It is submitted that the Project Proponent has proposed to establish a hospital in the revenue estate of Ward No. 2, Badesha Road, Khamanon, District Fatehgarh Sahib. Accordingly, the PP has applied for obtaining Consent to Establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for 20 beds alongwith requisite documents and fee.
The Hospital has submitted an undertaking, according to which, Dr. Harman Singh S/o Sh. Prem Singh is the sole proprietor of the HCF. The HCF has submitted the transfer deed dated 14/09/2022 executed between Smt. Manjeet Kaur W/o Sh. Prem Singh and Sh. Harman Singh S/o Sh. Prem Singh for the total land area 5 Kanal 13 Marle.
The HCF has also submitted the feasibility report, wherein, it has proposed to install ETP-cum-STP of capacity 10 KLD for the treatment of effluent generated from operation of HCF as well as domestic effluent. The HCF has proposed to dispose of the treated trade effluent as well as domestic effluent onto land for plantation as per Karnal Technology in an area of 0.25 acre. The components of the ETP-cum-STP are as under:
Bar Screen -> Collection tanks -> MBBR Reactors (Aeration Tank) -> Aeration systems with diffusers -> Secondary Sedimentation Tank -> Pressure Sand Filter -> Activated Carbon Filter -> Sludge Drying Beds
Further, the HCF has proposed to install a DG set of capacity 20 KVA with canopy and stack of adequate height.
The HCF has also submitted the No Dues Certificate (attached herewith) vide no. 569 dated 12/06/2024 issued by Executive Office, Nagar Panchayat, Khamanon, vide which, the site falls within the limits of Nagar Panchayat, Khamanon. Further, there is no school, petrol pump, marriage palace, historical place, state highway and national highway falls within the 100 meter of the proposed site.
The HCF has deposited the Consent to Establish (NOC) fee amounting to Rs. 1,000/- vide online R. No. 642183916 dated 26/06/2024, which is adequate upto 01/07/2024 as per Board’s office order no. 2235-59 dated 07/07/2017.
To verify the contents of the application, the HCF was visited by the undersigned on 02/07/2024 and during visit, it was observed as under:
1. The proposed site falls in the revenue estate of Ward No. 2, Badesha Road, Khamanon, District Fatehgarh Sahib.
2. The HCF has not started the construction work at the site.
3. The HCF is situated within the MC limit of Khamanon.
It is submitted that the Govt. of India, Ministry of Jal Shakti, Deptt. of Water Resources RD&GR Central Ground Water Authority, New Delhi has issued directions u/s 5 of Environment (Protection) Act, 1986 vide letter no. CGWA-21/6/2020-CGWA-101 dated 06/04/2022 “that it shall be mandatory for the Project Proponent abstracting ground water to obtain NOC from CGWA or the concerned State/ UT Ground Water Authority as the case made be in the compliance condition in consent to operate and consent to establish issued by the State Pollution Control Board.” Accordingly, the Board vide letter no. 1955-57 dated 18/01/2023 has informed all the officers of the Board in continuation to earlier circular no. CEE(HQ)/2018/7956-84 dated 03/03/2018 and 768-97 dated 13/01/2021 to ensure the compliance of the said directions.
PWRDA vide notification dated 27.01.2023 has exempted units from obtaining any permission of the authority, which are extracting not more than 300 cubic meters of ground water per month.
In the subject cited case, the Hospital has mentioned ground water extraction @ 9.8 KLD. Considering 30 working days in a month, the ground water extraction will be 294 KL/month, which is less than 300 KL/month. As such, the HCF does not require permission from PWRDA.
In view of the facts mentioned above, if approved, it is recommended that the Consent to Establish (NOC) under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 for 20 no. beds may be granted to the HCF upto 04/07/2024 subject to the suitable conditions and following additional conditions:
1. The HCF shall apply for consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 as well as authorization under Bio-Medical Waste Management Rules, 2016 before commissioning of the unit.
2. The HCF shall comply with the guidelines of Punjab Water Regulation & Development Authority.
3. The HCF shall ensure to comply with the effluent standards as notified under Bio Medical Waste Management Rules, 2016 amended upto date and subsequent amendments, if any.
4. There is no claim of continuation of HCF in present premises on the basis of this consent. The HCF has to comply with the zoning regulation of master plan & to be shifted from the site as and when asked by the Govt./PPCB/ or any concerned Govt. agency.
5. The HCF shall obtain other statutory approvals required from other departments, if any. |
