It is intimated that the reply of the observations raised by the Competent Authority is as under:
1) It is intimated that the industry has installed machinery as per consent to establish (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. It is intimated that project cost of Rs. 1.44 Crore was projected figure at the time of applying NOC. Now, the actual cost of the plant & machinery & other fixed assets is Rs. 4.78 or as proposed at the time of NOC.
2) The industry was visited by officers of this office on 27.06.2024 and during visit Sh. Hitesh Jain, Partner of the unit contacted. He informed that the industry is running on trail basis only. The industry has not commissioned w.e.f 01.01.2023.
3) Earlier, the industry has applied for Consent to establish (NOC) for extension and same was returned due to reasons mentioned therein. At that time the industry has deposited Rs. 4700/- as NOC fee. In view of above, the fee deposited by the industry after deduction of the NOC regularization fee (54000/- +54000/- + 4700/- = 112700/-) – 15500/- = 97200. The fee deposited by the industry is adequate upto 31.03.2028.
In view of above, it is recommended that the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 30.09.2025 with conditions as already recommended.
