File Note: The Civil Judge, Junior Division Ludhiana vide order dated 03.07.2024 in application no. Cs/3342/2024 titled as Anil Seth Vs Kamal Dev Chauhan has ordered as under: “Accordingly, defendants are hereby restrained from interfering in any manner in the smooth running of business/dyeing unit being run by the plaintiff under the name and style of M/s Aashish Dyeing, 2220/6, Tajpur Road, Opposite Central Jail, Ludhiana, as its sole proprietor by decreasing the number of 15000 Equity Shares to a lesser number already allotted by the defendants to the plaintiff vide aforesaid Share Certificate dated 09.11.2011 bearing registered Folio no. 39, Distinctive no. 778241-793240 as well as Allotment Advice cum-Allotment Money Notice dated 16.11.2011 or from creating any obstruction and embargo in any manner whatsoever from discharging Trade Effluent to the extent of 150 KLD CET Plant with 50 MLD Capacity by the plaintiff in any manner whatsoever except in due course of law till next date of hearing i.e. 24.07.2024.” Thus, Hon’ble court has restrained PDA from stopping the 150 KLD discharge of the industry i.e. M/s Aashish Dyeing into sewer line of 50 MLD CETP. However, the shares of the industry have not been done DEMAT. Keeping the above in view, it is recommended that application of the industry for varied 'Consent to Operate' under the Water Act, 1974 may be returned.
