It is submitted that the industry is small-scale red category unit and was earlier granted consent to operate under Water Act, 1974 vide no. CTOW/Renewal/LDH4/2023/23086459 dated 17.08.2023 valid upto 16.02.2024 and under Air Act, 1981 vide no. CTOA/Renewal/LDH4/2023/23086463 dated 14.08.2023 valid upto 13.02.2024 with suitable and special conditions mentioned therein and with temporary restoration of electric supply upto 16.02.2024.
Further the industry obtained auto renewal consent to operate under the Water Act, 1974 and Air Act, 1981, which were valid upto 05.02.2029.
Further, the industry was issued show cause notice for revocation/cancellation of auto renewal consent to operate under the Water Act, 1974 with opportunity of personal hearing before SEE, ZO-2, Ludhiana on 03.07.024 as the industry has not obtained further extension in electric supply, wherein it was decided as under: -
1. Auto renewed consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 be revoked.
2. Environment Engineer, Regional Office–4, Ludhiana shall get the compliance of directions issued to the industry earlier, as till date no further extension in the electric connection restorations is allowed by the Board. He shall submit the report along with recommendations, within 07 days.
In compliance of above the auto renewal consent to operate under the Water Act, 1974 has been revoked by the Competent Authority vide Board’s letter no. 4293 dated 08.07.2024.
Now, the industry has applied for fresh consent to operate under the Water Act, 1974. The industry has already deposited consent fee of amounting Rs. 14000/- vide R. NO CBINH23002445861 dated 02.01.2023 and Rs. 11000/- vide R.no. CBINH24029644502 dated 29.01.2024 under the Water Act, 1974 which is adequate upto 31.01.2032.
The industry was visited by the undersigned on 11.07.2024 and it was observed as under: -
1. The industry was in operation during visit and engaged in electroplating process.
2. The industry has made agreement with the CETP operator i.e. M/s JBR Technologies Pvt. Ltd., Phase-8, Focal Point, Ludhiana for lifting of trade effluent @3000 Litre/month generated from electroplating process.
3. The industry has installed a water meter on source of fresh supply of water in the process area, reading of the same was 40.12 KL. Opening balance as on 01.01.2024 was noted approx. 850 Ltr as per record maintain by the industry.
4. The industry has consumed (40.12-27.50) 12.62 KL of fresh water from 01.01.2024 to 11.07.2024. The industry has lifted 12.5 KL of effluent in the said period to the CETP operator. The industry has provided a storage tank of the capacity 1500 Ltr, approx. 900 ltr of effluent was stored in it. As per the water auditing, the fresh water consumed in the process area is in consonance with the effluent lifted.
5. The industry has submitted a certificate issued by the DTP, Ludhiana vide letter no. 1918 DTP(L)/M2A dated 27.07.2023 mentioning that the site of the industry falls in industrial zone.
6. No DG set has been installed by the industry.
7. The industry is complying with the provisions of the Water Act, 1974 and Air Act, 1981.
It is pertinent to mention here that the industry is maintaining the record of water consumption/ storage/ generation/ lifting to CETP operator and the industry has submitted request letter that electric connection may not be disconnected as the industry is not violating provisions of the Water (Prevention & Control of Pollution) Act, 1974 and consent to operate may be granted for further period (Copy of the request letter attached).
Keeping in view of the above, it is recommended as under: -
1. Electric connection of the industry be restored for six months.
2. Fresh consent to operate under the Water Act, 1974 may be granted to the industry upto six months with suitable conditions as per policy of the Board.
