It is intimated that earlier the brick kiln was granted consent to operate under Air (Prevention & Control of Pollution) Act, 1981 vide no. R15TRTCTOA2674740 dated 18/05/2015, which was valid upto 30/09/2019 for gravity dust settling chamber.
Now, the subject cited brick kiln has applied for varied consent to operate under Air (Prevention & Control of Pollution) Act, 1981 and fresh consent under Water (Prevention & Control of Pollution) Act, 1974 for manufacturing of Brick & Tiles @ 45,000 nos/day.
Detail of the case are as under: -
1. The brick kiln has submitted CA certificate dated 30.11.2023, which it is gross value of fixed assets of Rs. 45.16 Lakhs. Accordingly, it has deposited Rs. 43,500/- vide UTR No. SBIN423356810954 dated 22.12.2023 as consent fee under Water (Prevention & Control of Pollution) Act, 1974 and Rs. 43,500/- vide UTR No. SBIN423356961239 dated 22.12.2023 as consent fee Air (Prevention & Control of Pollution) Act, 1981 & Rs. 8700/- vide UTR No. SBIN423356958842 dated 22.12.2023 as Penalty fee under Air Act, 1981, to make fee adequate up to 30/09/2034 under both Acts against the fixed assets of the industry below 50 Lakhs. The brick kiln has also deposited Rs. 500/- vide UTR No. SBIN423356955835 dated 22.12.2023 as an application form fee.
2. The Brick Kiln has submitted the copy of Design adequacy cum Completion certificate issued by Punjab State Council for Science & Technology, vide no. PSCST/CC/1292 dated 10/07/2020 wherein, it is mentioned that the subject cited brick kiln has constructed Induced Draft Brick Kiln with Zig-Zag firing as per technology evolved by Punjab State Council for Science & Technology.
3. The brick kiln has submitted Land Documents, drawing of brick kiln issued by PSCST, Chandigarh, Issuance of Feasibility Report by PSCST, Chandigarh.
4. The brick kiln has also submitted that they have not operated their brick kiln from the period of Feb, 2019 to July 2020 and has submitted the coal summary as proof for operation of brick kiln for above mentioned period, which is duly verified by Attinder & Associates, Chartered Accountants.
The subject cited brick kiln was visited by AEE on 05/07/2024 and observed as under:-
1) The brick kiln was not in operation at the time of visit.
2) The brick kiln has been converted into Induced draft technology with zig-zag settings.
3) The passage around the vessel was stabilized with Brick Bats & Keri etc.
4) The approach road to the Brick Kiln is pre-mix carpeted.
5) The brick kiln has provided adequate stack fitted with induced draft fan.
6) No un-authorized fuel found stored in the premises of the brick kiln at the time of visit.
7) The BKO has planted trees along the boundary of the kiln. However, it was guided to plant more saplings in coming season.
Keeping in view of the above, if approved fresh consent to operate Water (Prevention & Control of Pollution) Act, 1974 and varied consent to operate under Air (Prevention & Control of Pollution) Act, 1981 may be granted to the brick kiln for a period up to 30.09.2034 with the conditions as under:-
1. The brick kiln shall use 20% paddy straw pallet by replacing coal as per office order issued by the Board.
2. The consent is subject to the orders passed by the Hon’ble High Court for the state of Punjab & Haryana/Hon’ble National Green Tribunal or other judiciary authority in the cases pending or being filed with regard to the subject matter of the office order.
3. The consent is subject to the performance evaluation of new technology adopted by the brick kiln.
4. The brick kiln will plant adequate trees around the boundary of the Brick Kiln. |
