It is intimated that the industry is small scale red category unit and earlier the industry was granted consent to operate under the Water Act, 1974 vide no. ZO/SGR/WPC/2005-06/F-61 dated 27.12.2005 valid upto 30.06.2018 for doing the process of electroplating on job basis and discharge of trade effluent @ 0.2 KLD to be lifted by the M/s Malerkotla Electroplating Association for further treatment at M/s JBR, Focal Point, Ludhiana.
Earlier, the industry was visited by the officer of this office on 29.01.2024 and during visit, it was found as under:-
1. The industry was found in operation and was engaged in the process of electroplating on job basis.
2. The industry had not provided any water meter in the process Area.
3. The industry had also not maintained record of consumption of water. However, it was using the flexible pipe from source line.
4. The industry was found discharging its untreated trade effluent directly into MC sewer through monoblock pump and flexible pipe from collection tank. Effluent sampling of the same carried out during the visit and as per the analysis report, the results were found beyond the prescribed limits.
5. The industry had not made any agreement with CETP for treatment of trade effluent.
6. The industry had failed to show NOC/Consent of the board carried out during the visit.
Therefore, the industry was issued show cause notice with an opportunity of personal hearing before the Worthy CEE (B) of the Board on 27/03/2024, however, no one from the industry attended the personal hearing.
Therefore, the industry was given another opportunity of personal hearing before the CEE(B) of the Board on 02/05/2024. The representative has not submitted any satisfactory reply during the hearing. The Competent Authority of the Board had directed the PSPCL authorities to disconnect the electric supply available to the industry with immediate effect vide Board's letter no. 947-49 dated 13.06.2024.
The matter was taken up regularly with the PSPCL, authorities vide this office letter no. 3405-06 dated 25.06.2024 and through telephone to disconnect the electric connection of the unit.
Finally, the electric connection of the unit has been disconnected by the PSPCL authorities vide TDCO dated 03.07.2024 to stop the operation of its process. Same is attached in the list of documents.
Now, the industry has applied for fresh consent to operate under the Water Act, 1974 for manufacturing L Drop @ 139 kg/day, Tower bolt @ 347 kg/day and Wall hanger @ 24 kg/day by using MS Bar @ 260 Kgs/day, MS Strips @ 250 Kgs/day, Chrome @ 0.4 Kgs/day and Chemical and acids @ 22 Kgs/day as raw material with the generation of trade effluent @ 2 KL per week. Accordingly, it has signed the agreement with the SPV Malerkotla @ 2 KL per week and domestic effluent @ 0.6 KLD to be discharged into MC sewer. The industry has also requested to restore its electric connection.
The industry has deposited Rs. 18,700/- (Rs. 9800/- as consent fee + Rs. 8400/- as penalty fee + Rs. 500/- as application form fee) vide no. 862978836 dated 22.06.2024 against the value of fixed assets of Rs. 7.06 lacs as per CA certificate dated 14.06.2024, which is adequate upto 30.06.2025.
The industry has submitted a copy of the agreement made with SPV for treatment its trade effluent of quantity 2 KLD per week which is valid upto 31.12.2025, which is adequate as compare to the discharge of the industry as mentioned in the application form.
To verify the facts, the industry was visited by the officer of this office on 09.11.2024 and it was observed as under:-
1. The industry was not in operation due to non supply of electricity as same has been disconnected by PSPCL authorities in compliance to the directions of Competent Authority of the Board.
2. The industry has provided water meter in the process area and now it has maintained the record of water consumption and trade effluent lifting to the SPV, Malerkotla. It has also provided the permanent pipeline from source of fresh water.
3. The industry has installed collection tank in their premises of capacity 2000 ltr for the collection of its trade effluent for further lifting to the SVP Malerkotla.
4. The industry now removed the monoblock pump and flexible pipe from its premises and during visit no effluent was being bypassed.
5. The industry has now made an agreement with M/s SPV, Malerkotla @ 2 KL per week for disposal of trade effluent.
6. There is no D.G set/boiler inside the industry premises.
The industry is an old existing unit since 1980 (as per record file), however, it has not submitted any land use classification from the Competent Authority, however at site, there are majority industrial establishments.
As such, the industry has now made the provisions of the Water Act, 1974.
In view of above, it is recommended that:-
1. Short time consent to operate under the Water Act, 1974 may be granted to the industry for six months for the discharge of trade effluent @ 0.166 KLD, lifted through SPV, Malerkotla for further treatment and disposal at CETP, Focal Point, Ludhiana and domestic effluent @ 0.6 KLD to be discharged into MC sewer with usual conditions and special condition that the industry will be bound to submit its area classification certificate within 01 month.
2. PSPCL authorities may be directed to restore the electric connection of the industry temporarily for six months.
