The industry was given personal hearing before the Chief Environmental Engineer, Ludhiana on 17.08.2022 u/s 31-A of the Air Act, 1981, wherein it was decided as under:
1. The industry shall install mechanical feeder and wet scrubber in line with the existing APCD, within one month, positively.
2. The industry shall maintain and operate its air pollution control device (APCD) regularly and efficiently, so as to achieve the stack emission standards consistently as prescribed by the Board/ MoEF&CC and also ensure not to emit black smoke under any circumstances.
3. The industry shall deposit Environmental Compensation of Rs. 01 Lac in lieu of the violations made by the industry.
4. It was made clear to the industry that if the industry was found emitting black smoke in future, then closure orders will be issued against the industry, without any further notice/ opportunity of hearing.
5. Environmental Engineer, Regional Office-3, Ludhiana shall visit the industry after one month to verify the contentions made by the industry, collect air emissions sample and submit report/ recommendations, within one month.
The industry has not installed wet scrubber and has also not deposited Environmental Compensation of Rs. 01 Lac.
Thus, the industry is not complying with the decisions of personal hearing dated 17.08.2022.
Keeping the above in view, it is recommended that show cause notice for refusal of ‘Consent to Operate’ under the Air Act, 1981 may be issued to the industry.
