Sub: Proceeding of the personal hearing given before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 03.07.2024 w.r.t. show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 to M/s HSN Fasteners Private Limited, Village Kanganwal, H B No. 245, Near Texla Plastics Pvt. Ltd, Ludhiana.

The Add. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry is a small scale red category unit. The industry has applied for fresh of consent to operate under Water Act, 1974 & Air Act, 1981.
The application of the industry has been perused and following observations has been made:-
1. The industry is red category unit and has been established without NOC of the Board.
2. The industry has submitted lease / rent deed dated 01.04.2022 as proof of date of commissioning and made agreement with M/s JBR Technologies Pvt. Ltd., CETP, Focal Point, Phase-VIII, Ludhiana on 11.09.2023. The industry has failed to intimate the status of generation of effluent from the period 01.04.2022 to 11.09.2023. The industry is required to submit the proof regarding date of installation of electric connection.
3. The industry has not submitted copy of approved building plan from the Director of Factories.
4. The industry has not submitted month wise details w.r.t. water consumption and effluent generation from process from date of agreement with CETP operator i.e. 11.09.2023.
5. The industry has not submitted point wise compliance to the NOC conditions which would have been imposed if the industry earlier had obtaining 'Consent to Establish' (NOC).
In view of the above, the industry was issued show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 with hearing before the Senior Environmental Engineer of the Board on 03.07.2024.
Sh. Gaurav Jain, Director of the industry attended the hearing and submitted written reply which has been taken on record. He submitted that the industry was earlier doing only machining work from 01.04.2022 and obtained NOC of the Board on 28.2.2024 for establishment of zinc plant and now applied for consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 alongwith agreement with M/s JBR Technologies Pvt. Ltd., CETP, Focal Point, Phase-VIII, Ludhiana. They maintaining record of water consumption and effluent lifting. They have mentioned the tentative date of commissioning in application form of 'Consent to Establish' (NOC) and they have submitted approved building plan. The details of water consumption and disposal is submitted with application form. The compliance report of NOC is also submitted with the application.
After hearing the industry, officer of the Board and considering material facts on record, the Senior Environmental Engineer of the Board decided that:-
1. The industry shall regularly lifted the trade effluent to CETP operator regularly and maintain the record of water consumption and lifting.
2. The Environmental Engineer, Regional Office shall verify submissions made by the industry and submit recommendations accordingly.
Submitted for confirmation of decisions of the hearing and for conveying to the industry and Regional Office for compliance of above decisions, please.
