Fee + Rs. 500/- as application form fee) deposited through online vide R.No. N164243091742606 dated 12.06.2024 as air consent fee against the fixed assets of Rs. 907.71 lakh as per CA certificate 10.06.2024, which is adequate upto 31.12.2028. The water requirement / wastewater generation of the establishment is as under: a) Total rooms = 36 no.(72 persons) b) Banquet halls = 1 nos. (100 persons) c) Restaurant hall = 1 no. (100 persons) d) Total persons = 272 nos. Water requirement: (72 x 135)+ (100 x 70) + (100 x 70) + (50 x 45) = 9.720 KLD + 7.0 KLD + 7.0 KLD + 2.250 KLD = 25.97 KLD Total wastewater generation = 25.97 x 0.8 = 20.77 KLD Accordingly, the hotel was visited by the officer of this office on 01.07.2024 and it was observed as under: 1. The hotel was found in operation and has provided 36 operational rooms. 2. The hotel has also provided 1 no. banquet halls (Capacity 100 Persons and 1 no. restaurant of capacity 100 persons. 3. The hotel has provided 1 no. of kitchen for preparation of food in hotel. 4. The Hotel is discharging its domestic effluent into sewer. Further, the wastewater generated from the kitchen / washing area is being passed through screen bars followed oil & grease trap and then discharged into MC sewer, leading to Terminal STP of Rajpura 7 MLD capacity. 5. The representative informed that they have also provided O&G trap for treating kitchen wastewater. 6. The establishment is disposing off its inorganic waste directly through MC, Rajupra. 7. The establishment has installed 1 no. DG set of capacity 125 KVA, which is equipped with canopy and stack of adequate height. 8. The establishment is disposing of its kitchen waste through piggery farm. The point wise compliance of the Board’s circular no. 64 dated 2/2/2021 is as under: 1. Water Pollution 1.1 Effluent Treatment Plant a) The Hotel is discharging its domestic effluent generated from toilet into sewer and which will be directed leading to terminal STP of Rajpura of capacity 7.0 MLD. Further, the wastewater generated from the kitchen / washing area is being passed through screen bars followed oil & grease trap and then discharged into MC sewer, leading to terminal STP of Rajpura of capacity 7.0 MLD. i) The establishment has provided screen bars followed oil & grease trap for treatment of wastewater generated from the kitchen in compliance of the Board’s Office Order vide its notification no. 271 dated 10/10/2011. ii) The establishment is discharging its domestic effluent into MC sewer, which will leads to the terminal STP of Rajpura of 7.0 MLD capacity. iii) Same as mentioned at Sr.no. (ii). iv) NA being small scale. b) EP Rules specify effluent discharge norms i) Not applicable. ii) The project proponent is yet to submit analysis report. c) The establishment is discharging its wastewater into MC sewer only. d) The establishment has provided water meters at the source of fresh water supply. e) NA, as being connected with Terminal STP of Rajpura 7 MLD capacity. f) Same as (c). g) The project proponent is yet to submit analysis report. h) Same as (c). i) Not applicable. 1.2. DG set of capacity 125 KVA, which is equipped with canopy and stack of adequate height. d) NA. 2.2. Energy Conservation a) The establishment has provided solar system for producing hot water. b) The establishment has installed 1 no. DG set of capacity 125 KVA, which is equipped with canopy and stack of adequate height. c) The establishment has used only LED bulbs in its premises. 3.0. Consent to establish / Consent to operate a) Complying, / CTO applied. b) Not applicable. c) Not applicable. 4.0. Solid Waste Management a) The kitchen waste (eatable items) is being disposed off through piggery farms and Recyclable/plastic waste is being lifted by MC, Rajpura. Moreover, the establishment is using re-useable crockery and glasses during functions to minimize plastic waste generation. b) Not applicable. Does not fall under the list bulk generators. c) Same as mentioned at 4.0 (a) d) The establishment has installed 1 no. DG set of capacity 125 KVA, which is equipped with canopy and stack of adequate height. e) The plastic / re-recyclable waste is being lifted by MC, Rajpura f) Same as above. g) Same as above. h) Same as above. 5.0. Noise Pollution a) The establishment uses only indoor loudspeakers as permitted upto 10.00 p.m. only. b) Same as above. c) Same as above. d) The establishment has installed 1 no. DG set of capacity 125 KVA, which is equipped with canopy and stack of adequate height. e) The representative of the establishment informed that no burning of crackers are allowed within the premises. f) The establishment uses only indoor loudspeakers as permitted upto 10.00 p.m. only. 6.0. Infrastructure issues and other requirement i) Does not relates to PPCB. ii) Does not relates to PPCB. iii) Does not relates to PPCB. iv) Does not relates to PPCB. v) Does not relates to PPCB. vi) Does not relates to PPCB. Moreover, the Hon’ble NGT while disposing of the matter of O.A. no. 400/2017 titled as Westend Green Society V/s UOI and others has passed orders dated 4/2/2021 and the relevant part of which is reproduced as under: ”ETPs need to be installed by all the big units, not connected to the sewer line.” However, the subject cited establishment is a Small Scale hotel and has provided screen bars followed by oil & grease trap for treatment of kitchen wastewater and is connected with terminal STP of Rajpura of capacity 7.0 MLD. In view of above, it is found that the establishment is complying with the guidelines for control and enforcement of environmental norms as notified by Board’s circular no. 64 dated 2/2/2021. Therefore, keeping in view of above mentioned facts and submissions made by the project proponent, it is recommended that project proponent may be granted fresh consent under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981 up to 31/12/2028 under orange category for operation of its hotel (36 rooms), restaurant of capacity 100 persons and 1 no. banquet hall of capacity 100 persons with usual conditions and special conditions that: - 1. The project proponent shall get its effluent samples analyzed from Board’s / Board’s approved lab in compliance to the Board’s office order dated 10/10/2011. 2. The project proponent shall maintain the record of water meter on the source of its fresh water. 3. The project proponent shall comply with the guidelines of Punjab Water Regulation and Development Authority (PWRDA), issued for the abstraction of ground water from time to time. 4. The project proponent shall not use any unauthorized mode for disposal of treated/untreated wastewater. 5. The project proponent shall regularly get cleaned the oil & grease trap, so that the wastewater can be effectively treated in the septic tank and the Oil & Grease so removed shall be disposed of in an environmentally sound manner. 6. The adequacy & efficacy of the waste water treatment system will be the entire responsibility of the establishment. 7. The establishment shall conform to the standards for treated waste water as laid down by the Board in circular vide no. SEE (HQ-1)/F.244/2011/271 Dated 10.10.2011. 8. The project proponent shall continue to comply with the provisions of the Solid Waste Management Rules, 2016 for disposal of solid waste generated from the hotel. 9. The industry shall ensure segregation of the solid waste at source, facilitate collection of segregated waste in separate streams, handover recyclable material to either authorized waste pickers or authorized recyclers as prescribed in Solid Waste Management Rules, 2016. The bio-degradable waste shall be processed, treated and disposed of through composting or bio-methanation within the premises as far as possible. The residual waste shall be given to the waste collectors or agency as directed by the local body. 10. The project proponent shall comply with the Mechanism/ guidelines prescribed by the Board vide officer order no. 64 dated 02/02/2021 in true letter & spirit. 11. The establishment shall comply with the provisions of Noise Pollution (Regulation & Control) Rules 2000. 12. The consent is granted on the basis of submissions / undertakings submitted by the project proponent, if in future any information provided by the project proponent found to be wrong / false, the consent granted shall be deemed cancelled / revoked. 13. The establishment shall be bound to comply with the bye-laws of Local Planning Area (LPA) notified on 04.05.2011. 14. The establishment shall obtain necessary permissions / NOCs from the concerned departments wherever and whenever required. 15. The establishment shall be bound to shift its unit whenever asked by the competent authority, if the validity of the consents is more than the time period afforded by the authority than the validity of the consent shall be curtailed. 16. As per orders of Hon’ble NGT in the matter of OA no. 606 of 2018 titled as Compliance of Municipal Solid Waste Rules, 2016 in para 16 of the order dated 31.08.2018, the project proponent shall provide mechanical composter for management of organic solid waste.
