File Note: It is submitted that the rice sheller was granted consent to operate under the provisions of the Water Act, 1974 vide no. CTOW/Fresh/FGS/2020/13765596 dated 01/10/2020 and the Air Act, 1981 vide no. CTOA/Renewal/FGS/2021/15785063 dated 10/06/2021, both are valid upto 30/09/2024 for Processing of Paddy @ 1.5 TPH to produce Raw Rice @ 1 TPH (without drier). Now, the industry has applied for varied consent to operate under the provisions of the Water Act, 1974 and the Air Act, 1981 alongwith requisite documents and fee through OCMMS for Processing of Paddy @ 1.5 TPH to produce Raw Rice @ 1 TPH alongwith mechanical dryer of capacity 32 T/batch. As per the record file, the fee deposited by the rice sheller under the Water Act, 1974 and the Air Act, 1981 was adequate upto 31/12/2024 against the fixed assets of Rs. 77.36 lacs. Now, the rice sheller has submitted the CA certificate dated 20/04/2024, wherein, it has mentioned that the total value of fixed assets of the unit as on 20/04/2024 is Rs. 113.34 lacs with value of plant & machinery is Rs. 56.26 lacs. Accordingly, the rice sheller has deposited consent fee amounting to Rs. 42,000 /- vide UTR no SBIN324158125217 dated 06/06/2024 under the Water Act, 1974 and Rs. 44,300/- vide UTR no. SBIN324158125035 dated 06/06/2024 under the Air Act, 1981. As such, after adjusting Rs. 2900/- as NOC regularization fee for increase in cost of fixed assets of the unit, the fee deposited by the rice sheller is adequate upto 30/06/2029 under the both acts, as per Board's Office Order dated 29/10/2018. The industry has submitted the feasibility report & completion certificate of APCD installed with the mechanical drier of capacity 32 T/batch issued by Evapo Tech Technical Service & Consultant. To verify the contents of the application, the rice sheller was visited by the undersigned on 02/07/2024. During visit, it was observed as under: 1. The rice sheller was not in operation due to off season. 2. The rice sheller has installed separate cyclone separator as APCD with shelling section and paddy cleaning section of the drier, which is adequate. The rice sheller has submitted the stack emission sampling report carried out by M/s Evapo Tech Technical Service & Consultant on 17/04/2024 as per which the concentration of SPM is 204 mg/Nm3, which is within permissible limits as per prescribed standards for rice shellers. 3. The rice sheller has provided brick paved on movement area of the vehicles so as to prevent the generation of dust. 4. The industry provided proper rice husk storage facilities inside the factory premises and the height of brick wall inclusive of wind screen in front of the discharge point of rice husk is more than 15'. 5. The industry has provided some green belt around the along the boundary wall within its premises. The representative of the industry was advised to increase the green belt around all the boundary walls. 6. The industry has provided septic tank for treatment of its domestic effluent generated from toilet/bathrooms. The rice sheller has submitted the land use pattern issued by DTP, Fatehgarh Sahib vide no. 588 dated 22/05/2019, vide which, the unit is located outside the limits of Nagar Panchayat, Khamanon. It is submitted that the Govt. of India, Ministry of Jal Shakti, Deptt. of Water Resources RD&GR Central Ground Water Authority, New Delhi has issued directions u/s 5 of Environment (Protection) Act, 1986 vide letter no. CGWA-21/6/2020-CGWA-101 dated 06/04/2022 “that it shall be mandatory for the Project Proponent abstracting ground water to obtain NOC from CGWA or the concerned State/ UT Ground Water Authority as the case made be in the compliance condition in consent to operate and consent to establish issued by the State Pollution Control Board.” Accordingly, the Board vide letter no. 1955-57 dated 18/01/2023 has informed all the officers of the Board in continuation to earlier circular no. CEE(HQ)/2018/7956-84 dated 03/03/2018 and 768-97 dated 13/01/2021 to ensure the compliance of the said directions. PWRDA vide notification dated 27.01.2023 has exempted units from obtaining any permission of the authority, which are extracting not more than 300 cubic meters of ground water per month. In the subject cited case, the industry has mentioned ground water extraction @ 2 KLD. Considering 30 working days in a month during season, so ground water extraction will be 60 KL/month, which is less than 300 KL/month. As such the unit does not require permission from PWRDA. Keeping in view of above, if approved, the varied consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for Processing of Paddy @ 1.5 TPH to produce Raw Rice @ 1 TPH alongwith mechanical dryer of capacity 32 T/batch may be granted upto 30/09/2028 with suitable conditions and following special conditions: 1. The industry shall be bound to comply with the provisions set forth in the Khamanon Master Plan upon its preparation. 2. The industry shall submit the stack emissions analysis report from Board's lab in the upcoming season. 3. The industry shall comply with the guidelines for Abstraction of Ground Water from the Punjab Water Regulation and Development Authority (PWRDA). 4. The industry shall discharge its domestic effluent onto land for plantation after treatment in septic tank. 5. The industry shall ensure that at any time the emissions do not exceed the emission standards laid down by the Board from time to time. 6. The adequacy and efficiency of the air pollution control device will be the entire responsibility of the industry. 7. The industry shall not discharge any fugitive emissions. All gases shall be emitted through a stack of suitable height, as per the norms fixed by the Board from time to time. 8. The industry will comply with the following code of practice notified by the Govt. i. All the processing sheds be covered and have minimum ventilation as per the recommendations of Director of Factories. ii. The industry should plant thick plantation of spreading crown varieties of evergreen trees all along the boundary wall of the rice sheller. iii. All dust emitting points should be properly hooded and dust extracted to a common point. At this exhaust point, dust coming here will be passed through a dust control system and air will be emitted through a stack of height 3 metres above the roof of the building. iv. The management and handling of rice husk in the rice shelling units should be done as under:- a) All the rice shelling units shall provide paved / brickroads /cement concrete roads/ metalled roads inside their premises for movement of vehicles, so as to prevent the generation of dust. b) The industry shall provide proper rice husk storage facilities inside the factory premises and the height of brick wall in front of the discharge point of rice husk area should be at least 10’ high or3.5 ’higher than the discharge point of the rice husk pipe (whichever is more) and the length of aforesaid brick wall should be at least 35’one ach side of the rice husk discharge pipe. c) The industry shall provide a layer of wind screen of mild steel orsome other similar material of at least 5’ height above the brickwall. The wind screen system should have a porosity of ~30% tolower the wind velocities, thus reducing the amount of air borne particulate from storage, handling and loading/unloading areas of rice husk. d) The minimum diameter at the outlet of discharge pipe of rice huskbe kept as 15’’ which can be maintained by extending the existingdischarge pipe with the help of a conical shaped pipe of at least 3’length. e) Wherever the height of rice husk is 3’ or more, the industry shall cover the heap of husk with HDPE warp knitted fabric completely, except the area near the discharge pipe. The HDPE warp knitted fabric be made of 100% virgin high density polymer of at least 70gm/m2 weight having 40-45 hole/inch 2 to prevent wind blowing of stored husk. f) During transportation of rice husk through vehicles, it shall be covered from all sides with tarpaulin to prevent blowing of husk by winds. 9. The emission standards given in the order dated 13/9/2006 will remain operative for Rice Shellers and Saila Plants. These emission standards are reproduced as under:- Emission Standards for Rice Shellers & Saila Plants in the State of Punjab will be applicable as under: - i. Emission standards 750 SPM (mg/Nm3) ii. Inside the building TLV of air SPM (mg/Nm3) NOTE: The existing units not meeting with the prescribed sitting guidelines will meet with stack emission standards of SPM 500mg/Nm3.To be controlled by the Director of Factories. 10. The industry shall continue to comply with the new code of practice notified by Govt. Notification no.10/48/2004-STE(4)/932 dated. 15/10/2013 at all the times. 11. The industry shall abide by the fresh directions (if any) issued by the Hon'ble Punjab & Haryana High Court/ Govt./ Board for compliance of code of practice of rice sheller. 12. The industry shall not cause any nuisance/traffic hazard in vicinity of the area. 13. The industry shall shift its location to designated area as per directions issued by the State Govt. / Board from time to time and time frame stipulated in Master Plan for industry located in MC limits. 14. The industry shall upgrade/ replace the APCD as per latest notificationissued by the Ministry of Environment & Climate Change, New Delhi to achieve the revised emissions stands as amended time to time. 15. The industry shall apply for obtaining 'consent to operate' under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution)Act,1981 before commissioning of the unit. 16. The project proponent shall not throw, burn or burry any solid wastes in open, outside premises or in drain/water bodies. 17. The project proponent shall promote use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic, through their Corporate Environment Responsibility (CER) activities. (See attached banner). 18. The project proponent shall properly handle and manage the solid wastages as per the provisions of the Municipal Solid Waste Rules 2016 and ensure that the solid waste is segregated & disposed of in an environmentally sound manner. 19. The industry shall provide thick plantation of spreading crown varieties of evergreen trees all along the boundary wall.
