File Note: • It is intimated that the project proponent has proposed to establish a small scale green category flour mill. • The industry has applied for ‘Consent to Establish' (NOC) under the Water (Prevention and Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 with requisite documents. • The industry has deposited Rs. 6400/- vide UTR No. 222195238 dated 29.06.2024 under NOC fee. • The industry has submitted land use classification from DTP, Kapurthala vide letter No. 131/DTP(K)EC-1 dated 14.02.2024 in which it is mentioned that the site does not fall in any notified Master Plan/Local Planning Area. The PP has proposed to establish flour mill (dry process) which falls under green category and as per memo no. 2180-2283/CTP(PB)/SP-432(GEN) dated 14.06.2023 issued by Director, Town & Country Planning, Punjab “Applicant/firm shall be liable to abide by the provisions of Master Plan and shall also be bound to follow the provisions of section 79 along with other provisions of PRTPD Act, 1995, in case the site falls in non-conforming land use zone after the notifications of Master Plan and no claim shall be demanded by the applicant from the Department of Housing & Urban Development". The DTP, Kapurthala has further added a condition in the land use classification letter that the industry shall be liable to follow the conditions of Master Plan, Fattu Dhinga to be notified in future and if the industry falls in non-confirming land use zone after notification of the Master Plan, then as per the memo no. 2180-2283/CTP(PB)/SP-432(GEN) dated 14.06.2023 issued by Director, Town & Country Planning, Punjab “Applicant/firm shall be liable to abide by the provisions of Master Plan and shall also be bound to follow the provisions of section 79 along with other provisions of PRTPD Act, 1995, in case the site falls in non-conforming land use zone after the notifications of Master Plan and no claim shall be demanded by the applicant from the Department of Housing & Urban Development". • To verify the facts, the industry was visited by EE alongwith AEE of this office on 02.07.2024 and observed that:- 1. The PP has constructed boundary wall and construction of first floor is underway. 2. No residential houses are located within 100 meters of the site. As such, the site is suitable. 3. There will be no source of air pollution. 4. Domestic effluent will be discharged onto land for plantation after septic tank. Keeping in view of above, it is recommended that consent to establish (NOC) under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the project proponent for one year with suitable conditions and with special condition that the industry shall be liable to follow the conditions imposed in land use classification letter issued by DTP, Kapurthala vide No. 131/DTP(K)EC-1 dated 14.02.2024 and the Board shall not be liable for any financial loss caused to the PP in case the site falls under non-confirming land use zone in future, if any.
