It is submitted that the industry was granted consent to establish (NOC) of the Board under the provisions of Water Act, 1974 & Air Act, 1981 vide no. CTE/Fresh/BTI/2020/13711834 dated 01.10.2020 for Formulation of Fertilizer and Bio-Fertilizer, Single Nutrients and Micro Nutrients @ 1.5 MTD, valid upto 30.09.2021 with suitable conditions along with following special conditions- 1. This NOC is issued from pollution angle and the industry shall obtain the statutory clearances / permissions from the other Govt. departments, as required. 2. The industry will install its pollution control devices simultaneously with the establishment of main project. The industry was visited by officer of this Board on 26.09.2022, where Sh. Mohit Garg, Proprietor, 7986980546 was present and it was observed as under- 1. The industry was in operation. 2. The industry is engaged in production of Bio-fertilizer and chemical fertilizer. 3. The industry has failed to provide solar evaporation tanks, to treat the effluent generated from lab and same is discharged into PSIEC sewer. 4. The industry has not provided alkali scrubber as APCD in the liquid and granular section of the chemical fertilizer. 5. The industry has been commissioned without obtaining consent to operate of the Board.
Further the industry was issued SCN for violations of the provisions of the Water Act, 1974 & Air Act, 1981 with an opportunity of personal hearing before Senior Environmental Engineer on 14.11.2022 wherein it was decided as under: 1. The industry shall install adequate and appropriate effluent treatment facility for the treatment of wastewater generated from its manufacturing activities / lab section etc., within one month. 2. The industry shall install adequate and appropriate air pollution control device for the liquid and granular section of the formulation unit, within one month. 3. The industry shall apply for obtaining consents to operate under the Water Act, 1974 & Air Act, 1981, within one week immediately after compliance of decision no. 1 & 2 above. 4. Regional Office shall visit the industry immediately after one month to verify the compliance (s) made at site and submit the report/recommendations in the matter.
To check the compliance the industry was visited on 13.2.2024 and it was observed as under: 1. The industry was not in operation during visit. 2. The industry has installed the process of granular formulation and liquid formulation. 3. The industry has installed water scrubber as air classifying mill with hoods over the granular formulation and liquid formulation machines. 4. During visit it was observed that the industry is also engaged in packing of the pesticides however no hood has been provided in that section. 5. The industry has made provision for forced evaporation of the effluent from the testing lab. 6.The industry has also not obtained CTO from the Board
Accordingly, SCN for violation of the provisions of the Water Act, 1974 and Air Act, 1981 has been issued to the industry vide letter no. 1314 dated 20.03.2024 with an opportunity of personal hearing before the Senior Environmental Engineer of the Board on 27.03.2024 wherein it was decided that:- 1. The industry shall apply for obtaining consents to operate under Water Act, 1974 and Air Act, 1981, within 7 days.......... 2. Regional Office, Bathinda shall visit the industry immediately after 7 days to verify the compliance(s) made by it and process the applications to be applied by the industry under the Water Act, 1974 and Air Act, 1981, on merits................
To check the compliance the industry was again visited on 6.7.2024 and it was observed as under: 1. The industry was not in operation during visit. however the condition in the processing area showed that the process of the granular formulation was operated recently as the industry has installed the granular mixer machine away from the hood on the other side of the processing shed near the packing area. 2. The industry has installed the process of granular formulation and liquid formulation. 3. The industry has installed water scrubber with hoods over the granular formulation space (where mixer machine was earlier installed) and liquid formulation machine. The re circulation tank of the water scrubber was covered with wild growth showing that the APCD is least operated. 4. The industry has made provision for forced evaporation of the effluent from the testing lab. 5.The industry has also not obtained CTO from the Board
From above it is clear that the industry is violating provisions of Water ACt, 1974 and Air Act, 1981 the matter has already been processed vide enoting no. 20084473 for action against the industry.
Now the industry has applied for obtaining CTO under Water ACt, 1974 and Air Act, 1981 for Formulation of Fertilizer and Bio-Fertilizer, Single Nutrients and Micro Nutrients @ 1.5 MTD.
The PP has deposited Rs 26000/- vide no. 202756580 & 525700470 dated 8.7.2024 against the gross fixed assets @ 33.19 lacs as per CA certificate as on 31.3.2022. Also the industry has not submitted date of commissioning proof and CA certificate with gross fixed assets value upto 31.3.2024(recent) as such the fee adequacy cannot be adjudged.
If approved, CTO applied by the industry may be returned/ refused please. |
