Sub: Proceeding of the personal hearing given before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 03.07.2024 w.r.t. show cause notice for refusal of consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 to M/s KS Cycles, Street No. 1, Industrial Estate, Umaidpur, Sahnewal, Ludhiana.

The Add. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry is a Small Scale, Orange Category unit. Earlier, the industry was issued notice to issue directions u/s 33-A of the Water Act, 1974 and u/s 31-A of the Air Act, 1981 with an opportunity of personal hearing before the Chief Environmental Engineer, Ludhiana on 06.06.2024, wherein it decided as under:-
1. The industry shall discharge only domestic effluent onto land for plantation through septic tank.
2. The industry shall remove stagnation from plantation area and shall ensure that there is no stagnation in future.
3. Environmental Engineer, Regional Office shall verify submissions made by the industry and process consent applications on merits.
The industry has applied fresh consent to operate under the Air (Prevention & Control of Pollution) Act, 1981.
The site of the industry was visited by officer of the Board on 07.06.2024 and it was observed as under:-
1. The industry was in operation during visit.
2. The industry is engaged in the process of manufacturing Mudguard, Mudguard wire with powder coating process.
3. It has installed 25 No. powder presses of different capacities and failed to submit noise monitoring report and failed to intimate arrangements provided to control the noise.
4. The industry has installed 1 diesel fired baking oven but failed to submit analysis report of air emissions.
5. Moreover, the industry has been established without NOC of the Board. The industry has not submitted point wise compliance to the NOC conditions which would have been imposed if the industry earlier had obtaining 'Consent to Establish' (NOC).
In view of the above, the industry was issued cause notice for refusal of consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 with hearing before the Senior Environmental Engineer of the Board on 03.07.2024.
Sh. Charnjit Kumar, Proprietor of the industry attended the hearing and submitted written reply which has been taken on record. He submitted that the industry is engaged in the process of manufacturing Mudguard, Mudguard wire with powder coating process and has installed powder presses without hammers. The industry has installed proper stack with diesel fired baking oven. He will apply for NOC of the Board.
After hearing the industry, officer of the Board and considering material facts on record, the Senior Environmental Engineer of the Board decided that:-
1. The industry shall discharge only domestic effluent onto land for plantation through septic tank.
2. The industry shall ensure that there is no stagnation in plantation area in future.
3. The industry shall provide adequate arrangements for control of process emissions.
4. Environmental Engineer, Regional Office shall verify submissions made by the industry and submit recommendations accordingly. He shall also give his comments on the requirement of APCD and analysis of air emissions.
Submitted for confirmation of decisions of the hearing and for conveying to the industry and Regional Office for compliance of above decisions, please.
