• The proposed unit is a small scale green category cold storage unit.
• The project proponent has applied for obtaining Consent to Establish (NOC) under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 to the Board through OCMMS of the Board for the establishment of a new cold storage unit at Village Mussewal, Tehsil Nakodar, Distt. Jalandhar under green category.
• The industry has deposited NOC fees Rs. 10,800/- vide UTR/Reference No. P183240332668052 Dated 01.07.2024, which is adequate for one year.
• The industry falls at serial no. 13 and code 3013 (Chilling Plant, cold storage and ice making).
• To verify the facts, the site was visited by officer of this office on 09.07.2024 and it was observed as under: -
1. The site is located in the revenue estate of Village Mussewal, Tehsil Nakodar, Distt. Jalandhar.
2. The project proponent has proposed to use 2.5 KLD of water for domestic use, thus only domestic effluent @ 2.0 KLD will be discharged onto land for plantation after passing through septic tank. There will be no generation of trade effluent at site. Entire cooling water will be re-circulated.
3. The project proponent has proposed to install 1 no. of D.G set of capacity 300 KVA with canopy and adequate stack height.
4. The site distance was checked on Google Maps and it was found that the village Mussewal Lal lakir/phirni is around 69 meters. However the representative has informed during the visit that they will construct cold store more than 100 meters distance from village Mussewal Lal lakir/phirni.
5. The project proponent has submitted a letter Land use classification from DTP vide no. 684 DTP(J)/SSV-1 dated 26.06.2024, which is reproduced as under:-
1) ਇਹ ਸਾਈਟ ਨਕੋਦਰ-ਮਲਸੀਆ ਰੋਡ (ਐਨ.ਐਚ. 7।) ਤੋਂ ਸੱਜੇ ਮੁੜਦਿਆਂ ਲਗਭਗ 390 ਮੀਟਰ ਦੀ ਦੂਰੀ ਤੇ ਪਿੰਡ ਬੋਧੀਪੁਰ ਨੂੰ ਜਾਂਦਿਆਂ ਲਿੰਕ ਸੜਕ ਦੇ ਮੱਜੇ ਪਾਸੇ ਪਿੰਡ ਮੂਸੇਵਾਲ (ਹ.ਬ ਨੰ. 68) ਤਹਿਸੀਲ ਨਕੋਦਰ, ਜ਼ਿਲ੍ਹਾ ਜਲੰਧਰ ਦੀ ਰੈਵੀਨਿਊ ਅਸਟੇਟ ਵਿੱਚ ਪੈਂਦੀ ਹੈ। ਸਾਈਟ ਦਾ ਰਕਬਾ 14 ਕਨਾਲ 1 ਮਰਲਾ (1.756 ਏਕੜ) ਹੈ, ਅਪਲਾਈ ਕੀਤਾ ਗਿਆ ਰਕਬਾ ਮੌਕੇ ਤੇ ਖਾਲੀ ਹੈ। ਮੌਕੇ ਅਨੁਸਾਰ ਇਸ ਸਾਈਟ ਦੇ ਨਾਲ ਲਗਦੇ ਰਕਬੇ ਵਿੱਚ ਸ਼ੈੱਡ ਤੇ ਲੇਵਰ ਕੁਆਰਟਰ ਬਣੇ ਹੋਏ ਹਨ ਅਤੇ ਮੌਕੇ ਤੇ ਦੋਨਾਂ ਸਾਈਟਾਂ ਦੀ ਇੱਕ ਸਾਂਝੀ ਚਾਰ ਦੀਵਾਰੀ ਹੋਈ ਹੈ।
2) ਇਹ ਸਾਈਟ ਨੋਟੀਫਾਈਡ ਮਾਸਟਰ ਪਲੈਨ ਨਕੋਦਰ (2010-31) ਦੇ ਰੂਰਲ ਅਤੇ ਐਗਰੀਕਲਚਰ ਜੋਨ ਅਤੇ Contiguous Expansion ਪਿੰਡ ਦੀ ਅਬਾਦੀ ਵਿੱਚ ਪੈਂਦੀ ਹੈ। ਯੂਨੀਫਾਈਡ ਜ਼ੋਨਿੰਗ ਰੈਗੂਲਰਾਈਜੇਸ਼ਨ ਦੇ ਟੇਬਲ ਨੰ.2 ਦੇ ਨੁਕਤਾ ਨੰ.C24 ਅਨੁਸਾਰ ਵਿਸ਼ੇ ਅਧੀਨ ਸਾਈਟ ਦਾ ਜਿਹੜਾ ਰਕਬਾ ਰੂਰਲ ਅਤੇ ਐਗਰੀਕਲਚਰ ਜੋਨ ਵਿੱਚ ਪੈਦਾ ਹੈ, ਉਸ ਵਿੱਚ ਕੋਲਡ ਸਟੋਰੇਜ ਦੀ ਸਥਾਪਨਾ ਆਗਿਆਯੋਗ ਹੈ। ਪਰੰਤੂ ਪਿੰਡ ਮੂਸੇਵਾਲ ਦੀ ਅਬਾਦੀ ਤੋਂ ਸਈਟ ਦੀ ਦੂਰੀ ਲਗਭਗ 69 ਮੀਟਰ ਹੈ। ਯੂਨੀਫਾਈਡ ਜ਼ੋਨਿੰਗ ਰੈਗੂਲਰਾਈਜੇਸ਼ਨ ਦੇ ਨੁਕਤਾ ਨੰ. 2.6 ਅਨੁਸਾਰ ਪਿੰਡ ਦੀ ਅਬਾਦੀ ਦੇ 100 ਮੀਟਰ ਦੇ ਘੇਰੇ ਵਿੱਚ ਕੋਲਡ ਸਟੋਰੇਜ ਦੀ ਸਥਾਪਨਾ ਆਗਿਆ ਯੋਗ ਨਹੀਂ ਹੈ। ਇਸ ਲਈ ਆਪ ਵੱਲੋਂ ਪਿੰਡ ਦੀ ਅਬਾਦੀ ਦੀ ਫਿਰਨੀ ਤੋਂ ।00 ਮੀਟਰ ਦੇ ਘੇਰੇ ਵਿੱਚ ਪੈਂਦੇ ਆਪਣੇ ਰਕਬੇ ਨੂੰ ਛੱਡਦੇ ਹੋਏ ਬਾਕੀ ਦਾ ਰਕਬਾ ਜੋ ਕਿ ਰੂਰਲ ਅਤੇ ਐਗਰੀਕਲਚਰ ਜੋਨ ਵਿੱਚ ਪੈਂਦਾ ਹੈ, ਉਸਦਾ ਬਿਲਡਿੰਗ ਪਲੈਨ ਪ੍ਰਵਾਨਗੀ ਹਿੱਤ ਅਪਲਾਈ ਕਰਨਾ ਬਣਦਾ ਹੈ।
3) ਸਾਈਟ ਨੂੰ ਅਪਰੋਚ ਰੈਵੀਨਿਊ ਦਸਤਾਵੇਜ਼ ਅਤੇ ਮੌਕਾ ਰਿਪੋਰਟ ਅਨੁਸਾਰ 22’-0'' ਚੌੜੀ ਲਿੰਕ ਰੋਡ ਤੋਂ ਲਈ ਗਈ ਹੈ। ਯੂਨੀਫਾਈਡ ਜੋਨਿੰਗ ਰੈਗੂਲੇਸ਼ਨ ਅਨੁਸਾਰ 22'-0'' ਚੌੜੀ ਲਿੰਕ ਰੋਡ ਨੂੰ 60 ਫੁੱਟ ਚੌੜਾ ਕਰਨ ਲਈ ਬਿਨਾ ਕਲੇਮ ਲਏ 19' -0" ਦੀ ਰੋਡ ਵਾਈਡਨਿੰਗ ਸਟਰਿੱਪ ਛੱਡਣ ਦੇ ਪਾਬੰਦ ਹੋਵੇਗੇ। ਸਾਈਟ ਦਾ ਫਰੰਟੇਜ਼ (181'-6'') ਅਤੇ ਰਕਬਾ (1.756 ਏਕੜ) ਵਿਭਾਰੀ ਗਾਈਡਲਾਈਨਾਂ ਦੀ ਪ੍ਰਤੀ ਪੂਰਤੀ ਕਰਦਾ ਹੈ।
4) ਸਰਕਾਰ ਦੀ ਨੋਟਿਫਿਕੇਸ਼ਨ ਨੰ:13/41/2021-6HG2/2684 ਮਿਤੀ 19/10/2022 ਰਾਹੀਂ ਜਾਰੀ ਹਦਾਇਤਾਂ ਵਿੱਚ ਦਰਜ ਵਿਭਾਰੀ ਗਾਈਡਲਾਈਨਾਂ ਦੀ ਪ੍ਰਤੀ ਪੂਰਤੀ ਕਰਨ ਉਪਰੰਤ-ਬਿਲਡਿੰਗ ਪਲੈਨ ਅਤੇ ਕੰਪਲੀਸ਼ਨ ਸਰਟੀਫਿਕੇਟ ਦੀ ਪ੍ਰਵਾਨਗੀ ਕੰਪੀਟੈਂਟ ਅਥਾਰਟੀ, ਡਾਇਰੈਕਟਰ. ਫੈਕਟਰੀਜ਼ ਪੰਜਾਬ ਪਾਸੋ ਪ੍ਰਾਪਤ ਕਰਨ ਦੇ ਪਾਬੰਦ ਹੋਵੋਗੇ ਅਤੇ ਸਬੰਧਿਤ ਵਿਭਾਗਾਂ ਦੀ ਐਨਓਸੀ ਤੋਂ ਬਿਨ੍ਹਾ ਪ੍ਰਵਾਨਗੀ ਮੌਕੇ ਤੇ ਕੋਈ ਵੀ ਉਸਾਰੀ ਨਹੀਂ ਕਰੋਗੇ ।
6. The project proponent has submitted site plan with khasra no.’s marked on it in which the propject proponent has drawn the 100 meter arc from the village Lal lakir and as per which the area of khasra no’s 24//20/2(5-13), 24// 20/1(2-16), 23// 16 (1-14), 24// 21/1/2(1-7), 24// 21/1/1(1-13) that part which is beyond 100 meter from the village lal lakir/Phirni will be used for construction of processing shed and no machinery or processing shed have been shown to be constructed or installed in the area within the 100 meter arc. Further the revenue authority also written in its report on the site plan dated 19.06.2024 mentioned about the accuracy of the drawing regarding the details of khasra no’s and no proposed construction within the area which is within 100 meter from village lal lakir/phirni.
7. The Industry has submitted Undertaking in which it is mentioned that: -
ਮੈਂ ਗੁਰਮੀਤ ਸਿੰਘ ਪੁੱਤਰ ਸ੍ਰੀ ਮਨੋਹਰ ਸਿੰਘ ਵਾਸੀ ਮਕਾਨ ਨੰਬਰ 294, ਐਲਡਿਕੋ ਗਰੀਨ ਨਕੋਦਰ ਰੋਡ, ਜਲੰਧਰ ਦਾ ਰਹਿਣ ਵਾਲਾ ਹਾਂ ਅਤੇ ਨੇਮ ਨਾਲ ਘੋਸ਼ਣਾ, ਕਰਦਾ ਹਾਂ ਕਿ
1) ਇਹ ਕਿ ਮੈਂ ਉਕਤ ਪਤੇ ਦਾ ਰਹਿਣ ਵਾਲਾ ਹਾਂ ।
2) ਇਹ ਕਿ ਮੈਂ ਇੱਕ ਕੋਲਡ ਸਟੋਰ ਜਿਸ ਦਾ ਨਾਮ ਮੈਸ਼ਰਜ ਕਰਨ ਪ੍ਰੀਤ ਕੋਲਡ ਸਟੋਰੇਜ਼, ਵਾਕਿਆ ਪਿੰਡ ਮੂਸੇਵਾਲ ਤਹਿ: ਨਕੋਦਰ ਜਿਲਾ ਜਲੰਧਰ ਦੀ ਹੱਦਬਸਤ ਨੰਬਰ 68 ਵਿਖੇ ਲਗਾਉਣ ਜਾ ਰਿਹਾ ਹਾਂ ।
3) ਇਹ ਕਿ ਜਮੀਨ ਦੇ ਖਸਰਾ ਨੰਬਰ 23// 16 (1-14) , 24// 20/2 (5-13), 24// 20/1(2-16) 24// 21/1/1(1-13), 24// 21/1/2(1-7) ਹਨ, ਜਿਸ ਵਿਚ, ਕੋਲਡ ਸਟੋਰ ਲਗਾਵਾਉਣ ਜਾ ਰਿਹਾ ਹਾਂ ।
4) ਇਹ ਕਿ ਮੈਂ ਜਿਸ ਖਸਰਾ ਨੰਬਰ ਦੇ ਰਕਬੇ ਵਿਚ ਕੋਲਡ ਸਚੋਰ ਦੀ ਬਿਲਡਿੰਗ ਦੀ ਉਸਾਰੀ ਕਰਵਾਂਵਾਂਗਾ, ਇਹ ਰਕਬਾ ਪਿੰਡ ਦੀ ਫਿਰਨੀ ਤੋ 100 ਮੀਟਰ ਦੀ ਦੂਰੀ ਚੋ ਬਾਹਰ , ਸਥਿਤ ਹੈ ਅਤੇ ਪਿੰਡ ਦੀ ਫਿਰਨੀਦੀ ਹਦੂਦ ਦੇ ਅੰਦਰ ਨਹੀ ਆਉਦਾ ਹੈ, ਇਹ ਮੇਰੀ ਨਿਰੋਲ ਜਿੰਮੇਵਾਰੀ ਹੋਵੇਗੀ ।
5) ਇਹ ਕਿ ਪਟਵਾਰੀ ਵਲੋਂ ਕੀਤੀ ਤਸਦੀਕ ਅਕਸ ਸਜਰਾ, ਜ਼ੋਨਿੰਗ ਪਲਾਨ, ਸਾਈਟ ਪਲਾਨ ਜੋ ਕਿ ਇਨਵੈਸਟ ਪੰਜਾਬ ਦੀ ਸਾਈਟ ਉੱਤੇ ਕੰਬਾਈਨਡ ਬਿਲਡਿੰਗ ਪਲਾਨਜ਼ ਅਪਰੂਵਲ ਤਹਿਤ, ਅਪਰੂਵਲ ਹੋਣ ਲਈ ਅਪਲੋਡ ਕੀਤੇ ਗਏ ਹਨ ਨਾਲ ਨੱਥੀ ਹਨ ।
6) ਉਹਨਾਂ ਸਾਈਟ ਪਲਾਨ ਅਤੇ ਜ਼ੋਨਿੰਗ ਪਲਾਨ ਉਪਰ 100 ਮੀਟਰ ਰੈਡੀਅਸ ਦਾ ਸਰਕਲ ਡਰਾਅ ਕੀਤਾ ਹੋਇਆ ਹੈ, ਜੋ ਕਿ ਮੈਂ 100 ਮੀਟਰ ਦੇ ਰੈਡੀਅਸ ਸਰਕਲ ਨੂੰ ਛੱਡ ਕੇ ਪੈਂਦੇ ਰਕਬੇ ਵਿਚ ਉਸਾਰੀ ਕਰਾਂਗਾ |
7) ਇਹ ਕਿ ਦਿੱਤਾ ਬਿਆਨ ਸਹੀ ਅਤੇ ਦਰੁਸਤ ਹੈ ।
8) ਇਹ ਕਿ ਇਹ ਮੇਰੀ ਨਿਰੋਲ ਜਿੰਮੇਵਾਰੀ ਹੋਵੇਗੀ ।
Keeping in view of above, it is recommended that the consent to establish (NOC) for cold storage at its proposed site located in revenue estate of at Village Mussewal Tehsil Nakodar, District Jalandhar under green category may be granted for one year to the industry with suitable conditions and with special conditions:-
1. The project proponent shall construct its cold store more than 100 meter away from village Mussewal Lal Lakir/Phirni and project proponent will not construct any processing shed and will not install any machinery within 100 meter of the village lal lakir/phirni with or outer its premises.
2. The industry shall comply with the terms and conditions mentioned in the DTP letter issued vide no. 684 DTP(J)/SSV-1 dated 26.06.2024 by the Competent Authority condition No. 02, which is reproduced:-

ਹੈ, ਉਸ ਵਿੱਚ ਕੋਲਡ ਸਟੋਰੇਜ ਦੀ ਸਥਾਪਨਾ ਆਗਿਆਯੋਗ ਹੈ। ਪਰੰਤੂ ਪਿੰਡ ਮੂਸੇਵਾਲ ਦੀ ਅਬਾਦੀ ਤੋਂ ਸਈਟ ਦੀ ਦੂਰੀ ਲਗਭਗ 69 ਮੀਟਰ ਹੈ। ਯੂਨੀਫਾਈਡ ਜ਼ੋਨਿੰਗ ਰੈਗੂਲਰਾਈਜੇਸ਼ਨ ਦੇ ਨੁਕਤਾ ਨੰ. 2.6 ਅਨੁਸਾਰ ਪਿੰਡ ਦੀ ਅਬਾਦੀ ਦੇ 100 ਮੀਟਰ ਦੇ ਘੇਰੇ ਵਿੱਚ ਕੋਲਡ ਸਟੋਰੇਜ ਦੀ ਸਥਾਪਨਾ ਆਗਿਆ ਯੋਗ ਨਹੀਂ ਹੈ। ਇਸ ਲਈ ਆਪ ਵੱਲੋਂ ਪਿੰਡ ਦੀ ਅਬਾਦੀ ਦੀ ਫਿਰਨੀ ਤੋਂ ।00 ਮੀਟਰ ਦੇ ਘੇਰੇ ਵਿੱਚ ਪੈਂਦੇ ਆਪਣੇ ਰਕਬੇ ਨੂੰ ਛੱਡਦੇ ਹੋਏ ਬਾਕੀ ਦਾ ਰਕਬਾ ਜੋ ਕਿ ਰੂਰਲ ਅਤੇ ਐਗਰੀਕਲਚਰ ਜੋਨ ਵਿੱਚ ਪੈਂਦਾ ਹੈ, ਉਸਦਾ ਬਿਲਡਿੰਗ ਪਲੈਨ ਪ੍ਰਵਾਨਗੀ ਹਿੱਤ ਅਪਲਾਈ ਕਰਨਾ ਬਣਦਾ ਹੈ।
3. The project proponent shall install its Cold store in the Khasra no. 23// 16 (1-14), 24// 20/2 (5-13), 24// 20/1(2-16) 24// 21/1/1(1-13), 24// 21/1/2(1-7) which falls more than 100 meters away from the village Mussewal Lal lakir/phirni.
4. The Industry shall submit approved building plan from competent authority within one month.
5. The Industry will obtain necessary permission from Central Ground Water Authority for extraction of ground water.
6. The industry will be bound to comply with the zoning regulation of the master plan in force and the grant of NOC by the Board will not vest any right on the industry w.r.t. other stipulations by any authority or the zoning regulations of the master plan.
7. The industry is bound to comply with the zoning regularizations of Master Plan as and when notified and Board will not be liable for any loss incurred in case site falls under non-conforming zone.
