Sub: Proceeding of the personal hearing given before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 03.07.2024 w.r.t. show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 to M/s D.G.N Petro, Plot No. 21, Shiv Shakti Industrial Area, Village - Tibba, Ludhiana.

The Add. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry was visited by the officer of the Board on 05.03.2024 and it was observed as under:-
1. During visit the industry was in operation and involved in manufacturing of grease from lubricants.
2. The industry has installed 03 blending vessels machines (3 Tons each) and 1 packaging machine.
3. The industry has installed0 1 Thermopack boiler (1 Lac cal capacity) which is furnace oil fired but is without any APCD.
4. Only domestic effluent is generated but the industry has not provided any adequate plantation area for its disposal.
5. The industry is commissioned without NOC /consents of the Board and is operating without the consent to operate under Water Act, 1974 & Air Act, 1981 of the Board.
The industry was show cause notice for violation of provisions of the Water Act, 1974 and Air Act, 1981 with hearing before the Senior Environmental Engineer of the Board on 15.05.2024, wherein it was decided as under:-
1. The industry shall close soakage pit immediately and develop adequate plantation area for discharge of treated domestic effluent.
2. The industry shall submit within 7 days Bank Guarantee of Rs. 1.00 lac as an assurance to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 in future at all times
3. The industry shall apply for obtaining consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, within 07 days.
4. The Environmental Engineer, Regional Office-1, Ludhiana shall verify submission made by the industry and process consent applications on merits.
5. Re-hearing be given to the industry after 15 days to review compliance of decisions of hearing.
The industry was issued show cause notice for violation of provisions of the Water Act, 1974 and Air Act, 1981 with hearing before the Senior Environmental Engineer of the Board on 03.06.2024, wherein it was decided as under:-
1. The industry shall close soakage pit immediately and develop adequate plantation area for discharge of treated domestic effluent.
2. The industry shall submit within 02 days, the Bank Guarantee of Rs. 1.00 lac, as already imposed during hearing held on 15.05.2024.
3. In case, the industry fails to make the compliance, action u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 shall be recommended to CEE Ludhiana.
4. The Environmental Engineer, Regional Office shall verify submission made by industry and submit further recommendations, accordingly.
The industry has applied fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981
The industry has not submitted the Bank Guarantee of Rs. 1.0 lacs imposed during hearing held on 03.06.2024.
In view of the above, the industry was issued show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 with hearing before the Senior Environmental Engineer of the Board on 03.07.2024.
Sh. Saranjeet Singh, Proprietor of the industry attended the hearing and submitted written reply which has been taken on record. He submitted that the industry is engaged in manufacturing of grease from lubricants and has installed 03 blending vessels machines (3 Tons each) and 1 packaging machine, 01 Thermopack boiler with proper stack and there is no requirement of APCD. They have provided adequate plantation area for disposal of domestic effluent. They will submit Bank Guarantee of Rs. 1.0 lacs within a week.
After hearing the industry, officer of the Board and considering material facts on record, the Senior Environmental Engineer of the Board decided that:-
1. The industry shall discharge only domestic effluent onto land for plantation through septic tank.
2. The industry shall submit within 7 days Bank Guarantee of Rs. 1.00 lac as already imposed during hearing dated 15.05.2024.
3. Environmental Engineer, Regional Office shall verify submissions made by the industry and submit recommendations, accordingly.
Submitted for confirmation of decisions of the hearing and for conveying to the industry and Regional Office for compliance of above decisions, please.
