It is submitted that Project Proponent applied for obtaining Consent to Establish (NOC) for setting up hot mix plant has been refused vide no. CTE/Fresh/MOG/2024/24471344 dated 29.01.2024, due to reason that the project manager was apprised that as per the report of SDM, Baghapurana issued vide letter no. 102/SPC-1 dated 01.06.2023, National Highway is located at a distance of 300 meters from the proposed site of the project as such the site is not suitable for establishment of hot mix plant as it is not complying with the siting guidelines prescribed by the Board vide notification dated 26.04.1999 for establishment of such type of units.
Thereafter, the Project Proponent has submitted its application for obtaining Consent to Establish (NOC) through OCMMS Id O23MOG365960for installation of batch type hot mix plant for preparing premix @ 180 TPH by using aggregate, water, cement &sand and Bitmen VG-30 & VG40 as raw material in the revenue area of Village Village Rajiana, Tehsil Baghapurana, District Moga, the detail of case is as under:
1. The Project Proponent has already submitted copy of DTP Moga report vide memo no. 41 dated 12.01.2023, relevant part of which is reproduced as under:
"ਖਸਰਾ ਨੰਬਰ103//24/1(2-7), 109//4(8-0), 7/1(5-0), 7/2(2-0), 7/3(1-0), 14(8-0), 17/1(5-4), 17(2-16)ਰਕਬਾ 34 ਕਨਾਲ 7 ਮਰਲੇ ਪਿੰਡ ਰਾਜੇਆਣਾ—2 (ਹਬ ਨੰ: 110), ਤਹਿਸੀਲ ਬਾਘਾਪੁਰਾਣਾ ਜਿਲ੍ਹਾ ਮੋਗਾ ਵਿੱਚ ਬਾਘਾਪੁਰਾਣਾ—ਕੋਟਕਪੂਰਾ ਰੋਡ ਤੇ ਪੈਂਦੀ ਹੈ, ਜਿਸ ਨੂੰ ਮਾਸਟਰ ਪਲੈਨ ਬਾਘਾਪੁਰਾਣਾ (2010—2031) ਅਨੁਸਾਰ 150—0 ਚੌੜਾ ਕਰਨਾ ਅਤੇ ਇਸ ਤਜਵੀਜਤ ਰੋਡ ਵਾਈਡਨਿੰਗ ਦੇ ਨਾਲ 5 ਮੀਟਰ ਨੋ ਕੰਸਟ੍ਰਕਸਨ ਛੱਡਿਆ ਜਾਣਾ ਤਜਵੀਜ ਕੀਤਾ ਗਿਆ ਹੈ। ਪ੍ਰਵਾਨਤ ਮਾਸਟਰ ਪਲੈਨ, ਬਾਘਾਪੁਰਾਣਾ (2010—2031) ਅਨੁਸਾਰ ਸਾਈਟ ਦਾ ਮੁੱਢਲਾ 200 ਮੀਟਰ ਤੱਕ ਹਿੱਸਾ ਮਿਕਸ ਲੈਂਡ ਯੂਜ ਜ਼ੋਨ ਅਤੇ ਉਸ ਤੋ ਪਿੱਛੇ ਬਾਕੀ ਦਾ ਹਿੱਸਾ ਖੇਤੀਬਾੜੀ ਜ਼ੋਨ ਵਿੱਚ ਪੈਂਦਾ ਹੈ। ਯੂਨੀਫਾਈਡ ਜੋਨਿੰਗ ਰੈਗੁਲੇਸ਼ਨ—2018 ਅਨੁਸਾਰ ਇਸ ਜ਼ੋਨ ਵਿੱਚ ਕੰਕਰੀਟ ਮਿਕਸਿੰਗ ਪਲਾਂਟ (ਬੈਚਿੰਗ ਪਲਾਂਟ), ਬਿਟੂਮਿੰਨ, ਸੈਂਡ, ਕੰਕਰੀਟ ਮਿਕਸਿੰਗ ਪਲਾਂਟ (ਹਾਟ ਮਿਕਸ ਪਲਾਂਟ) ਆਗਿਆਯੋਗ ਹਨ।"
2. The Project Proponent has already submitted copy of SDM Baghapurana report vide no. 102 / SPC-1 dated 01.06.2023, in which distance mentioned from various locations are as under:

But, the Project Proponent has submitted fresh report from SDM, Baghapurana vide letter no. 84 dated 21.05.2024, relevant part of which reproduced as under:
"ਉਪਰੋਕਤ ਵਿਸ਼ੇ ਤੇ ਹਵਾਲਾ ਅਧੀਨ ਪੱਤਰ ਦੇ ਸਬੰਧ ਵਿੱਚ ਬੇਨਤੀ ਹੈ ਕਿ ਆਪ ਜੀ ਵੱਲੋਂ ਮੰਗੀ ਗਈ ਰਿਪੋਰਟ ਤਹਿਸੀਲਦਾਰ, ਬਾਘਾਪੁਰਾਣਾ ਪਾਸੋਂ ਪ੍ਰਾਪਤ ਕੀਤੀ ਗਈ। ਮੁਤਾਬਿਕ ਰਿਪੋਰਟ ਤਹਿਸੀਲਦਾਰ ਵਾਕਿਆ ਰਕਬਾ ਪਿੰਡ ਰਾਜੇਆਣਾ—2 ਨੰਬਰਾਨ ਖਸਰਾ 103//24/1—109//4—109//7/2—109//7/3—109//14—109/17/1—109//17/2 ਦਾ ਇੱਕ ਟੱਕ ਹੈ ਜਿਸ ਵਿੱਚ ਹਾਟ ਮਿਕਸ ਪਲਾਂਟ ਹੈ ਅਤੇ ਇੱਕ ਟੱਕ ਦਾ ਨੰਬਰ ਖਸਰਾ 103//24/1 ਰਾਜ ਮਾਰਗ (ਕੋਟਕਪੂਰਾ — ਮੋਗਾ ਰੋਡ) ਨਾਲ ਲੱਗਦਾ ਹੈ ਅਤੇ ਰਾਜ ਮਾਰਗ ਤੋਂ ਉਕਤ ਪਲਾਂਟ ਦੀ ਦੂਰੀ ਲਗਭਗ 340 ਮੀਟਰ ਹੈ।"
3. The project proponent has already submitted copy of registry of land area 34 kanals 7 marlas on the name Sh. Darshan Kumar Gupta (one of partner / sharer of the firm), bearing khasra nos. 103//24/1(2-7), 109//4(8-0), 7/1(5-0), 7/2(2-0), 7/3(1-0), 14(8-0), 17/1(5-4), 17(2-16) in revenue estate of village Rajeana, Tehsil Baghapurana, District Moga.
4. The project proponent has already submitted the project report showing the value of proposed expansion i.e. hot mix plant gross fixed assets of Rs. 418 lacs. Accordingly, the project proponent has deposited the NOC fee of Rs. 10800/- vide UTR / Ref. No. N059232348692266 dated 28.02.2023, which is adequate for one year under orange category.
5. The project proponent has already submitted feasibility report regarding installation of dust collector followed by bag filter as APCD to contain the flue emissions from batch type hot mix plant.
6. The project proponent has proposed to install septic tank for treatment of domestic effluent with provision to discharge onto land for plantation.
7. The Project Proponent has already submitted copy of MOU among its 06 no. partners.
8. The Project Proponent has submitted copy of letter issued by National Highway Authority of India, New Delhi vide no. NHAI/30022/1/2017/PB/MB/PB-604 dated 31.12.2021 regarding allotment project for laying road under Bharatmala Pariyojana.
The site of hot mix plant was visited by undersigned (AEE) on 24.06.2024 and Sh. Bal Mukund Lal Nautiyal, representative was contacted. During visit it was observed that
1. The site is located along Moga- Kotkapura State Highway Road and location of HMP is located more than 300 meters from the Road.
2. No National Highway is located within 300 meter from HMP site. Moreover, the Project Proponent is doing work for construction of New NH-105B from Dhillon Nagar (Moga) to Bajakhana (Lambwali). As per work order issued by NHAI vide letter dated 31.12.2021 (copy enclosed). Moreover, as per guidelines of Board, the HMP is allowed at distance 200 meters from under construction National Highway, to whom work has been alloted.
3. No Village phirni / lal lakir, wide life sanctuary / zoo, national highway / scheduled road, education institute, historical religious place, protect monuments, residential area (cluster of 15 pacca houses) within the 500 mtrs radius from the site.
As per report of SDM Baghapurana dated 21.05.2024, the site is located along State Highway Kotkapura - Moga Road more than 340 m distance against 300 meter as per policy of the Board. As per copy of work order allotted by The National Highway Authority of India (NHAI) vide its letter no. NHAI/30022/1/2017/PB/MB/PB-604 dated 31.12.2021 has allotted work order to the M/s VRC Construction (I) Pvt. Ltd. for laying four laning new national highway from Dhillon Nagar (Moga) to Bajakhana (Lambwali) section of NH-105B (Greenfield Alignment) from design chainage km 0.000 to km 43.319 under Bharatmala Pariyogana.
In view of the above facts, the application of the project proponent was processed. The application was considered by the Zonal Office and it was observed that the industry has obtained NOC for RMC plant and WMM plant at the same area for which it has applied for obtaining fresh NOC for establishment of Hot mix Plant. Accordingly, the project proponent was requested to apply the application for Consent to establish (NOC for expansion) from the existing OCMMS IdG23MOG394485 from which it has already obtained CTE/CTOs for RMC plant. The representative of the industry was requested to obtain all the permission from existing OCMMS IDG23MOG394485.
Now, the Project Proponent has submitted its application through its existing OCMMS id for obtaining Consent to Establish (NOC for expansion) for installation of batch type hot mix plant for preparing premix @ 180 TPH by using aggregate, water, cement & sand and Bitumen VG-30 & VG40 as raw material in the revenue area of Village Village Rajiana, Tehsil Baghapurana, District Moga. The site has already been visited by undersigned (AEE) on 24.06.2024 and found suitable for establishment of hot mix plant as prescribed by Board i.e. National Highway (under construction) and State Highway as prescribed by the Board. The proposed pollution control measures seem adequate for such type of industry.
Keeping in view of above consent to establish (NOC for expansion) may be granted to the industry for installation of hot mix plant to prepare the premix @ 180 TPH with suitable conditions.
