It is submitted that the project proponent was granted fresh Consent to Establish (NOC) under the Water Act, 1974 and Air Act, 1981 for establishment of Commercial Complex comprising of Food Court @ 4 number, Water Body @ 1 number and Commercial Shops @ 82 Number under green category vide no. CTE/Fresh/PTA/2023/24346654 dated 27-12-2023, valid upto 03-12-2024 with suitable conditions.
It is submitted that the Project Proponent has now applied for obtaining revised consent to establish (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for establishment of Commercial Colony Development Food Court @ 11 number, Water Body @ 1 number and Commercial Shops @ 80 Number under orange category, with requisite supporting documents i.e. application form, feasibility report, project report, copy of CLU, land documents, revised site plan etc.
In above regards, it is submitted that as per the proposal submitted by the PP, it intends to establish a Commercial Development in the revenue estates of Village Ramgarh, on NH-7, on Rajpura Bhawanigarh Road, Patiala, in an area measuring 8.588 acres.
The project proponent has deposited Rs. 56900/- vide online receipt no. 154309991 dated 16.09.2024 as NOC fee against the project cost of Rs. 4125 lacs, which is adequate for one year. As per the application form, the total land area is 34756 sqm and built up area is 18419 sqm, which is less than 20,000 sqm and hence not covered under EIA notification dated 14.09.2006.
The project proponent has submitted new land registry of additional land 7.0 bigha 9 biswa 15 biswasi. The khewat / khatauni no. 109/163, 110/164 khasra no. 858, 863, 864, 865, 866, 867, 868. The project has also submitted the previous registry of land measuring 33 bigha 14 biswa 10.5 biswasi
The project proponent had obtained change of land use from Office of the Competent Authority-cum-Chief Administrator, PDA, Patiala under Papra Act, 1995 vide memo no. PDA-Admn.A-2-2023/35755 dated 08.10.2023 for development of commercial colony in the name of style of M/s Goldust City Centre Patiala (Developed by Goldust Land Promoters Private Limited) Village Ramgarh, on NH-7, on Rajpura Bhawanigarh Road, Patiala, (H.B. no. 173), and Khewat/Khatoni no. 105/159, 108/162, 109/163, 110/164, Tehsil & District, Patiala of an area of 7.03 acre in khasra no. 842(1-1-10), 843/1(2-12-15), 844/2(0-3-4), 848/1(2-3-3), 849/2(4-0-0), 850/2(4-0-0), 851/1(2-8-4), 855(3-8-0), 856(4-0-0), 857/1(3-18-16), 854/3(0-8-2), 858/2(0-13-13), 865/2(1-10-3), 868/1(2-17-18), 864/2(0-1-9), 869/1(0-7-18) subject to conditions mentioned in the letter.
The project proponent has not submitted CLU of additional area 1.558 acres of land.
As per feasibility report, the total water requirement during the operation of the project shall be 98.45 KLD and total wastewater generation shall be 78.76 KLD for which the project proponent has proposed to install STP having components collection pit, screening, oil & grease removal, primary Treatment (Screen Chamber, Oil & Grease Chamber, Sewage collection tank), Secondary or biological treatment (MBBR Reactor I & II, Secondary Tube Settler), Tertiary treatment (Filter feed Tank, Pressure sand Filter, Activated Carbon Filter, and Hypo Dosing System, UF and UV) and Sludge Treatment (Sludge drying beds). The STP shall be based on MBBR technology of capacity 100 KL.

Proposed Total Water Requirement 98.45 KLD
The treated effluent @ 35.28 KLD will be discharged onto land for plantation. The project proponent will utilize its 35.28 m 3 treated waste water for the plantation purpose as per karnal technology in parks & Green Strips 0.441 acres. and 41.9 KLD reused in dual plumbing. The total land adequate to take the effluent load of 100 KLD. The plantation area is adequate if the green area is to be developed as per Karnal Technology.
The project proponent has submitted in the feasibility report that at full operational activity, 109 kg per day solid waste (considering 0.1 Kg/capita/day) will be generated from the project, which shall consist of Bio degradable (45%) Green waste, food waste, paper waste, which further shall be converted into manure using Mechanical composter @ 49.05 kg/day. Non- Biodegradable Combustible waste, sanitary waste, recyclable waste, plastic Handed over to authorized recycler as per SWM rules, 2016 @ 57.77 kg/day and domestic hazardous waste 2.18 kg/day.
Accordingly, the site of the project proponent was visited by the officer of this office on 28.06.2024 and contacted Sh. Tejinderpal Singh site incharge of the project at site. During visit, it was observed as under:
1. The proposed site of the project proponent falls on NH-7, on Rajpura Bhawanigarh Road, Patiala.
2. The project proponent has started the construction activity.
3. The project proponent has informed that will construct water body (lake) which will filled one time. There will be no discharge of waste water from the water body.
4. The project is in proximity with Moti Bagh Wild Life Sanctuary and the reprehensive informed that 100 mtr of distance has been left between the project and the Wild Life Sanctuary.
There is no air polluting industries within 100 mtr of the project site and also there is no MAH project proponent within 250 mtr of the said site. As such, the site is also complying with notification no. No. 3/6/07/STE(4)/2274 Dated 25.07.2008.
There is clarification vide Board letter no. 4426-49 dated 05.02.2009 in which it was mentioned that the prescribed distance are to be maintain or not from the various category of above mentioned industries (i.e. rice shellers/saila plant/stone crushers/brick kilns/cement plants/cement grinding units/hot mix plants) for establishments of residential colonies/commercial establishments, was discussed in a meeting held under the chairmanship of Chief Secretary, Punjab on 13.01.2009 and it was decided as under:
a) The distance of 500m and 300m as prescribed in the above mentioned notification for establishment of rice shellers/saila plants/stone crusher and brick kilns/cement plants/cement grinding units/hot mix plants, respectively, would be maintained by the new residential colonies to be established outside the local planning area (LPA) i.e. these notifications would be deemed to be operative vice-versa also.
b) The residential/commercial establishments shall be allowed within the Local Planning area as per the land use prescribed in the master plan/draft master plan of the area irrespective of their distance from the rice shellers/saila plants/stone crushers/ brick kilns/ cement plants/ cement grinding units/ hot mix plants. However, minimum buffer of 15m green belt of broadleaf trees should be provided by the colonizer towards the air polluting industries, boundary of which are located within 100m from the boundary of such projects.
In this case, no air polluting industry and MAH industry is located within 100 mtr of the said site. The site is suitable for establishment of the project.
In view of above, if approved, recommendations may be sent to the competent authority that the consent to establish (NOC) under the Water Act, 1974 and the Air Act, 1981 to the Project proponent granted may be granted for one year with the suitable conditions and following special conditions that:
1. The project proponent shall obtain prior Environment Clearance, as per EIA notification 14.09.2006, (if applicable), amended from time to time.
2. The project proponent shall submit approved building plan before commissioning of the project, in which built up area of the project should be mentioned.
3. The project proponent shall get its CLU revised by the Competent Authority-cum-Chief Administrator, PDA, Patiala under Papra Act, 1995.
4. The project proponent shall obtained LOI and other necessary permission from the concerned department and submit the copy in the Board.
5. The project proponent shall install STP as proposed in the application submitted by it.
6. The project proponent shall ensure that a storm water drain does not get mixed with untreated / treated sewage line
7. The project proponent shall properly handle and manage the solid waste as per the provisions of the Municipal Solid Waste Management Rules, 2016 and ensure that the solid waste is segregated Into biodegradable and non-biodegradable components. The biodegradable component shall be treated by providing mechanical composter to produce compost, which will be disposed of/reused in an environmentally sound manner and the non- biodegradable solid waste shall also be disposed of in an environmentally sound manner.
8. The project proponent shall comply with the provisions of E-Waste Management Rules, 2022 in true letter and spirit.
9. The project proponent shall comply with the provisions of Plastic Waste Management Rules, 2016 in true letter and spirit.
10. In case any other unit such as microbrewery / service station etc. other than food court / restaurant comes in the said project than those unit shall be liable to obtain separate NOC / CTO from the Board.
11. The project proponent shall ensure compliance of noise pollution rules, 2000 in true letter and spirit and no noise pollution is caused in the vicinity due to the project.
12. The project proponent shall ensure scientific disposal of its entire treated wastewater onto land for irrigation /green area to be provided by it and shall not discharge any trade effluent.
