It was brought out that the project proponent has applied for obtaining 'Consent to Establish' (NOC) under the Water Act, 1974 & Air Act, 1981 for establishment of residential colony in an area of 13.24 acres for development of 268 no. residential plots................ From the perusal of the documents submitted by the project proponent, it has been observed that the project proponent has proposed STP of capacity 435 KLD, considering 15 persons/plot and has proposed 181 KLD to be used for flushing purposes by providing dual plumbing line, 40 KLD to be used for utilization for the garden purposes to be developed in an area of 0.662 acres, 90 KLD onto plantation to be developed on the road sides in an area of 1.2 acres & 180 KLD to be discharged onto the adjoining land of 1.5 acres to be developed under karnal technology, however neither any revenue record of 1.5 acres land area submitted alongwith the application nor any registered land agreement submitted as a proof regarding the ownership of the said land area............... The matter has been considered by the Competent Authority and decided to afford an opportunity of show cause with personal hearing before refusal of 'consent to establish' (NOC) applied by the project proponent under the provisions of the Water Act, 1974 & Air Act, 1981............... In view of above, show cause notice before refusal of 'Consent to Establish' (NOC) under the provisions of the Water Act, 1974 and Air Act, 1981 has been issued to the project promoter alongwith an opportunity of personal hearing before the Senior Environmental Engineer of the Board on 04.07.2024................. During hearing, the partner of the colony attended the hearing and submitted written reply w.r.t. notice issued to it, which has been taken on record. He further stated that the land area of 1.5 acres (adjoining to the premises of the colony) belongs to the Partners of the colony and the same will be utilized for the disposal of the treated effluent. He further submitted that 181 KLD will be used for flushing purposes by providing dual plumbing line, 40 KLD into 0.6 acre land area to be developed under green parks, 90 KLD into 1.2 acre land area to be developed along the road sides and 180 KLD into 1.5 acres adjoining to the premises of the colony................. During hearing, it was deliberated that as per the Department of Housing and Urban Development notification issued vide no. G.S.R. 144/P.A.11/1995/Ss.180 and 43/2021 dated 31.08.2021 circulated by the Board vide Head Office letter no. 15864-82 dated 22.07.2022, it has been specified that the population of plotted development shall be counted @ 15 persons per plot, however the proposal of the project proponent to reutilized 181 KLD of the effluent for flushing purposes and the remaining effluent (180 KLD) to be discharged onto land for plantation in an area of 1.5 acres, does not seems to be feasible. So the proposal submitted by the project proponent for disposal of the treated wastewater is not adequate............... After hearing, the partner of the project as well as the officer of the Board, it has been decided by the Senior Environmental Engineer of the Board that the application applied by the project proponent for obtaining 'consent to establish' (NOC) under the Water Act, 1974 & Air Act, 1981 be refused..............
