It is intimated that Earlier the consent to operate under the Water (Prevention & control of Pollution) Act, 1974 & Air (Prevention& control of Pollution) Act, 1981 was granted to the said stone crusher vide no. CTOA/Fresh/HSP/2023/23341792 and CTOW/Fresh/HSP/2023/23341794 dated 30.08.2023, Valid upto 30.09.2024 for manufacturing of River Bed Material @10000CFT/day from Bajri, Sand, Gatka, Roari, Vapasi @10000CFT/day with conditions mentioned therein.
Thereafter the industry was visited by officer's of this office on 06.11.2023 and found the stone crusher was not complying with the code of practice prescribed by the Board.
Accordingly, the show cause notice issued for revocation of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 with an opportunity of personal hearing, but no one from the stone crusher attending the personal hearing.
Thereafter, the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 was revoked/cancelled vide this office letter no. 1376 dated 13.06.2024.
Now the industry has applied for obtaining fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 for the operation of stone crusher through OCMMS in a totally paperless manner by uploading necessary documents as PDF. The industry has already deposited Rs. 42000/- vide UTR No. 352061708 dated 23.08.2023 under Water (Prevention & Control of Pollution) Act, 1974, Rs. 42500/- vide UTR No. 499203249 dated 26.08.2023 under Air (Prevention & Control of Pollution) Act, 1981 same are adequate upto 30/09/2027 under both Acts.
Accordingly, the stone crusher was visited by the officers of this office on 04.07.2024 and contacted Sh. Sourav Saini, Representative of the unit who was present there. During the visit the stone crusher was not in operation. During visit, it was observed as under; The stone crusher has installed 02 No. Jaw, 02 No. Granulators, 02 No. Rotopactors, 03 no. Vibrators, 01 no. sandwash and 01 no. DG Set of capacity 500 KVA with canopy. The stone crusher has installed re-circulation tank of size 20'x20'x15'.
In view of above, if approved, it is recommended that consent to operate under Water (Prevention& control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 30/09/2025 with suitable along with special conditions :-
1. The stone crusher shall comply with the orders of NGT in O.A. No 57/2020 or any relevant orders of Competent Authority in related matter.
2. The stone crusher shall comply with the Punjab stone crusher policy 2022 implemented by Govt. of Punjab vide notification no. 5217/Crusher Policy dated 16/08/2022.
3. The stone crusher shall maintain the plantation cover around the periphery so as to comply with the code of practice
4. The industry shall obtain the registriation from Mining Department.
5. The Project Proponent shall obtained CLU from concerned Department within 02 months.
6. The industry shall comply with the code of practice prescribed by the Board.
7. The industry shall submit Approved Building Plan from the competent person under the Punjab Factories Act, 1948.
8. The stone crusher shall obtain permission from the Water Extraction of ground water the concerned Department.
9. The stone crusher shall comply with noise Rules ,2016 and ensured that no complaint regading operation of the stone crusher.
10. The stone crusher shall comply with the guidelines/code of practice of Environmental guidelines for stone crushing unit vide CPCB letter no. CP-12/9/2022-IPC-V-HO-CPCB-HO/1900 dated 01.08.2023 as circulated to the stone crusher within stipulated period.
