• It is submitted that the industry was granted Consent to operate under Water Act, 1974 & Air Act, 1981 vide nos. CTOW/Varied/BTI/2022/19978669 & CTOA/Varied/BTI/2022/19978104 dt. 12.10.2022, which is valid upto 30.09.2027 for production of Raw Rice/Sorted Rice @ 2 TPH with dryer, subject to the conditions mentioned therein.
• Earlier, the industry has already existed in land area of 18 Kanals 0 Marlas land, bearing Khasra /Killa nos. 185/2 min (2-12) 197/1 (8-15) 197/4 (6-13) in the revenue area of Village Balahar vinjhu, Goniana, Tehsil & Distt. Bathinda.
• The industry vide its request letter dated 28.06.2023 has submitted the proposal for expansion of land by adding 15 Kanals 10-5/9 Marlas in the revenue area of village Balahar vinjhu, Goniana. After addition in the land the total land area under the rice sheller will be 33 Kanals 10-5/9 Marlas bearing khasra nos. 185/1/1(1-7-7/9), 196/3(1-10), 185/2(7-15), 197/2/2(2-7-7/9), 197/3(2-10) and 185/2 min (2-12) 197/1 (8-15) 197/4 (6-13) along with relevant record for the expansion of existing rice sheller unit in the revenue estate of Village Balahar vinjhu.
• Accordingly, the proposal was sent to the District Town Planner, Bathinda vide this office letter nos. 2737 dt. 28.06.2024, with the request to submit report regarding their concerned parameters as required in view of the siting guidelines prescribed by the State Govt. vide order dt. 15.10.2013.
• Now, the industry has applied for obtaining varied consents to operate of the Board under Water Act, 1974 & Air Act, 1981 through OCMMS for production of raw rice / sorted rice @ 5 TPH with dryer with expansion in land area for 15 kanals 10-5/9 Marlas bearing khasra no. 185/1/1(1-7-7/9), 196/3(1-10), 185/2(7-15), 197/2/2(2-7-7/9), 197/3(2-10).
• The details of case are as under –
• Earlier, the industry has submitted consent fee under Water Act, 1974 and Air Act, 1981 against fixed assets of Rs. 138.90 lacs, which is adequate up to 30.06.2027
• Now, the industry has deposited consent fee of Rs. 19100/- vide online UTR. No. 985530011 dated 03.07.2024 (including NOC Regularization Fee of Rs. 1800/-, Water Consent Fee of Rs. 16800/- and Form Fee of Rs. 500/-) under Water Act, 1974 and Rs. 16800/- vide online UTR. No. 893735006 dated 03.07.2024 under the Air Act, 1981, against fixed assets of Rs. 156.54 lacs to make it adequate up to 30.06.2029 under the both acts.
• The industry has submitted the Land Use Classification report from the Department of District Town Planner, Bathinda vide his memo no. 819 dt. 01.07.2024 has reported as under and the relevant extract of which is reproduced as –
ਉਪਰੋਕਤ ਵਿਸ਼ੇ ਸਬੰਧੀ ਹਵਾਲੇ ਅਧੀਨ ਪੱਤਰ ਨਾਲ ਪ੍ਰਾਪਤ ਦਸਤਾਵੇਜ਼ਾਂ ਨੂੰ ਇਸ ਦਫਤਰ ਵਿਖੇ ਵਾਚਿਆ ਗਿਆ ਹੈ ਅਤੇ ਸਾਈਟ ਦਾ ਮੌਕਾ ਨਿਰੀਖਣ ਕਰਵਾਇਆ ਗਿਆ ਹੈ। ਵਿਸ਼ੇ ਅਧੀਨ ਵਾਧੇ ਵਾਲੀ ਸਾਈਟ ਜੈਤੋ ਨਿਆਣਾ ਖੇਡ ਤੋਂ ਪਿੰਡ ਮਹਿਮਾ ਸਵਾਈ ਵੱਲ ਜਾਦਿਆਂ ਲਿੰਕ ਸੜਕ ਉੱਪਰ ਪੈਂਦੇ ਰੇਲਵੇ ਫਾਟਕ ਤੋਂ ਲਗਭਗ 472 ਮੀਟਰ ਦੀ ਦੂਰੀ ਤੇ ਖੱਬੇ ਹੱਥ ਸਥਿਤ ਸ਼ੈਲਰ ਦੇ ਨਾਲ ਅਤੇ ਪਿਛਲੇ ਪਾਸੇ ਪੈਂਦੀ ਹੈ। ਦਫਤਰੀ ਰਿਕਾਰਡ ਅਨੁਸਾਰ ਇਸ ਦਫਤਰ ਦੇ ਯਾਦ ਪੱਤਰ ਨੰ. 2871 -ਡੀਟੀਪੀ(ਬੀ)/ਸਮ-55 ਮਿਤੀ 30-12-2015 ਰਾਹੀਂ ਮੌਜੂਦਾ ਸ਼ੈਲਰ ਦੇ 18 ਕਨਾਲ 0 ਮਰਲੇ ਰਕਬੇ ਦੀ ਸਾਈਟ ਨੂੰ ਭੋ-ਵਰਤੋਂ ਤਬਦੀਲੀ ਦੀ ਪ੍ਰਵਾਨਗੀ ਜਾਰੀ ਕੀਤੀ ਹੋਈ ਹੈ। ਹੁਣ ਵਾਧਾ ਕੀਤੀ ਜਾ ਰਹੀ ਸਾਈਟ ਤਹਿਸੀਲਦਰ ਗੋਨਿਆਣਾ ਮੰਡੀ ਦੀ ਤਸਦੀਕਸ਼ੁਦਾ ਰਿਪੋਰਟ ਮਿਤੀ 11-03-2024 ਅਨੁਸਾਰ ਰੈਵੀਨਿਊ ਅਸਟੇਟ ਪਿੰਡ ਬਲਾਹੜ੍ਹ ਵਿੰਬੂ, ਹੜ, ਨੰ. 166 ਤਹਿਸੀਲ ਗੋਨਿਆਣਾ, ਜਿਲਾ ਬਠਿੰਡਾ ਦੇ ਖਸਰਾ ਨੰ. 185/1/1(1-7-7/9), 196/3(1-10), 185/2(7-15), 197/2/2(2-7-7/9), 197/3(2-10) ਕੁੱਲ ਰਕਬਾ 15 ਕਨਾਲ 10-5/9 ਵਿੱਚ ਪੈਂਦੀ ਹੈ। ਵਾਧਾ ਕਰਨ ਉਪਰੰਤ ਸਾਈਟ ਅਧੀਨ ਕੁੱਲ ਰਕਬਾ 33 ਕਨਾਲ 10-5/9 ਮਰਲੇ (4.19 ਏਕੜ) ਬਣ ਜਾਦਾ ਹੈ।
ਪੰਜਾਬ ਸਰਕਾਰ ਦੇ Department Of Science, Technology & Environment and Non-Conventional Energy ਵਿਭਾਗ ਵੱਲੋਂ ਜਾਰੀ ਗਾਈਡਲਾਈਨ ਮਿਤੀ 15-10-2013 ਅਨੁਸਾਰ ਇਸ ਦਫਤਰ ਨਾਲ ਸਬੰਧਤ ਨੁਕਤਾ A(i) ਤੋਂ A(ii) ਦੀ ਰਿਪੋਰਟ ਹੇਠ ਲਿਖੇ ਅਨੁਸਾਰ ਹੈ:-
A(i) ਵਿਸ਼ੇ ਅਧੀਨ ਸਾਈਟ ਕਿਸੇ ਫੋਕਲ ਪੁਆਇੰਟ ਜਾਂ ਡੈਜੀਗਨੇਟਡ ਉਦਯੋਗਿਕ ਖੇਤਰ ਵਿੱਚ ਨਹੀਂ ਪੈਂਦੀ ਹੈ।
A(i) ਸਾਈਟ ਨੋਟੀਫਾਈਡ ਮਾਸਟਰ ਪਲੈਨ ਬਠਿੰਡਾ ਦੀਆਂ ਹੱਦਾਂ ਦੇ ਅੰਦਰ ਤਜਵੀਜ਼ੀ ਉਦਯੋਗਿਕ ਖੇਤਰ ਵਿੱਚ ਪੈਂਦੀ ਹੈ। ਜਿਸ ਵਿੱਚ ਰਾਈਸ ਸੈੱਲਰ ਸਥਾਪਤ ਕਰਨਾ ਆਗਿਆਯੋਗ ਹੈ।
A(i) ਵਿਸ਼ੇ ਅਧੀਨ ਸਾਈਟ ਦੇ 500 ਮੀਟਰ ਦੇ ਘੇਰੇ ਅੰਦਰ ਕੋਈ ਨੈਸ਼ਨਲ ਹਾਈਵੇਜ਼/ਸ਼ਡਿਊਲ ਰੋਡ, ਸਟੇਟ ਹਾਈਵੇ ਜਾਂ ਬਾਈਪਾਸ ਨਹੀਂ ਪੈਂਦਾ ਹੈ।
• The industry has also submitted the report of Naib Tehsildar, Goniana vide his report dt. 21.06.2024 has reported as under and the relevant extract of which is reproduced as –
ਮਾਲ ਰਿਕਾਰਡ ਮੁਤਾਬਿਕ ਇਹ ਤਸਦੀਕ ਕੀਤਾ ਜਾਂਦਾ ਹੈ ਕਿ ਸੁਖਦੀਪ ਸਿੰਘ ਪੁੱਤਰ ਸੁਖਦੇਵ ਸਿੰਘ ਪੁੱਤਰ ਗੁਰਦੇਵ ਸਿੰਘ ਦੀ ਮਾਲਕੀ ਖਸਰੇ ਨੰਬਰ 185/1/1, 197/2/2, 185/2/2, 197/4/1, 185/2/1, 185/2/3, 197/1, 197/4/2, 197/3, 196/3 ਵਿੱਚੋਂ 33-10-5/9 ਦੀ ਹੈ ਜੋ ਕਿ ਬਲਾਹੜ੍ਹ ਵਿੰਝੂ ਦੇ ਰਕਬੇ ਵਿੱਚ ਪੈਂਦੀ ਹੈ। ਇਸ ਰਕਬੇ ਦੇ 500 ਮੀਟਰ ਦੇ ਘੇਰੇ ਵਿੱਚ ਕਿਸੇ ਪਿੰਡ ਦੀ ਫਿਰਨੀ / ਲਾਲ ਲਕੀਰ, ਵਾਈਲਡ ਲਾਈਫ ਸੈਂਚਰੀ, ਚਿੜੀਆਘਰ, ਕਿਸੇ ਵੀ ਸਰਕਾਰੀ ਅਦਾਰੇ ਤੋਂ ਮਾਨਤਾ ਪ੍ਰਾਪਤ ਰਿਹਾਇਸ਼ੀ ਏਰੀਆ, ਕੋਈ ਵਿਦਿਅਕ ਅਦਾਰਾ, ਇਤਿਹਾਸਿਕ ਸਥਾਨ, ਧਾਰਮਿਕ ਸਥਾਨ ਅਤੇ ਪ੍ਰੋਟੈਕਟ਼ਡ ਮੋਨੂਮੈਂਟ ਨਹੀਂ ਆਉਂਦੇ ਹਨ। ਰਿਪੋਰਟ ਪੇਸ਼ ਹੈ।
• The site of the industry was visited on 06.07.2024 and it was observed as under:
1. The rice sheller was not in operation due to off season.
2. The rice sheller has provided a shelling section with cyclone as APCD to arrest the dust emissions from the shelling process.
3. The rice sheller has installed a drier section with cyclone as APCD equipped with the paddy pre cleaner.
4. The industry has provided sampling facilities along with stack of adequate height with shelling section as well as with paddy cleaner of dryer section.
5. The industry has provided wall of adequate length with height of 10 feet around husk storage area and 5 feet Jali have been provided over the said wall.
6. The industry has provided paved road for the control of the vehicular dust pollution.
7. The industry has provided the septic tank for treatment of domestic effluent of office building with provision of discharge of effluent onto land for plantation.
8. The industry has provided adequate plantation along the boundary wall of the industry
9. The rice sheller has completed it process of expansion in the land area.
10. The industry has installed additional machinery for increasing the production capacity.
11. The site is outside the 500 m radius of village lal lakeer/phirni, wild life sanctuary, zoo, educational institute, historical religious place and protected monument. However, there are 6-7 houses within 500 m radius of the site.
12. No HT wire passes through the proposed expansion site of the rice sheller unit.
• As such, the site of the industry is suitable for expansion and complying with the provisions of the Water Act, 1974 & Air Act, 1981 as well as code of practice prescribed by the Govt. vide order dt. 15.10.2013.
• Keeping in view of above, if approved, it is recommended that varied consents to operate under the provisions of the Water Act, 1974 and Air Act, 1981 may be granted to the industry for production of raw rice/sorted rice @ 5 TPH with dryer for a period upto 30.06.2029, subject to the suitable conditions along with specific condition that the industry will comply with the conditions imposed by District Town Planner in the report sent to Punjab Pollution Control Board in the report regarding verification of site guidelines.
