The industry was obtained consent to operate under the Water Act, 1974 and Air Act, 1981 both expired on 31/03/2023 for manufacturing of measuring tapes, spirit levels, knives @ 1,10,000 Numbers/day using Yarn @ 275 Kgs/day, Steel Strips @ 5500 Kgs/day, Plastic and PVC @ 3200 Kgs/day, Xylene @ 18 Ltr./day, Paint @ 950 Ltr./day, Toluene @ 14 Ltr./day as material.
The industry was visited by the officers of the Board on 08.12.2023 and various violations were observed during visit.
Hence, the industry was issued show cause notice for violation of provisions under the Water Act, 1974 alongwith notice for imposition of Environment Compensation (EC) with an opportunity of personal hearing before the Chairman of the Board on 15.03.2024 in which following decisions were taken: - 1. The industry shall close the soakage pit, immediately. 2. The industry shall take requisite steps to improve rain water harvesting pit. 3. The industry shall not operate its phosphating section without obtaining NOC of the Board. 4. The industry shall operate its STP regularly and efficiently, so as to achieve prescribed effluent standards. 5. The industry shall apply for consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, within 15 days. 6. The industry shall apply for varied authorization under Hazardous and other Waste (Management & Transboundary Movement) Rules, 2016 for hazardous waste categories 5.2, 21.1 and 33.1, within 15 days. 7. The industry shall apply for EPR registration under the Plastic Waste Management Rules, 2016, within 15 days. 8. The industry shall make adequate arrangements for handling and management of solid waste. 9. The industry shall submit Bank Guarantee of Rs. 30 lacs, within 15 days, as an assurance to comply with the provisions of the Water Act, 1974, Air Act, 1981 and Hazardous and other Waste Rules, 2016, out of which Bank Guarantee of Rs. 15 lacs be encashed. 10. The Environmental Engineer, Regional Office-2, Ludhiana shall verify the submission made by industry and process consent / authorization applications, accordingly.
To verify the compliance of the decisions of personal hearing, the industry was visited by RO on 20.05.2024 and RO reported as under: -
1. The industry has closed the soakage pit permanently.
2. Now, it has improved the up-keep of Rain Water harvesting system.
3. Phosphating section was lying non-operational condition. The representative of the industry informed that phosphating section has not been operated after hearing and same will not be operated without obtaining NOC of the board.
4. Now, the industry has applied for NOC to operate its Phosphating section alongwith required documents and fee.
5. The STP installed by the industry was in operation. The samples from the final outlet of STP were collected during visit. As per analysis report the concentration of various parameters were found such as pH= 7.2, TSS=26 (mg/l), TDS=461 (mg/l), COD=176 (mg/l), BOD=35 (mg/l), Oil & Grease=7.6 (mg/l) which are within the prescribed limits fixed by the Board.
6. Now, the industry has applied for consent to operate under the Water Act, 1974, Air Act, 1981 and authorization under Hazardous and other Waste Rules, 2016 for hazardous waste categories 5.1, 5.2, 21.1 and 33.1, which has been processed separately for grant.
7. Now, the industry has obtained the registration certificate for Importer of the Plastic Waste Management Rules, 2016 vide Regd. No. IM-13-000-06-AAACF2540H-24 dated 13.06.2024.
8. The industry is lifting its Solid Waste to M/S A2V Infra Services, Bhadaur House, Booth No. 6, Arya School Road, Ludhiana, which is the authorized by Municipal Corporation, Ludhiana vide its Letter No. 97/CS-I/ZB/D dated 27.03.2023.
9. The industry has submitted a Bank Guarantee of Rs. 30 lacs bearing No. 034GT02241170002 dated 19.04.2024 with validity period of 19.04.2025 out of which Bank Guarantee of Rs. 15.00 Lacs has been encahsed on 14.05.2024.
Now, the industry has applied for NOC for manufacturing existing production of measuring taps and knives @ 1,50,000 Nos/Day and Spirit Level @ 5000 Nos/Day (with phosphating process) alongwith required documents and fee. The details of visit are as under:-
1. The industry is engaged in the manufacturing of measuring tapes, spirit levels, knives using Yarn, Steel Strips, Plastic and PVC, Xylene, Paint and Toluene as material.
2. During visit, industry was in operation, but phosphating section was lying non-operational condition.
3. The manufacturing process of the industry is as under :- Raw Materials CRM Slitting Heat Treatment Of Tapes Paint Printing Varnish Tape Cutting Riveting Measurement Winding & Assembly Checking & Cleaning Labelling Packing Super Checking Dispatch.
4. The industry has made an agreement with M/S J.B.R. Technologies Pvt. Ltd., Ludhiana @ 20,000 Lts/Month on 17.05.2024.
5. It has also installed the Water meter in process area and reading of the same was 529.0 KL.
6. The industry has commissioned its phosphating process in the Month of September, 2023 (as per bill produced by the industry it has fabricated its phosphating Tank from M/S J.V. Enterprises (India) St.No.2,1/2, Daba Road, Near Oswal Mills, G.T.Road, Ludhaina vide Bill No. 231 dated 28.09.2023 of Rs. 3,09,160/-)
7. During visit, the samples of treated domestic effluent were collected from the final outlet of STP and were sent to Zonal Lab., Ludhiana for analysis. As per analysis report the concentration of various parameters were found: pH= 7.2, TSS= 26 (mg/l), TDS= 461(mg/l), COD=176 (mg/l), BOD = 35(mg/l) and Oil & Grease = 7.6, which were within the prescribed limits fixed by the Board.
8. The treated domestic effluent and is discharged onto land for plantation/gardening after treatment in STP.
9. It has installed 4 D.G. sets of capacity 500 KVA each and 1 DG set of capacity of 250 KVA which is equipped with canopies and adequate stack heights.
10. It has installed 6 Electric Hardening Furnaces, 6 Electric Tempering furnaces, 4 Paint Booth, 2 Powder Coating booths, 2 electric baking oven, HSD fired Baby Boiler with adequate stack height with other allied machinery.
11. The industry has provided two submersible pumps with common water meter and reading of the same was 241152 KL. The industry is maintaining the record of water consumption.
12. The industry has submitted approved building plan from Competent Person duly approved by Director of Factories, Punjab.
13. The industry has submitted certificate from CTP, Punjab, Chandigarh regarding adjustment of M/s FMI Limited issued vide no. 4322 dated 29.09.2017 mentioning that the industry is operating before the Master Plan, Ludhiana, therefore, the site has been adjusted and no objection certificate has been issued to the industry.
14. The industry is complying with the provisions under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
15. As per project report the cost of Phosphating Section is Rs. 20.12 Lacs.
RO recommended that NOC for manufacturing existing production of measuring taps and knives @ 1,50,000 Nos/Day and Spirit Level @ 5000 Nos/Day (with phosphating process) under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry.
In view of the above, it is recommended that 'Consent to Establish' (NOC) under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry as proposed by RO.
