Sub: Proceeding of the personal hearing given before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 11.07.2024 w.r.t. show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 to M/s Padma Bhavam Engineers Pvt Ltd, Budhewal Road, Village Jandiali, Ludhiana.

The Add. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry was granted 'Consent to Established' under Water Act, 1974 and Air Act, 1981 vide no. CTE/Fresh/LDH1/2024/24702199 Date of issue: 26/02/2024 upto 25/02/2025 for setting up a unit for Job Work of Heat Treatment for manufacturing of Auto parts, motor parts, cycle parts, other machinery parts @ 5 TPD by using of Ready Auto Parts, Cycle Parts, Motor Parts, cycle parts Other Machinery Parts From customer @ 5 TPD.
The industry has applied for fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
The industry was visited by officer of the Board on 26.06.2024 & it was observed that no machinery proposed by the applicant in its application has been installed at the site.
The industry was issued show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 with hearing before the Senior Environmental Engineer of the Board on 11.07.2024.
In reference of show cause notice, vide note dated 05.07.2024, Regional Office reported that the industry has installed all the machinery proposed at the time of obtaining NOC i.e. Tempering Furnace followed by heat treatment and 1 no. shot blasting. In the agenda note at Sr. no. 3 due to typing mistake it got typed that no machinery has been installed, due to which SCN for refusal has been issued. Due to typing error it was wrongly typed in agenda note. Since, the unit was established after obtaining NOC of the Board and has installed machinery as proposed in application and is complying with the provisions of Water Act, 1974.
Sh. Sandeep Singh, Representative of the industry attended the hearing and submitted that the industry has installed all the machinery proposed at the time of obtaining NOC i.e. Tempering Furnace followed by heat treatment and 1 no. shot blasting.
After hearing the industry, officer of the Board and considering material facts on record, the Senior Environmental Engineer of the Board decided that the consent to operate under the Water Act, 1974 and Air Act, 1981 be granted to industry as per the adequacy deposited consent fee.
Submitted for confirmation of decisions of the hearing and for conveying to the industry and Regional Office for compliance of above decisions, please.
