It is intimated that the industry is a small scale orange category brick kiln and recently, was granted consent to operate under the Water Act, 1974 vides no. CTOW/Fresh/SGR/2024/25509735 dated 06.06.2024 and under the Air Act, 1981 vide no. CTOA/Varied/SGR/2024/25510456 dated 06.06.2024 valid upto 30.09.2030 for manufacturing of Bricks and Tiles @ 20,000 Numbers/Day by using Clay & Soil @ 50 Metric Tonnes/Day as raw material under orange category, in the name of Darshan Singh, (Proprietor) after adopting zig-zag technology in its kiln.
Now, a new partner has been added in the firm namely Sh. Ranjit Singh S/o Sh. Gurcharn Singh. In this regard, the Brick kiln has provided partnership deed dated 04.07.2024.
Accordingly, the brick kiln has now applied for obtaining varied consent to operate under the Water Act, 1974 and the Air Act, 1981 for manufacturing of Bricks and Tiles @ 20,000 Numbers/Day by using Clay & Soil @ 50 Metric Tonnes/Day as raw material under orange category in the name of Darshan Singh as a partner.
The industry has already deposited consent fee of Rs. 32,400/- (Rs. 21,600/- consent fee + Rs. 10,800/- penalty fee) deposited through online vide UTR No. 179974139 dated 29/04/2024 under the Water Act, 1974 & Rs. 34,700/- (Rs. 21,600/- consent fee + Rs. 10,800/- penalty fee) + Rs. 1800/- NOC fee + Rs. 500/- application fee) vide UTR no. 823018046 dated 29/04/2024, under the Air Act, 1981, against the fixed assets of value i.e. Rs. 16.37 Lacs as per CA certificate date 23.04.2024. The deposited fee is adequate upto 30.09.2030 under the both the Acts. The brick kiln has already submitted following documents along with its previous approved applications: -
1) Coal record, as per which it has not used coal during the period of 01.02.2019 to 29.02.2020.
2) Coal Consumption Certificate issued by CA as per which BKO was not in operation from 01.02.20219 to 29.02.2020.
3) Completion certificate issued by CSIR- Central Building Research Institute, Roorkee, as per which the bko has constructed induced draught brick kiln with zig-zag technology, rectangular in shape as per CSIR-CBRI design and as per certificate, the brick kiln has adopted induced draft technology on dated 19.02.2020.
The brick kiln was already visited by officer of the Board on 14.05.2024 and it was observed as under:-
1) The brick kiln was not in operation.
2) The Brick kiln has adopted induced draft technology for the manufacturing of bricks and has submitted design adequacy cum completion certificate issued by CBRI, Roorkee dated 19/02/2020. 3) The brick kiln has provided pucca keri road for the movement of the vehicles.
3) The industry has provided plantation along the boundary.
4) The industry has provided ladder with the stack for carry out emission sampling of the kiln.
5) No unauthorized fuel was found at the site.
6) The industry has provided septic tank for the treatment of domestic effluent and discharge of treated effluent onto plantation.
Keeping above in view, it is recommended that consent to operate already granted under the Water Act, 1974 and the Air Act, 1981 up to 30/09/2030 for manufacturing of Bricks and Tiles @ 20000 Numbers/Day by using Clay & Soil @ 50 Metric Tonnes/Day as raw material under orange category in the name of Sh. Darshan Singh as a proprietor may now be granted in the name of Sh. Darshan Singh as a partner, subject to certain conditions to be mentioned therein and a special condition that the industry shall replace at least 20 % coal with paddy straw pellets as per directions issued by the Government vide notification dated 4.11.2022.
