• The proposed unit is a small scale orange category Rice Sheller unit.
• The project proponent has applied for obtaining Consent to Establish (NOC) under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 to the Board through OCMMS of the Board for the establishment of a new unit at Village Kang Khurd & Kotha Tehsil Shahkot District Jalandhar for proposal to manufacturing of Raw Rice @ 5 MTD, Rice Bran @ 0.8 MTD, Rice Husk @ 1.4 MTD and Paddy @ 7.5 MTD as raw material under Orange category.
• The industry has deposited NOC fee of Rs.10800/- & Rs. 500/- as form fee vide Receipt No. 875861379 dated 28.06.2024. Adequate for one year.
• To verify the facts, the site was visited by officer of this office on 03.07.2024 and it was observed as under: -
1. The site is located in the revenue estate of Village Kang Khurd & Kotha Tehsil Shahkot District Jalandhar.
2. The industry has not started construction work at site.
3. The industry has proposed to use 2.0 KLD of water for domestic use, thus only domestic effluent @ 1.5 KLD will be discharged onto land for plantation after passing through septic tank. There will be no generation of trade effluent at site.
4. The industry has proposed to install 1 no. of Dryer section, 1 no. of shelling section with cyclone separator as APCD.
5. The industry has proposed to install 1 no. of D.G set of capacity 75 KVA with canopy and adequate stack height.
6. The project proponent has submitted DTP letter vide no. 702 dated 27.06.2024, which is reproduced as under:-
1) ਸਾਈਟ ਕਿਸੇ ਵੀ ਫੋਕਲ ਪੁਆਂਇੰਟ ਅਤੇ ਡੈਜੀਗਨੇਟਡ ਇੰਡਸਟਰੀਅਲ ਜੋਨ ਵਿੱਚ ਨਹੀਂ ਪੈਂਦੀ ਹੈ ।
2) ਇਹ ਸਾਈਟ ਕਿਸੇ ਵੀ ਨੋਟੀਫਾਈਡ ਮਾਸਟਰ ਪਲੈਨ ਵਿੱਚ ਨਹੀਂ ਪੈਂਦੀ ਅਤੇ ਨਾ ਹੀ ਕਿਸੇ ਨੋਟੀਫਾਈਡ ਮਾਸਟਰ ਪਲੈਨ ਦੀ Urbanisable Limit ਦੇ 500 ਮੀਟਰ ਦੇ ਘੇਰੇ ਵਿੱਚ ਪੈਂਦੀ ਹੈ । ਸਾਈਟ ਦਫਤਰੀ ਰਿਕਾਰਡ/ਗੂਗਲ ਈਮੇਜ਼ ਅਨੁਸਾਰ ਕਿਸੇ ਲੋਕਲ ਬਾਡੀ ਲਿਮਟ ਦੇ 02 ਕਿਲੋਮੀਟਰ ਦੇ ਘੇਰੇ ਅੰਦਰ ਨਹੀਂ ਪੈਂਦੀ ਹੈ ।
3) ਸਾਈਟ ਕਿਸੇ ਵੀ ਬਾਈਪਾਸ, ਨੈਸ਼ਨਲ ਹਾਈਵੇ, ਸਟੇਟ ਹਾਈਵੇ ਅਤੇ ਸ਼ਡਿਊਲਡ ਰੋਡ ਤੋਂ 500 ਮੀਟਰ ਦੇ ਘੇਰੇ ਵਿੱਚ ਨਹੀਂ ਪੈਂਦੀ ਹੈ ।
7. The Project Proponent has submitted a Letter Regarding Land use Classification from DTP vide no. 225 dated 09.02.2024, which is reproduced as under:-
1) ਇਹ ਸਾਈਟ ਪਿੰਡ ਚੱਕ ਗਦਾਈਪੁਰ ਤੋਂ ਪਿੰਡ ਕੱਕੜਖੁਰਦ ਨੂੰ ਜਾਂਦੀ ਲਿੰਕ ਰੋਡ ਤੇ ਪਿੰਡ ਗਤੀਪੀਰ ਬਖਸ਼ ਨੂੰ ਜਾਂਦੀ ਲਿੰਕ ਰੋਡ ਤੋ ਲਗਭਗ 770 ਮੀਟਰ ਦੀ ਦੂਰੀ ਤੇ ਖੱਬੇ ਪਾਸੇ ਪਿੰਡ ਕੰਗ ਖੁਰਦ (ਹ.ਬ. ਨੰ. 234) ਅਤੇ ਕੋਠਾ (ਹ.ਬ. ਨੰ. 202) ਤਹਿਸੀਲ ਸ਼ਾਰਕੋਟ ਜ਼ਿਲ੍ਹਾ ਜਲੰਧਰ ਦੀ ਰੈਵੀਨਿਊ ਅਸਟੇਟ ਵਿੱਚ ਪੈਂਦੀ ਹੈ। ਸਾਈਟ ਦਾ ਰਕਬਾ 4 ਏਕੜ੍ਹ ਹੈ। ਮੌਕੇ ਤੇ ਸਾਈਟ ਨੂੰ ਖੇਤੀਬਾੜੀ ਵਜੋਂ ਵਰਤਿਆ ਜਾ ਰਿਹਾ ਹੈ।
2) ਇਹ ਸਾਈਟ ਲੋਕਲ ਪਲੈਨਿੰਗ ਏਰੀਆ ਲੋਹੀਆਂ ਖਾਸ ਵਿੱਚ ਪੈਂਦੀ ਹੈ, ਜੋ ਕਿ ਅਜੇ ਨੋਟੀਫਾਈਡ ਨਹੀਂ ਹੋਇਆ ਹੈ। ਮਾਸਟਰ ਪਲੈਨ ਲੋਹੀਆਂ ਖਾਸ ਨੇਟੀਫਾਈਡ ਹੋਣ ਉਪਰੰਤ ਜੇਕਰ ਆਪ ਦੀ ਇਕਾਈ Non Confirming Land use Zone ਵਿੱਚ ਆਉਦੀ ਹੈ ਤਾਂ ਆਪ “Punjab Regional and Town Planning and Development Act, 1995” ਦੇ Section-79 ਅਤੇ ਬਾਕੀ ਦੇ ਸਾਰੇ ਉਪਬੰਧਾ ਨੂੰ ਮੰਨਣ ਦੇ ਪਾਬੰਦ ਹੋਵੇਗੇ । ਕਿਉਂ ਜੋ ਸਾਈਟ ਮਕਾਨ ਉਸਾਰੀ ਅਤੇ ਸ਼ਹਿਰੀ ਵਿਕਾਸ ਵਿਭਾਗ ਦੀਆਂ ਸਾਈਟਿੰਗ ਗਾਈਡਲਾਈਨਜ਼ ਦੀ ਪ੍ਰਤੀ ਪੂਰਤੀ ਕਰਦੀ ਹੈ, ਡਾਇਰੈਕਟਰ, ਟਾਊਨ ਐਂਡ ਕੰਟਰੀ ਪਲੈਨਿੰਗ ਪੰਜਾਬ ਦੇ ਮੀਮੋ ਨੰ. 2180-2283 ਮਿਤੀ 14.06.2023 ਦੀਆਂ ਹਾਦਾਇਤਾਂ ਅਨੁਸਾਰ ਆਪ ਬਾਕੀ ਦਸਤਾਵੇਜ਼ ਅਤੇ ਅੰਡਰ ਟੇਕਿੰਗ “The applicant shall be liable to abide by the provisions of Master Plan and shall also be bound to follow the provisions of Section-79 along with other provisions of PRTPD Act,1995, In case site falls in non-conforming land use zone after the notification of Master Plan and no claim shall be demanded by the applicant from the department.” ਡਾਇਰੈਕਟਰ ਆਫ਼ ਫੈਕਟਰੀਜ਼ ਨੂੰ ਦੇਣ ਉਪਰੰਤ ਹੀ ਉਹਨਾਂ ਵੱਲੋਂ ਅਗਲੀ ਕਾਰਵਾਈ ਕੀਤੀ ਜਾਈ ਬਏਦੀ ਹੈ।
3) ਸਾਈਟ ਨੂੰ ਅਪਰੋਚ ਰੈਵੀਨਿਊ ਦਸਤਾਵੇਜ਼ ਅਤੇ ਮੌਕਾ ਰਿਪੋਰਟ ਅਨੁਸਾਰ 22'-0'' ( 4 ਕਰਮ) ਚੌੜੀ ਲਿੰਕ ਰੋਡ ਤੋਂ ਲਈ ਗਈ ਹੈ। ਯੂਨੀਫਾਈਡ ਜ਼ੋਨਿੰਗ ਰੈਗੂਲੇਸ਼ਨ ਅਨੁਸਾਰ 22'-0'' ਚੌੜੀ ਲਿੰਕ ਰੋਡ ਨੂੰ 60 ਫੁੱਟ ਚੌੜਾ ਕਰਨ ਲਈ ਬਾਕੀ ਸਬੰਧਿਤ ਵਿਭਾਗਾਂ ਪਾਸੋਂ ਐਨਉਓਸੀ ਲੈਣ ਉਪਰੰਤ ਹੀ ਆਪ ਆਪਣੇ ਰਕਬੇ ਵਿਚੋਂ ਸਰਕਾਰ ਦੇ ਹੁਕਮਾਂ ਅਨੁਸਾਰ ਬਿਨਾ ਕਲੇਮ ਲਏ 19'-0" ਦੀ ਰੈਡ ਵਾਈਡਨਿੰਗ ਸਟਰਿੱਪ ਛੱਡਣ ਉਪਰੰਤ ਹੀ ਮੌਕੇ ਤੇ ਉਸਾਰੀ ਕਰਨ ਦੇ ਪਾਬੰਦ ਹੋਵੋਗੇ। ਸਾਈਟ ਦਾ ਫਰੰਟੇਜ਼ (198'-0'') ਅਤੇ ਰਕਬਾ (4 ਏਕੜ) ਵਿਭਾਗੀ ਗਾਈਡਲਾਈਨਾਂ ਦੀ ਪ੍ਰਤੀ ਪੂਰਤੀ ਕਰਦਾ ਹੈ।
4) ਸਰਕਾਰ ਦੀ ਨੋਟੀਫਿਕੇਸ਼ਨ ਨੰ. 13/41/2021-6HG2/2684 ਮਿਤੀ 19.10.2022 ਰਾਹੀਂ ਜਾਰੀ ਹਦਾਇਤਾਂ ਵਿੱਚ ਦਰਜ ਵਿਭਾਗੀ ਗਾਈਡਲਾਈਨਾਂ ਦੀ ਪ੍ਰਤੀ ਪੂਰਤੀ ਕਰਨ ਉਪਰੰਤ ਬਿਲਡਿੰਗ ਪਲੈਨ/ਬਿਲਡਿੰਗ ਦੀ ਕੰਪਾਊਡਿੰਗ ਅਤੇ ਕੰਪਲੀਸ਼ਨ ਸਰਟੀਫਿਕੇਟ ਦੀ ਪ੍ਰਵਾਨਗੀ ਕੰਪੀਟੈਂਟ ਅਥਾਰਟੀ ਡਾਇਰੈਕਟਰ, ਫੈਕਟਰੀਜ਼ ਪੰਜਾਬ ਪਾਸੋਂ ਪ੍ਰਾਪਤ ਕਰਨ ਦੇ ਪਾਬੰਦ ਹੇਵੇਗੇ।
8. The industry has submitted a detailed report from revenue authority w.r.t. siting guidelines as per the report signed by the Naib Tehsildar , Lohian dated 19.06.2024, which is reproduced as under:-
ਮੁਤਾਬਕ ਹੁਕਮ ਉਪਰੋਕਤ ਵਿਸ਼ੇ ਸੰਬੈਧੀ ਰਿਪੋਰਟ ਕੀਤੀ ਜਾਂਦੀ ਹੈ ਕਿ ਵਾਕਿਆਂ ਪਿੰਡ ਕੋਠਾ ਕੰਗ ਖੁਰਦ ਤਹਿਸੀਲ ਸ਼ਾਹਕੋਟ ਜਿਲ੍ਹਾ ਜਲੰਧਰ, ਖਸਰਾ ਨੰ 97//6 (8-0) ਵਾਕਿਆ ਰਕਬਾ ਪਿੰਡ ਕੋਠਾ ਨੰਬਰ ਖਸਰਾ 96//10 (7-12) ਨੰਬਰ ਖਸਰਾ 97//13(8-0), 18(8-0), 19(8-0) ਕਿਤੇ 03 (24-0) ਕਾ 1/3 ਹਿੱਸਾ (8 ਕ 0 ਮ) ਨੰਬਰ ਖਸਰਾ 97//14(8-0) 15(8-0) ਕਿਤੇ ਰਕਬਾ (16-0) ਕਾ 168/320 ਹਿੱਸਾ (8 ਕ 8 ਮ) ਕੁੱਲ ਨੰਰਕਬਾ 32 ਕਨਾਲ ਸਾਲਮ ਵਿਚ Mannat Rice Mills ਪਿੰਡ ਕੋਠਾ, ਕੰਗ ਖੁਰਦ ਜਿਲ੍ਹਾ ਜਲੰਧਰ ਮਾਲ ਰਿਕਾਰਡ ਅਨੁਸਾਰ ਮਾਲਕੀ ਹੈ। ਰਿਕਾਰਡ ਮੁਤਾਬਕ ਸਥਿਤੀ ਨੁਕਤਾ ਵਾਇਜ਼ ਹੇਠ ਨਿਖੇ ਅਨੁਸਾਰ ਹੈ;-
1. ਸਾਈਟ ਪਲੈਨ ਪਿੰਡ ਦੀ ਫਿਰਨੀ/ਲਾਲ ਲਕੀਰ ਤੋਂ 500 ਮੀਟਰ ਦੇ ਘੇਰੇ ਵਿਚ ਨਹੀਂ ਪੈਂਦਾ।
2. ਇਸ ਰਕਬੇ ਦੇ 500 ਮੀਟਰ ਦੇ ਘੇਰੇ ਵਿਚ ਕੋਈ ਚਿੜੀਆ ਘਰ ਨਹੀਂ ਪੈਂਦਾ।
3. ਇਸ ਰਕਬੇ ਦੇ 500 ਮੀਟਰ ਦੇ ਘੇਰੇ ਵਿਚ ਕੋਈ ਬਰਡ ਸੈਚੁਰੀ ਨਹੀਂ ਹੈ।
4. ਇਸ ਰਕਬੇ ਦੇ 500 ਮੀਟਰ ਦੇ ਘੇਰੇ ਵਿਚ ਕੋਈ ਰਿਹਾਇਸ਼ੀ ਏਰੀਆ ਨਹੀਂ ਹੈ।
5. ਇਸ ਰਕਬੇ ਦੇ 500 ਮੀਟਰ ਦੇ ਘੇਰੇ ਵਿਚ 15 ਘਰ ਪੱਕੇ ਨਹੀਂ ਹਨ।
6. ਇਸ ਰਕਬੇ ਦੇ 500 ਮੀਟਰ ਦੇ ਘੇਰੇ ਵਿਚ ਕੋਈ ਵਿਦਿਅਕ ਅਦਾਰਾ ਨਹੀਂ ਹੈ।
7. ਇਸ ਰਕਬੇ ਦੇ 500 ਮੀਟਰ ਦੇ ਘੇਰੇ ਵਿਚ ਕੋਈ ਧਾਰਮਿਕ ਸਥਾਨ ਨਹੀਂ ਹੈ।
8. ਇਸ ਰਕਬੇ ਦੇ 500 ਮੀਟਰ ਦੇ ਘੇਰੇ ਵਿਚ ਕੋਈ ਪ੍ਰੋਟੈਕਟਿਡ ਮੋਨੋਮੈਂਟਸ ਨਹੀਂ ਹੈ।
9. ਇਸ ਰਕਬੇ ਦੇ 500 ਮੀਟਰ ਦੇ ਘੇਰੇ ਵਿਚ ਕੋਈ ਪੁੱਡਾ, ਮਿਊਂਸੀਪਲ ਕਾਰਪੋਰੇਸ਼ਨ/ਕੌਸਲ, ਇੰਪਰੂਵਮੈਂਟ ਟਰੱਸਟ ਅਤੇ ਏਜੰਸੀ ਦਾ ਕੋਈ ਏਰੀਆ ਨਹੀ ਪੈਂਦਾ ਹੈ।
From the above, it is clear that the proposed site of the industry is meeting with the specific siting guidelines prescribed by the Board for the establishment of a rice sheller, as per order dated 13.09.2006 as amended on 15.10.2013 and further amended on 05.08.2021.
Keeping in view of above, it is recommended that the consent to establish (NOC) for setting up of rice sheller unit at its proposed site located in revenue estate of Village Kang Khurd & Kotha Tehsil Shahkot District Jalandhar for proposed to manufacturing of Raw Rice @ 5 MTD, Rice Bran @ 0.8 MTD, Rice Husk @ 1.4 MTD and Paddy @ 7.5 MTD as raw material under Orange category may be granted to the industry for one year with usual suitable conditions as per policy of the Board and special condition that: -
1. CTE/NOC has been granted on the basis of documents submitted by the project proponent and he shall obtain permission from Director of Factories regarding establishment of said unit in compliance of Govt. of Punjab notification no. 13/41/2021-6Hg2/2684 dated 19.10.2022.
2. The project proponent shall install adequate and appropriate pollution control devices, ensure compliance of Code of Practices prescribed for such units and obtain prior Consent to Operate from the Board under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 before the commencement of operation of the rice sheller.
3. The industry will be bound to comply with the zoning regulation of the master plan in force and the grant of consent by the Board will not vest any right on the industry w.r.t. other stipulations by any authority or the zoning regulations of the master plan.
4. The Consent to Establish (NOC) has been granted on the basis of documents/report submitted by the project proponent, from the Tehsildar, Lohian and DTP Jalandhar, In future, if any document/information submitted is found wrong or the industry is found creating nuisance in its vicinity due to its operation, the Board reserves the right or to revoke/cancel the Consent to Establish (NOC) without giving any notice/opportunity to the project proponent.
5. The project proponent shall install its rice sheller unit in the Khasra No. 97//6 (8-0) ਵਾਕਿਆ ਰਕਬਾ ਪਿੰਡ ਕੋਠਾ ਨੰਬਰ ਖਸਰਾ 96//10 (7-12) ਨੰਬਰ ਖਸਰਾ 97//13(8-0), 18(8-0), 19(8-0) ਕਿਤੇ 03 (24-0) ਕਾ 1/3 ਹਿੱਸਾ (8 ਕ 0 ਮ) ਨੰਬਰ ਖਸਰਾ 97//14(8-0) 15(8-0) ਕਿਤੇ ਰਕਬਾ (16-0) ਕਾ 168/320 ਹਿੱਸਾ (8 ਕ 8 ਮ) Total land 32 karnal as mentioned in the letter issued by Naib Tehsildar Lohian.
