Subject: Application for obtaining fresh consent to operate under the Water Act, 1974 and Air Act, 1981 - M/s Bhavin Agro Industries, Village Ghudani Khurd, Tehsil Payal, District Ludhiana.
Reference: Industry's online application ID 26205671 (W) and 26205670 (A) dated 19/07/2023.
It is submitted that the rice sheller was earlier granted 'Consent to Operate' under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Fresh/LDH1/2023/22895505 dated 11/08/2023 and under Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Fresh/LDH1/2023/22895335 dated 11/08/2023 valid upto 10/02/2024 for processing of Paddy @ 10.5 TPH to produce Rice @ 7 TPH, Polish @ 1.05 TPH, Rise Husk @ 1.9 TPH, Phuck @ 0.35 TPH and Nakku @ 0.2 TPH (with drier).
Earlier history
The industry was visited by AEE of this office on 24.03.2023 and observed that the rice seller was in operation. The rice sheller has installed one shelling section and one dryer unit, but the dried unit was without any air pollution control device and the air pollution control device installed on shelling unit was also without proper sampling arrangements. Further the movement area was not stabilized and the rice husk storage area was also not according to the code of practice. The rice sheller has not planted trees around the boundary as per COP nor for disposal of domestic effluent.
Accordingly, Board has refused consent to operate under the Water Act, 1974 vide no. CTOW/Fresh/LDH1/2023/21357056 dated 24/03/2023 and the Air Act, 1981 vide no. CTOA/Fresh/LDH1/2023/21356923 dated 24/03/2023. The Competent Authority of Board has decided to issue directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 for disconnection of electric connection available to the industry/ premises, with immediate effect.
Further, to verify the compliance, the industry was visited by the AEE of this office on 24/07/2023 and it was observed that the industry was following code of practice for rice mills. Accordingly, Competent Authority of the Board had granted 'Consent to Operate' under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 upto 10/02/2024 and PSPCL authorities were directed to restore the electric connection of the industry upto 10.02.2024 vide Board’s letter no. 4425-26 dated 11.08.2023.
Now, the industry has applied for fresh consent to operate under the Water Act, 1974 and the Air Act, 1981 alongwith requisite documents through OCMMS. The rice sheller has earlier deposited Rs. 46200/- vide e-R no. 827518990 dated 16/03/2023 as Water consent fee and Rs. 46200/- vide e-R no. 812729264 dated 16/03/2023 as Air consent fee against the fixed assets of Rs. 172.83 Lacs as on 20/02/2023 as per CA Certificate dated 21/02/2023. The consent fee is adequate upto 30/06/2026 as per Board's Office Order dated 29/10/2018 after deducting penalty fee 25 %.
To verify the compliance, the industry was visited by the AEE of this office on 12/07/2024 and it was observed as under:
1. The industry was not in operation due to rain.
2. The industry has installed drier of capacity 32 T/batch and paddy pre cleaner.
3. It has provided cyclone separator as APCD with paddy pre cleaner.
4. The industry has installed separate cyclone separator as APCD with the shelling section.
5. The industry has not installed any D.G. set.
6. The industry has stabilized its movement area.
7. The industry is complying with code of practice as per the notification dated 15/07/2013.
8. No water used in the process therefore no trade effluent is generated.
9. Domestic effluent generated is being discharged onto land for plantation after passing through septic tank.
In the subject cited case, the industry has mentioned ground water extraction @ 4.0 KLD. Considering 25 working days per month, ground water extraction will be 100 KL/month, which is less than 300 KL/month.
As per procedure for processing the cases for restoration of power supply, the consent may be granted only for 6 months in the second instance.
It is therefore recommended that:
1. Consent to operate under the Water Act, 1974 and the Air Act, 1984 may be granted for short period of 6 months for processing of Paddy @ 10.5 TPH to produce Rice @ 7 TPH, Polish @ 1.05 TPH, Rise Husk @ 1.9 TPH, Phuck @ 0.35 TPH and Nakku @ 0.2 TPH (with drier) with suitable conditions. (Competency- E.E)
2. PSPCL authorities may be directed to further restore electric connection for six months.
