Sub: Proceeding of the personal hearing given before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 11.07.2024 w.r.t. show cause notice for refusal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 to M/s Saanvi Enterprises, B-29, Near Mandir, Mann Kanda Street Jaspal Bangar, Ludhiana.

The Add. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry is a small scale red category unit. Now, the industry has applied for fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974.
And whereas, the application of the industry has been perused and following observations has been made:-
1. The industry is red category unit and has been established without NOC of the Board.
2. The industry is a new unit and failed to submit MSME certificate as proof of exact date of commissioning of the unit.
3. The industry has made an MOU with M/s JBR Technology Pvt. Ltd., (Unit-I), Ludhiana @ 5000 Ltr/M for the disposal of trade effluent generated from process dated 18.12.2021 and the industry was in operation without valid consent/ NOC of the Board from last three years. Also, the industry has failed to submit month wise details w.r.t. water consumption and effluent generation from process from date of agreement with JBR.
4. The industry is a new unit and the industry has not submitted the certificate from Competent Authority regarding land use pattern of the area.
5. The industry has not submitted point wise compliance to the NOC conditions which would have been imposed if the industry earlier had obtaining 'Consent to Establish' (NOC) verified by visiting officer.
The industry was issued Show cause notice for refusal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 with hearing before the Senior Environmental Engineer of the Board on 11.07.2024.
Sh. Raghav Kumar, Proprietor of the industry attended the hearing and he failed to submit proper reply. He further requested to give time of 7 days to submit proper reply to show cause notice.
After hearing, officer of the Board and considering material facts on record, the Senior Environmental Engineer of the Board decided that another opportunity of personal hearing be given to the industry.
Submitted for confirmation of decisions of the hearing and for conveying to the industry and Regional Office for compliance of above decisions, please.
