It is submitted that the case has been re-processed in light of reply of clarification of the industry dated 11.07.2024, which is as under:-
It is intimated that the industry is a small scale and red category unit and was granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Varied/LDH2/2019/9901129 dated 01.07.2019 valid upto 30.06.2024 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Varied/LDH2/2019/9901114 dated 01.072019 valid upto 30.06.2024 for production of hydraulic fittings @ 40000 Numbers/Day.
Earlier, the industry was visited by the officer of the Board on 23.11.2022 and various discrepancies were observed during visit. Hence, the industry was issued show cause notice with an opportunity of personal hearing before the Senior Environmental Engineer, Zonal office-1, Ludhiana on 24.02.2023, in which the following decisions were taken:-
1. The industry shall maintain record regarding fresh water consumption, effluent lifted to CETP operator and effluent treated through STP on daily basis.
2. The industry shall provide APCD alongwith stack of adequate height with phosphating section and stacks of adequate of height with D.G sets and hot water generator, within 15 days.
3. The industry shall dispose hazardous waste of all categories to authorized agencies and shall also obtain authorization under Hazardous and other Waste (Management & Transboundary Movement) Rules, 2016 for all categories, within 15 days.
4. The Environmental Engineer, Regional office-2, Ludhiana shall verify submission of industry / compliance of hearing decisions and submit report alongwith recommendations, after 15 days.
To verify the compliance of the decisions of personal hearing, the industry was visited by officer of the Board on 23.01.2024 and it was observed that the industry has not provided the APCD with its phosphating section. Further, the industry has installed D.G. Set of 500 KVA with Inadequate stack height. Hence consent granted to the industry under the Air (Prevention & Control of Pollution) Act, 1981 was revoked vide Zonal office-1, Ludhiana letter no. 2285-86 dated 18.04.2024.
Now, the industry has applied for consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 on 09.07.2024 for manufacturing of hydraulic pipe fittings @ 40000 nos./day using M.S. Round @ 2400 MT/Year, Powder @ 5 Kgs/day, Caustic @ 6 Kgs/day, Acid @ 30 Kgs/day, Phosphate @ 18 Liter/day and Zinc @ 2 Liter/day as raw material.
The industry was visited by the undersigned on 09.07.2024 and 12.07.2024 and observed as under:-
(A) COMPLIANCE OF DECISIONS OF PERSONAL HEARING:
1. (a) Now, the industry is maintaining the record of fresh water consumption, effluent lifted to CETP operator. As per record maintained by the industry for the period 01.02.2024 to 09.07.2024, the o/B of effluent in storage tank was 5.5 KL, it has consumed 221.03 KL of fresh water in process area during this period, hence the quantity of total effluent = 226.53 KL. The trade effluent @ 201.80 KL has been lifted by M/S J.B.R. Technologies Pvt. Ltd., and about 7.0 KL effluent was lying stored in effluent storage tanks, which was in synchronization with water consumed considering the evaporation losses.
(b) It has installed the STP to treat the domestic effluent consisting of Storage Tanks (1,2,3)--> Aeration Tank-I, Aeration Tank-II, Clarifier --> Pre-filteration Tank--> Filters--> outlet. During visit dated 23.01.2024 it was observed that STP was in operation and samples from final out of STP were collected . As per analysis report the concentration of various parameters was found pH= 8.2, TSS= 25 (mg/l), TDS=630(mg/l), COD=56(mg/l), BOD 14(mg/l) and Oil & Grease= BDL (mg/l) which are within the prescribed limits prescribed by the Board.
2. Now, the industry has provided APCD alongwith stack of adequate height with phosphating section. It has provided adequate stack heights to its D.G.Sets of capacity 500 KVA & 250 KVA equipped with canopies and hot water generator.
3. Now, the industry has made an agreement with CTSDF,Nimbua and recyclers to dispose hazardous waste of all categories to authorized agencies and has also applied for authorization under Hazardous and other Waste (Management & Transboundary Movement) Rules, 2016 for respective categories which is being processed separately.
4. Now, the industry is complying with the decisions of personal hearing as stated above.
(B) OTHER DETAILS OF VISITS ARE AS UNDER:-
1. The industry is engaged in manufacturing of hydraulic pipe fittings.
2. The manufacturing process involves: MS Round - Cutting - Phosphating - Annealing - Caustic Cleaning - Phosphating - Cold Forging - Machining - Caustic Clean - Zinc Plating - Packaging.
3. Now, the industry has provided APCD alongwith stack of adequate height with phosphating section.
4. Now, the industry has provided the adequate stack heights to its D.G.Sets of capacity 500 KVA & 250 KVA equipped with canopies.
5. One hot water generator is installed with adequate stack height in which uses diesel as fuel.
6. As per CA certificate submitted by the industry the value of total fixed assets is Rs. 654.67 Lacs as on 31.03.2024.
7. The industry has deposited Rs. 108000/- Vide R.No N170243100468572 Dt 18.06.2024 as consent fee Air, which is adequate upto 30.06.2029.
8. Now, the industry deposited Rs. 3600/- vide R.No. N190243140993573 dated 08.07.2024 as NOC Regularisation fee and Rs. 2660/- (Rs. 2160/- as Late Fee + Rs. 500/- as consent form fee) vide R.No. N190243141018447 dated 08.07.2024 .
9. As per details submitted by the industry, it has increased in fixed assets are Cars, Tools and other assets for industrial use.
10. The industry has submitted approved building plan from authorized competent person authorized by Director of Factories, Punjab.
11. The industry has submitted the letter issued by DTP, Ludhiana vide no 2026 dated 30.6.2014 which the site of the industry falls in industrial zone as per Master Plan, Ludhiana (2007-31).
12. It is further submitted the e-noting No. 20572150 processed on 10.07.2024 may please linked with the above said facts and with the following recommendations.
Keeping in view of above, it is recommended that Consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 may be Granted to the industry up to 30.06.2029.
