Sub: Proceeding of the personal hearing given before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 03.07.2024 w.r.t. show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 to M/s P.L. Bright Bar Industries, B-29-II, Near Yuvraj Overseas, Kanganwal, Ludhiana.

No one attended the hearing
The Add. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry is a small scale red category unit. The industry has applied for fresh of consent to operate under Water Act, 1974 & Air Act, 1981.
The application of the industry has been perused and following observations has been made:-
1. The industry is red category unit and has been established without NOC of the Board.
2. The industry has submitted the copy of electric connection released on 31.08.2021 and made an agreement with M/s Keshav Chemical Pvt. Ltd., on 26.03.2024. The industry is discharging effluent into sewer from 31.08.2021 to 26.03.2024.
3. The industry is newly established unit and has not submitted the certificate from Competent Authority regarding land use pattern of the area.
4. The industry has not submitted month wise details w.r.t. water consumption and effluent generation from process from date of agreement with re-processor.
5. The industry has not submitted point wise compliance to the NOC conditions which would have been imposed if the industry earlier had obtaining 'Consent to Establish' (NOC).
In view of the above, the industry was issued show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 with hearing before the Senior Environmental Engineer of the Board on 03.07.2024.
No one from industry attended the hearing and not submitted any written reply
After hearing, officer of the Board and considering material facts on record, the Senior Environmental Engineer of the Board decided that another opportunity of personal hearing be given to the industry.
Submitted for confirmation of decisions of the hearing and for conveying to the industry and Regional Office for compliance of above decisions, please.
