File Note: The report of Regional Office may kindly be perused………………………… The industry is a small-scale red category dyeing unit and was granted consent to operate under the Water Act, 1974 vide no. CTOW/Fresh/LDH3/2022/19745191 dated 15.11.2022 for dyeing of polyester fabrics @ 3 Kgs/day with generation & disposal of trade effluent @ 49 KLD and domestic effluent @ 1 KLD into CETP 50 MLD, which was expired on 14.02.2023……………………….. Thereafter, notice u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 was issued to the industry with the opportunity of personal hearing given before the Chief Environmental Engineer, Ludhiana on 19.12.2023. After hearing Competent Authority of the Board was decided as under: 1. The industry shall dismantle the steam and electric connection of the excess machinery having discharge beyond the DEMAT shares. These excess machines shall be sealed by the Regional Office of the Board till the industry obtains revised CTE/CTO for the same. 2. Environmental Engineer, Regional Office-3, Ludhiana shall visit the industry to seal the machinery as detailed at the decision no. 1 and process the consent application on merits, accordingly. 3. It was made clear to the industry that in case it is found operating beyond the DEMAT shares capacity, without prior permission of the Board, strict action may be taken which may include closure without any further notice/ opportunity of personal hearing……………………. Regional Office reported that in compliance of above said decisions industry was visited and it was observed that the industry has got DEMAT all 80 shares. Further the shares were adequate to manage the quantum of discharge from installed machinery therefore no machinery is required to be sealed………………………………... Now, the industry has applied for varied consent to operate under Water Act, 1974 for dyeing of polyester fabrics @ 3 T/day with generation & disposal of trade effluent @ 79 KLD and domestic effluent @ 1 KLD into CETP 50 MLD. The industry has deposited consent fee, which is adequate upto 28.02.2030 as verified by the Regional Office………………….…………………... The industry has submitted the copy of area classification certificate vide their letter no. 744/STP(L)/TW/2A dated 12.03.2018, which is stating that the unit falls in the industrial Zone as per approved Master Plan, Ludhiana…………………………... The industry was visited by AEE of RO on 27.06.2024 and observed that: 1. The industry was in operation during the visit and the same was engaged in the process of dyeing of polyester fabrics. 2. The industry has installed 02 soft flow machines of capacity 250 kg each in its premises. The total installed chambers are 04. 3. As per study carried out by Guru Nanak Dev Engineering College (GNE), total effluent generation from its 04 chambers is 80 KLD considering generation of effluent @ 20 KLD per chamber, hence the discharge of the industry is within the share allotted to it. 4. The industry is connected with the conveyance system of CETP 50 MLD, Tajpur Road, Ludhiana for discharge its effluent. The industry has provided the flow meter at its final outlet leading to CETP. 5. The industry has installed 01 submersible and has installed emf with the same. 6. The industry is complying with the provisions of Water (Prevention & Control of Pollution) Act, 1974. The industry has submitted certificate from company secretary regarding DEMAT of 80 KLD shares. The contents of the DEMAT certificate is as under: ………………………………… 1. Shares held in DEMAT (A/c No. IN304295-71063650) as per the list provided by the SKYLINE dated 5th May 2024-30,000………………………………… 2. As per the list of allotees in E-Form PAS-3 filed with ROC by the company for the allotment made on 21st October 2023 and shares are under the process of demat- 50,000. Total- 80,000 Further, it is pertinent to mention here that it was decided as under in the e-noting no. 19582356 (copy attached herewith): ………………………………… “It shall be ensured that no further CTE/CTO for any new/expansion of dyeing units shall be given without the permission from Head office.” ………………………………… Thus, the competency to decide the case falls with Worthy Chairman of the Board. ………………………………… As proposed by Regional Office, may if approved, 1. Varied consent to operate under Water (Prevention & Control of Pollution) Act, 1974 may be granted to the industry for dyeing of polyester fabrics @ 3 T/day with generation & disposal of trade effluent @ 79 KLD and domestic effluent @ 1 KLD into CETP 50 MLD upto 30.06.2029 with usual terms and conditions a) The industry shall the make the necessary arrangements to achieve the effluent standards as per the inlet designed parameters of CETP. b) The industry shall stop discharging its effluent in case due to any reason the CETP is not operational or dedicated conveyance system is overflowing. c) The industry shall maintain the record of flow meter installed at outlet leading to CETP. d) The industry shall not generate/discharge trade & domestic effluent more than consent granted. e) The industry shall not install any new dyeing/ water polluting machinery without permission of the Board. f) The industry shall discharge the whole consented effluent into dedicate sewer line leading to CETP for final treatment in accordance to the shares allotted to the unit. g) The industry will also dismantle any other connection available for discharge of effluent either into public sewer or PDA conveyance system. h) The industry should either take measures to control its inlet parameters by good practices and selection of good chemicals for processing or shall operate and maintain its existing effluent treatment plant (ETP), regularly and efficiently, so as to achieve the inlet effluent standards of CETP as per DPR. i) The industry will install EMF at inlet water supply also within 01 month j) The industry shall make adequate arrangements to minimize the consumption of fresh water........................................
