Sub: Proceedings of the personal hearing held before Senior Environmental Engineer, Zonal Office-2, Ludhiana for refusal of consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 on 03.07.2024 - M/s Deepak Fasteners Ltd, Unit-II, E-553, Phase-6, Focal Point, Ludhiana.

Environmental Engineer, Zonal Office-2, Ludhiana brought out that the industry is a small-scale red category unit and was granted Consent to Operate under the Air Act, 1981 vide no. CTOA/Renewal/LDH4/2019/9934228 dated 14.06.2019, which are valid upto 30.06.2024 for manufacturing of Nuts & Bolts @ 1.5 MTD and End Cuttings @ 0.500 MTD by using Bolts/Nuts @ 1.5 MTD as raw material.
The industry has applied for varied Consent to Operate under the Air (Prevention & Control of Pollution) Act, 1981 through OCMMS for manufacturing of Nuts & Bolts @ 1.7 MTD and End Cuttings @ 0.6 MTD by using Rods and bars @ 1.7 MTD as raw material.
The industry was visited by the officer of the Board on 21.05.2024 and it was observed as under: -
1. The industry was in operation during visit & is engaged in heat treatment process.
2. The industry has installed two no. tempering furnace provided with adequate stack height.
3. The industry has installed 02 oil fired furnace provided with hoods, however proper sampling arrangements has not been provided.
4. The industry has installed one no. rotary furnace and has been provided adequate stack height with hood system.
5. The industry has one gothali furnace and has been provided adequate stack.
6. The industry has installed 01 no. DG set of 380 KVA with canopy and adequate stack height.
7. The industry has not submitted an approved building plan by the Competent Person. The industry is not complying with the provisions of the Air (Prevention & Control of Pollution) Act, 1981 of the Board.
The industry is violating the provisions of the Air (Prevention & Control of Pollution) Act, 1981.
Show cause notice for refusal of consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 was issued to the industry with an opportunity of personal hearing before Senior Environmental Engineer, Zonal Office -2, Ludhiana on 03.07.2024.
Sh. Deepak Chhabra, Vice President of the industry attended the hearing and submitted a written reply which was taken on record. He stated that they have provided arrangements to take air samples on the stack. New chimney was installed recently so sampling window was provided after the staircase. He further informed that they have submitted the approved building plan from the Director of industries, Punjab and requested to grant the consent.
After hearing, the vice president of the industry and officers of the Board, the Senior Environmental Engineer of the Board decided as under:-
1. Environmental Engineer, Regional Office-4, Ludhiana shall visit the industry to verify the contentions of the industry and submit the report alongwith recommendations, within 07 days.
Submitted for confirmation of decisions of the hearing and for conveying to the industry and Regional Office for compliance of above decisions, please.
