The note of Regional Office may kindly be perused.
The industry is a medium scale (Plant and Machinery- 5.23 cr) red category dyeing unit and was granted consent to operate under the Water Act, 1974 vide no. CTOW/Renewal/LDH3/2020/13001263 dated 09.09.2020 for dyeing of cloth @ 2000 Kgs/day, Printing of Cloth @ 1000 Kgs/day, Finishing of Cloth @ 2000 Kgs/day and Raising of Cloth @ 2000 Kgs/day with trade effluent @ 200 KLD onto land for plantation after treatment through ETP and domestic effluent @ 5 KLD onto land for plantation after passing through septic tank, which was valid upto 30.06.2024……
Thereafter, notice u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 was issued to the industry with the opportunity of personal hearing given before the Chief Environmental Engineer, Ludhiana on 19.12.2023. After hearing Competent Authority of the Board was decided as under: -
1. The industry shall dismantle the steam and electric connection of the excess machinery having discharge beyond the DEMAT shares. These excess machines shall be sealed by the Regional Office of the Board till the industry obtains revised CTE/CTO for the same.
2. The industry shall apply, within 10 days, for consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 alongwith following documents:
• The industry shall submit data regarding abstraction of ground water / fresh water supply for the last three months. It shall provide EMFs on all sources of fresh water if not provided earlier. • The industry shall earmark on map the location of all active / closed submersible pumps / fresh water sources.
• Details of dyeing machinery / other water consuming machinery along with specifications including production capacities specifying liquor ratio, number of lots, water consumption per lot, thus calculating the total fresh consumption (with duly authenticated). • Numbers of shares held by the industry (duly certified by the SPV) along with NOC from PDA/ SPV regarding proposed discharge into common sewer of CETP.
• The industry shall get its shares DEMAT and submit the documentary evidence in this regard. By the time, the DEMAT process is completed, the industry shall submit a certificate from Company Secretary of the PDA for the shares that have been recommended to the ROC for DEMAT.
• Record of discharge during the last three months as per SCADA.
• NOC from the PDA allowing quantum of discharge into the common conveyance system of CETP of 50 MLD capacity.
3. Environmental Engineer, Regional Office-3, Ludhiana shall visit the industry to verify its contentions and process the consent application on merits. He is also requested to take action as per decision no. 1, above.
4. It was made clear to the industry that in case it is found operating beyond the DEMAT shares capacity, without prior permission of the Board, strict action may be taken which may include closure without any further notice/ opportunity of personal hearing.
In compliance of above said decisions industry was visited by officer of the Board to seal the excess machinery but it was observed that the industry had got DEMAT all 873 shares and same were adequate to manage the quantum of discharge from installed machinery therefore no machinery was sealed by the visiting officer…….
Now, the industry has applied for varied consent to operate under Water Act, 1974 for dyeing and finishing of polyester fabric @ 22.125 T/day or dyeing and finishing of cotton/polyester-cotton fabric @ 8.85 T/day with trade effluent generation @ 868.0 KLD & domestic effluent @ 5.0 KLD into conveyance system of CETP 50 MLD………
The industry has deposited adequate fee upto 30.06.2029 as verified by the RO……..
Regional Office has reported that the industry has submitted the copy of letter issued by DTP, Ludhiana vide memo no. 1387/DTP(L)/M2A dated 25.04.2011 stating that the site of the industry falls in industrial zone as per Master Plan, Ludhiana (2007-2021) ……..
The industry has also submitted certificate from Company Secretaries stating that:-
• Shares held in DEMAT (A/C No. IN300239-80035396) as per the list provided by SKYLINE dated 07th June 2024 = 873 KLD. …………
The industry has submitted bills of PDA regarding discharge and as per these bills for the month of February 2024, March 2024 & April 2024 the average discharge of the industry into CETP conveyance system are 388.72, 467.80 KLD and 519.32 KLD respectively, which is well within the shares obtained as well as consent granted to it. ……..
The industry has earmarked the location of its submersible pumps on map……
The industry has submitted the detail regarding capacity of machines, number of lots, number of baths, liquor ratio, production and corresponding effluent generation which has been verified by the RO……
Regional Office reported that the industry has submitted the requisite documents as required for obtaining consent to operate of the Board for unit connected with CETP 50 MLD as verified by the Regional Office.
The industry was visited by the AEE of RO on 26.06.2024 and reported that the industry is complying with the provisions of Water Act, 1974……
It is pertinent to mention here that it was decided as under in the e-noting no. 21071130:
“The consents being presently given to the member units conditionally to settle the share issue, may be given for at least one year with the condition that in case of any variation of shares at the time of final settlement with PDA / approval by the Board, the industry concern is bound to follow the production / effluent discharge from their unit accordingly and obtain revised consents with modified figures of production and effluent discharge as per the final share allotment.”
However, the industry has submitted DEMAT certificate as certified by the Company Secretary as mentioned above….
Thus, the consent can be granted to the industry as the shares have already been DEMAT and can be considered to be final as per the practice of the Board…….
Further, it is pertinent to mention here that it was decided as under in the e-noting no. 19582356 (copy attached herewith):
“It shall be ensured that no further CTE/CTO for any new/expansion of dyeing units shall be given without the permission from Head office.”
Thus, the competency to decide the case falls with Worthy Chairman of the Board.
As proposed by Regional Office, it is recommended that varied consent to operate under Water (Prevention & Control of Pollution) Act, may be granted to the industry upto 30.06.2029 for dyeing and finishing of polyester fabric @ 22.125 T/day or dyeing and finishing of cotton/polyester-cotton fabric @ 8.85 T/day with trade effluent generation @ 868.0 KLD & domestic effluent @ 5.0 KLD into conveyance system of CETP 50 MLD subject to the condition that:-
• The industry shall make the necessary arrangements to achieve the effluent standards as per the inlet designed parameters of the CETP.
• The industry shall stop discharging its effluent in case due to any reason the CETP is not operational or dedicated conveyance system is overflowing.
• The industry shall maintain the record of flow meter installed at outlet leading to CETP.
• The industry shall not generate/discharge trade & domestic effluent more than 873 KLD without obtaining prior permission of the Board.
