It is submitted that while scrutinized the case it has been observed that:-
1. The industry has not submitted the site plan duly approved by Director of Factories, Punjab OR from the Competent Person authorised by Director of Factories.
2. Earlier, industry obtained the consent of the Board under Red Category. Now, it has applied in Orange Category. Please intimate the Date of closed down the Dyeing unit with documentary proof, so that adequacy of consent fee may be adjudged accordingly.
3. The consent fee deposited by the industry of Rs. 2,59,200/- is adequate upto 30.09.2024 even in Orange Category.
4. The industry has not deposited the consent form fee of Rs. 500/-.
5. The manufacturing process submitted by the industry is not appropriate; please submit the amended manufacturing process.
6. The industry has not submitted the compliance report of previous consent conditions granted to the industry and also submit the point-wise compliance of the directions issued.
7. The industry has been issued directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and U/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 and u/s 5 of the Environment (Protection) Act, 1986 and PSPCL authorities have been directed to disconnect the supply of electricity available to the industry/premises with immediate effect vide Boards letter No. 3060 dated 24.05.2024, please submit the copy of TDCO no.
8. The industry has not submitted the Bank Guarantee of Rs. 10 Lacs as assurance for the compliance of the pollution control laws as decided in the personal hearing dated 16.06.2023 taken by Worthy Chairman of the Board.
9. The industry has not applied for varied authorisation under the Hazardous and Other Wastes (Management & Transboundary Movement) Rules, 2016.
The industry was requested to attend the above said observations and submit your reply within 2 days and also submit the hardcopy of Consent application with complete documents in office by 01.07.2024 through clarification dated 29.06.2024, but no reply submitted by the industry so far. Hence, the incomplete application cannot be processed and is required to be returned, but I have no option to return the application.
It is, therefore, requested to allow me to the return the application with the request to the industry to re-submit the application after attending the above said observations and complete in all respects at the earliest.
