File Note: • It is submitted that earlier the application was applied for obtaining CTO for both Dhaba and marriage palace……………….. • The application was examined and it was found that the land area of 03 Kanal 02 Marlas for which CLU has been issued by the Department of Town & Country Planning is only for the purpose of Dhaba and not for the purpose of marriage palace and further it has been mentioned in the CLU that the applicant shall develop the site as a single unit after taking permission from the Competent Authority and shall not bifurcate the site. Since, the visiting officer has reported that project proponent has applied for operation of Dhaba and marriage palace, however no document i.e. CLU/approved building plan mentioning the permissibility of the marriage palace at the said site has been submitted along-with the application. As such, the regularization of Dhaba and marriage palace both without any requisite documents in land area of 03 kanal 02 marlas cannot be considered and accordingly the application applied was returned after approval of the Competent Authority in the matter along-with the request to the RO to guide the project proponent to submit all the requisite documents to conclude the application…………………………. • Now, the PP has applied for obtaining fresh consent to operate for operation of for operation of Dhaba for Food Serving @ 100 Persons under the Water Act, 1974 & Air Act, 1981 through OCMMS and submitted undertaking that they will use hall for siting arrangement for food serving and will not use the hall for any type of functions (marriage etc)……………….. • The visiting officer has not reported that the Dhaba has provided Oil & grease trap followed by septic tank for treatment of waste water generated. The unit has developed plantation in lawn area as well as along the boundary wall for disposal of treated water. The plantation area developed by the unit is adequate to handle the treated waste water. The unit has constructed 2 no. compost pits for the in-situ management of wet waste generated after the function. The unit has installed suction hood in the kitchen section. The unit has provided 02 no. DG set of capacity 200 KVA & 80 KVA with canopy & stack of adequate height. The Dhaba is complying with the provisions of the Water Act, 1974 and the Air Act, 1981 and the guidelines issued by the Board vide order dated 02.02.2021……………….. • In view of above, if approved, CTO under the Water Act, 1974 and Air Act, 1981 be issued to the PP for operation of Dhaba only in land area of 3K-2M subject to the following specific conditions: 1. This consent to operate is granted for operation of only Dhaba and the PP will ensure not to use its hall as a marriage palace/banquet hall without prior written permission of the Board. 2. The project will always comply with guidelines issued by the Board vide no. HQ-2/2021/64 dated 02.02.2021 in true letter and spirit…………….. 3. The PP will ensure in-situ management of wet solid waste generated from its premises in compliance to the Solid Waste Management Rules, 2016………… Competency : SEE
