It is intimated that the industry has been granted ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/SAS/2019/11194455 dated 22/10/2019 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/SAS/2019/11194445 dated 22/10/2019, having validity upto 30/06/2024, for production of Rail Coach & Locomotive Equipment @ 50 MTD, subject to certain conditions.
Now, the project proponent has applied for obtaining renewal of ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, alongwith requisite documents.
The industry has deposited Rs. 550100/- vide UTR no. SBINR52024051823345230 dated 18.05.2024 under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 528000/- vide UTR. no. SBINR52024051823343653 dated 18.05.2024 under the Air (Prevention & Control of Pollution) Act, 1981, which is adequate upto 30.06.2029 (Considering NOC regularization fee of Rs. 21600/-) for both the Acts against the increase in fixed assets of Rs. 133.02 cr. to 147.94 cr. as on 31.03.2024.
While processing the online application of the industry, some clarification was raised and the industry has replied as under:

1. Earlier, the project proponent was granted CTO for total value of fixed assets of Rs. 133.02 cr. Now, the industry has uploaded a CA certificate mentioning total value of assets of Rs. 147.94 cr. The industry is required to clarify the reason for increase in the fixed assets value. Latest CA Certificate of Fixed Assets of Rs. 147.94 Crore increased from Rs. 134.02 Crore is due to Maintainace Work and Replacement of Old Machinery with New Machinery for better thent Quality of Product. We confirm that there is no increase in Production Capacity.
2. As per the CA certificate, there in increase in the value of plant & machinery as well as building. As such, the industry is required to clarify regarding the same and upload revised approved building plan under the Factories Act, 1948 There is no addition in Machinery as well as in Building. The increase in value of Machinery and Building is due to Maintainace Work and Replacement of old Machinery with new Machinery for Betterment of Quality of Products. However, we are uploading the latest approved Building Plan Under Factory Act from Competent Person recognized by Director of Factories (Punjab) Under Factory Act 1948.
3. The industry is also requested to upload land use classification letter of the land on which the unit is located. We are operating our industry since 2013. Our industry falls under FEZ Area. Copies of CLUB are enclosed herewith for your reference.
4. Further, the industry is also required to deposit corresponding NOC regularization The water quantity mentioned in the application from is increased from the previous quantity, please clarify fee. We have already deposited NOC Regularization Fee of Rs. 21600/- ( Copy of Receipt is enclosed herewith)
5. In the previous application, the project proponent had mentioned that 10 KLD wastewater is disposed off onto land for plantation and now the project proponent has mentioned that 15 KLD wastewater is disposed off onto land for plantation. Hence the project proponent needs to clarify regarding this increase. There is no increase in Waste Water Generation. The 15.0 KLD mentioned is exact Quantity as per our Current Workers.
6. Further, the industry is also required submit details of green area, so as to adjudge its adequacy for disposal of treated wastewater. There is no increase in Waste Water Quantity. Therefore, treated effluent of same quantity is discharged into same Plantation Area.
Our Total Green Area is 0.375 Acres.
Visit:
Accordingly, the industry was visited by AEE of this office on 05.07.2024 and during visit, it was observed as under:
1. The industry was in operation. The industry is engaged in the manufacturing of Rail Coach & Locomotive Equipment. The manufacturing process involved is:
Raw material → Shearing of sheets & Plates → Press work → Bending → Tracking & Welding of components → Machining → Finished product for inspection (water testing) → Painting & Shot Blasting (if required) → Dispatch.
2. The industry has installed shearing machines, CNC machines, power presses, lathe machines etc. within its premises to carry out its manufacturing operations.
3. The industry does not generate and discharge any trade effluent from its process. The industry is generating only domestic effluent from its premises. The industry has installed an STP for treatment of domestic effluent being generated from its premises.
4. During earlier visit to the site of the industry on 16.04.2024, the effluent samples were collected and the analysis results as obtained from Head office Lab, Patiala is tabulated as under:

From above, it is clear that the industry is complying with the prescribed standards.
5. The industry is maintaining record of reading of flow meter installed at outlet of STP.
6. The industry is using treated domestic effluent onto land for plantation developed within its premises. The industry has developed around 0.3 acres of land area as per karnal technology for disposal of treated wastewater, which is adequate.
7. The industry generates hazardous waste of category 5.2, 21.1 and 33.1 from its premises. The industry has executed agreement with TSDF for lifting of hazardous waste of category 5.2 and 21.1. the industry has constructed as dedicated storage room with lock and key facility for storage of hazardous waste.
8. The industry has not installed any boiler/ melting furnace in its premises.
9. The industry has installed 04 no. DG sets of capacity 1 x 630 KVA, 2 x 500 KVA, & 1 x 250 KVA, which are equipped with inbuilt canopy and stacks of adequate height.
10. The industry has installed one paint booth section wherein the fabricated components are coated with paint through paint spray guns and the section is installed with membrane filters equipped with I/D fan attached to the stack (of height 3 m ARL). Further, the painted components are passed through an LPG fired drying oven which is equipped with stack of adequate height 3 m ARL.
11. The industry has installed 1 no. shot blasting machine installed with bag filter house acting as APCD attached to stack of height 3 m ARL.
12. The industry has submitted the analysis results of the stack emission sample of the process stack of shot blasting machine got analyzed by M/s Envirochem Testing & Consultancy LLP., collected on 28.06.2024 and tabulated as under:

From above, it is clear that the industry is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
Recommendations:
In view of above, if may approved, the ‘consent to operate’ granted under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, may be renewed upto 30.06.2029 with usual conditions & with following special conditions:
1. The industry shall not carry out any activity in its premises which can change the category of unit from Orange to Red.
2. The industry shall not generate and discharge any kind of trade effluent from its premises.
3. The industry shall discharge only domestic effluent onto land for plantation within premises after treatment in STP.
4. The industry shall apply for obtaining authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016, within 07 days.
5. The industry shall install flow meter on the tubewell installed in its premises, within 07 days.
6. The industry shall not use any fuel in its premises, except HSD for operation of DG sets and LPG for operation of oven.
7. The industry shall obtain permission from PWRDA (if required) and shall comply with the regulations of PWRDA, at all times.
8. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation at any time, under any circumstances.
9. The industry shall ensure that due to operation of the project at the site, no nuisance for general public is created at any time and no public complaints are received.
10. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time.
11. The unit shall ensure that no nuisance is created in the vicinity of its premises from the operations of its service station. In case, any complaint is received against the unit, the Board shall be at liberty to revoke/ cancel this consent without giving any opportunity of hearing to the industry.
12. The adequacy/ efficacy of the pollution control and disposal arrangements shall be the sole responsibility of the project proponent and the project proponent shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time.
13. The Consent is being granted to the industry based upon the undertaking/ documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time.
14. In case the industry fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the industry.
