Sir, it is intimated that the industry is small scale red category unit. The industry was earlier granted consent to operate under Water Act, 1974 vide no. CTOW/Renewal/LDH2/2022/19320183 dated 22.8.2022 expired on 30/06/2024 and under Air Act, 1981 vide no. CTOA/Renewal/LDH2/2022/19320166 dated 28/08/2022 expired on 30/06/2024 for manufacturing of Cycle Cart @11000 Nmber/Year and Kik Cycle/Cycle @110000Nmber/Year.
Now, the industry has applied for varied consent to operate under Water Act, 1974 & Air Act, 1981 alongwith requisite documents for decrease in production capacity i.e Cycle Cart @10000 Nmber/Year and Kik Cycle/Cycle @100000 Nmber/Year.
The application of the industry has been perused and it has been observed as under:-
1. The industry has not submitted copy of agreement with M/s JBR Technologies Ltd, Ludhiana for lifting of trade effluent generated from process and not clarified whether there is change in quantity of agreement due to decrease in production.
2. The industry has not intimated mode of lifting of trade effluent.
3. The value of plant and machinery during previous consent was 1.02 Cr and now value of plant and machinery is 1.03 Cr. The industry has not submitted details of machinery added due to which value of Plant & machinery Increased.
4. The industry has not submitted the certificate from Competent Authority regarding land use pattern of the area.
5. The industry has not submitted analysis report of air emissions of APCD installed by it.
6. The industry has not submitted point wise compliance to the previous consent conditions verified by visiting officer.
In view of the above, it is recommended that show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 may be issued to the industry with hearing at ZO level due to reason mentioned at point no. 1, 2, 3, 4 & 5 and RO may be requested to submit reply in view point no. 6, please.
