It is submitted that the industry was issued show cause notice for violation of the provisions of Water Act, 1974 & Air Act, 1981 and Plastic Waste Management Rules, 2016 with an opportunity of personal hearing before the Senior Environmental Engineer on 12.03.2024. After hearing, the representative of the industry as well as the officer of the Board, it has been decided by the Senior Environmental Engineer of the Board that:-
1. The industry shall ensure that the painting is executed in a separate enclosure/room with adequate air pollution control device, within 15 days.
2. The industry shall apply for obtaining consents to operate under Water Act, 1974 and Air Act, 1981, within 15 days alongwith all the requisite documents.
3. Regional Office, Faridkot shall visit the industry immediately after 15 days to verify the compliance(s) made by it and process the applications to be applied by the industry under the Water Act, 1974 and Air Act, 1981, on merits……………………
Now, the industry has applied for obtaining fresh consent to operate under the Water Act, 1974 and the Air Act, 1981 through OCMMS for manufacturing of plastic toys @ 500 kgs/day using plastic granules @ 500 kg/day under green category. Details of the case are as under:
1) The industry has submitted copy of change of land use certificate vide memo no. 1084 STP(L) TW12A dated 26.03.2018 issued by the Department of Town & Country Planning vide by Senior Town Planner, Ludhiana for area of 6 kanal 03 marlas bearing khasra no. 95//3 in the revenue state of Village Sulhani (H.B. No. 168), Tehsil & District Ferozepur…….
2) The industry has submitted possession report from the revenue authorities. As per which, the industry is owing its land. The industry has also submitted copy of sale deed…..
3) The industry has submitted electric connection bill as proof of date of commissioning as 28.05.2018…..
4) The industry has submitted CA certificate showing the value of gross fixed assets as Rs. 10.91 Lakhs. Accordingly, the industry has deposited Rs. 28000/- vide UTR/Ref No. 611303972 dated 08.07.2024 under the Water Act 1974 and 28000/- vide UTR/Ref No. 262421563 dated 08.07.2024 under the Air Act, 1981, which is adequate for a period upto 31.12.2029 after deducting penalty, previous fee and NOC regularization fee…….
5) The industry has submitted GST registration certificate, as per which Sh. Gurinder Singh is proprietor of the unit. ……
6) The industry has submitted copy of report w.r.t. general siting guidelines issued by the Naib Tehsildar, Talwandi Bhai, District Ferozepur, which is reproduced as under:-
1) ਨੰਬਰਾਨ ਖਸਰਾ ਮੁਸਤੀਲ 95//3 (6-3) ਦਾ 40/123 ਹਿੰਸਾ ਬਕਦੱਰ 2-0 ਜਿਸਦੀ ਮਾਲਕੀ ਮੈਸਰਜ ਫਰੈਡਜ਼ ਪਲਪ ਮੋਲਡਿੰਗਸ ਪਿੰਡ ਸੁਲਹਾਣੀ ਤਹਿਸੀਲ ਵਾ ਜਿਲਾ ਫਿਰੋਜ਼ਪੁਰ ਦੀ ਮਾਲਕੀ ਵਾ ਕਬਜਾ ਹੈ ।
2) ਇਹ ਨੰਬਰਾਨ ਖਸਰਾ ਰਕਬਾ ਲਾਲ ਲਕੀਰ / ਫਿਰਨੀ ਦੇ ਦਾਇਰੇ ਤੋਂ 100 ਮੀਟਰ ਦੂਰੀ ਤੋਂ ਬਾਹਰ ਹੈ ।
3) ਇਹ ਰਕਬਾ ਮਿਉਸਪਲ ਕਮੇਟੀ ਦੀ ਹਦੂਦ ਤੋਂ 100 ਮੀਟਰ ਦੀ ਦੂਰੀ ਤੋਂ ਬਾਹਰ ਹੈ ।
4) ਇਸ ਦੇ 100 ਮੀਟਰ ਘੇਰੇ ਵਿੱਚ ਕੋਈ ਰਿਹਾਇਸ਼ੀ ਵਾ 15 ਪੱਕੇ ਮਕਾਨ ਨਹੀਂ ਹਨ ।……..........
5) The industry has submitted an undertaking to the fact that it will only use coloured plastic granules at every time……...
To check the compliance, the industry was visited by undersigned (AEE) on 14.07.2024 and it was observed as under: -
1. The industry was in operation and engaged in the manufacturing of plastic toys using fresh plastic granules. Another unit namely M/s N F Moulding is also operating opposite to the industry. Earlier the visiting officer consider the both units as single unit. CTO application of the unit M/s N F Moulding is being dealt through OCMMS separately.
2. The industry has installed 08 no. injection molding machines. …
3. The industry has not installed any paint machine for painting. ….
4. The industry has installed septic tank for treatment of domestic effluent generated from washroom section………………….
As per the report of Naib Tehsildar, Talwandi Bhai and CLU issued by the Department of Town & Country Planning, the site is suitable for such type of units. The industry is complying with the provisions of the Water Act, 1974 and the Air Act, 1981…….
It is therefore recommended that consent to operate under the Water Act, 1974 and the Air Act, 1981 may be granted to the industry for a period upto 31.12.2029 for manufacturing of plastic toys @ 500 kgs/day using fresh coloured plastic granules, subject to the suitable conditions alongwith the following specific: -
1) The industry shall always use fresh coloured plastic granules as undertaking submitted by it.
2) The industry shall not use recycled plastic granules without obtaining prior permission from the Board.
3) The industry shall not carry out painting process within the premises without obtaining prior permission from the Board.
4) The industry shall not manufacture any banned single use plastic item / plastic carry bags.
