Earlier the industry was operating with the name & style of M/s Master Art Processors at Mata Karam Kaur Colony, Near Lovely Dyeing Tajpur Road, Ludhiana. The old unit operating at Mata Karam Kaur Colony was granted ‘Consent to Operate’ under the Water Act, 1974 vide no. CTOW/Varied/LDH3/2021/15217464 dated 22.04.2021 for washing of garments @ 300 Kgs/day along with discharge of trade effluent @ 10 KLD and domestic effluent @ 01 KLD into sewer…………………………………...
Thereafter, the industry had planned to shift its unit at present location i.e. kakka road, near 225 MLD STP, village Jamalpur, Ludhiana and had obtained ‘Consent to Establish’/ NOC for present location vide no. CTE/Fresh/LDH3/2021/16870996 dated 15.11.2021 valid upto 17.10.2022 for Dyeing of Cloth @ 1500 Kg/day along with discharge of trade effluent 150 KLD & domestic effluent @ 0.45 KLD into conveyance system of CETP 50 MLD.The above said NOC was granted to the industry for the installation of 03 soft flow machines, 01 hydro extractor and 1 pole dryer, one boiler of capacity 02 TPH & DG set of capacity 125 KVA along with total effluent discharge @ 150 KLD into conveyance system of CETP 50 MLD…………………………………...
Thereafter, the industry had applied for fresh ‘Consents to Operate’ under the Water (Prevention & Control of Pollution) Act 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 through OCMMS for dyed cloth @ 1000 Kgs/day alongwith discharge of trade effluent @ 100 KLD & domestic effluent @ 0.5 KLD into conveyance system of CETP 50 MLD along with 01 boiler of capacity 02 TPH & 01 DG set of 125 KVA, which were returned and the industry was asked to resubmit the same with correct detail of raw material & production and effluent generation…………………………………...
Thereafter, the industry again applied for fresh ‘Consents to Operate’ under the Water Act 1974 and under the Air Act, 1981 through OCMMS for dyed cloth @ 1000 Kgs/day & Dyed acrylic polyester @ 5 MTPD with discharge of trade effluent @ 100 KLD & domestic effluent @ 0.5 KLD into conveyance system of CETP 50 MLD with 01 boiler of capacity 02 TPH & 01 DG set of 125 KVA…………………………………...
Show cause notice for refusal of ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 vide letter no. 4918-19 dated 25.08.2023 to submit following documents, within 15 days:
a) The industry shall submit data regarding abstraction of ground water / fresh water supply for the last three months. It shall provide EMFs on all sources of fresh water if not provided earlier.
b) The industry shall earmark on map the location of all active / closed submersible pumps / fresh water sources.
c) Details of dyeing machinery / other water consuming machinery along with specifications including production capacities specifying liquor ratio, number of lots, water consumption per lot, thus calculating the total fresh consumption (with duly authentication by the supplier of the machines).
d) Numbers of shares held by the industry (duly certified by the SPV) and it shall submit NOC from PDA / SPV regarding proposed discharge into common sewer of CETP.
e) The industry shall get its shares demat and submit the documentary evidence in this regard.
f) Copy of agreement and status of disposal of fly ash either to brick kiln or in low lying area. The industry has failed to submit the reply of show cause notice…………………………………...
An e-mail dated 08.08.2023 was received by the Board from Punjab Dyers Association (PDA) where PDA has alleged that the industry has shares for discharge of trade effluent @100 KLD of wastewater into conveyance system of PDA, however, the industry has installed machinery having total discharge capacity of 140 KLD and the PDA has directed the industry to dismantle the excess machinery of total discharge potential of 40 KLD. The matter was considered by the Competent Authority and Notice u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 as amended in 1988 along with show cause notice for refusal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 was issued to the industry with an opportunity of personal hearing before the Chief Environmental Engineer, Ludhiana on 17.10.2023 wherein it was decided as under:
1. The ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 applied by the industry be refused.
2. Another opportunity of personal hearing be afforded to the industry by issuing notice for issuing directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974…………………………………...
Accordingly, the ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 was refused vide no. CTOW/Varied/LDH3/2023/21906948 dated 31.10.2023. …………………………………..
Thereafter, notice u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 was issued to the industry with an opportunity of personal hearing before the Chief Environmental Engineer, Ludhiana on 22.11.2023. However, no one from the industry attended the hearing. The matter was considered by the Competent Authority of the Board and it was decided to give another opportunity of personal hearing to the industry on 19.12.2023.…………………………………..
However, again no any one from the industry attended the hearing. The Chief Environmental Engineer of the Board decided that directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 be confirmed against the industry for its closure and disconnection of its electricity supply…………………………………...
Accordingly, directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 were issued to the PSPCL Authorities vide no. 292-93 dated 15.01.2024 for disconnection of the electricity supply of the industry…………………………………..Accordingly, the electricity connection of the industry was disconnected by the PSPCL Authorities vide TDCO No. 271/30 dated 13.02.2024…………………………………...
Thereafter, the industry had again applied for obtaining fresh ‘Consents to Operate’ under the Water (Prevention & Control of Pollution) Act 1974 through OCMMS for dyeing of cloth @ 1000 Kgs/day along with discharge of trade effluent @ 100 KLD & domestic effluent @ 0.5 KLD into conveyance system of CETP 50 MLD, which was refused on 29.05.2024 due to non- submission of DEMAT certificate…………………………………...
Now, the industry has again applied for obtaining fresh ‘Consents to Operate’ under the Water (Prevention & Control of Pollution) Act 1974 through OCMMS for dyeing of cloth @ 600 Kgs/day along with discharge of trade effluent @ 49.5 KLD & domestic effluent @ 0.5 KLD into conveyance system of CETP 50 MLD…………………………………...
The industry has already deposited consent fee, which is adequate upto 30.11.2027 as verified by the Regional Office…………………………………...
Regional Office has reported that the industry has already submitted DTP certificate vide no. 2744 dated 05.09.2021 is stating that the site of the industry falls in industrial zone…………………………………...
The industry was visited by the AEE of Regional Office-3 on 09.07.2024 and reported as under:
1. The industry was not in operation due to disconnection of power supply to the industry.
2. The industry has installed 03 soft flow dyeing machines (2 X 300 Kg and 1 X 450 Kg) having total 07 chambers/mouths in its premises. As per GNE Calculations, discharge of the industry will be 07 x 20 = 140 KLD. The industry has also installed one pole dryer.
3. The industry has submitted certificate from Company Secretaries regarding DEMAT of shares and as per this certificate, DEMAT shares are 50.
4. The industry has submitted permission obtained by it from PDA regarding discharging 50 KLD effluent into its sewer line.
5. The industry is connected with the conveyance system of CETP 50 MLD, Tajpur Road, Ludhiana for discharge its trade and domestic effluent. The industry has provided the flow meter at its final outlet leading to CETP.
6. The industry has not provided EMF at ground water extraction point.
7. The old unit earlier located at Mata Karam Kaur Colony was also checked and found that this unit has been permanently closed at old site…………………………………...
Further, it is pertinent to mention here that it was decided as under in the e-noting no. 19582356 (copy attached herewith): …………………………………
“It shall be ensured that no further CTE/CTO for any new/expansion of dyeing units shall be given without the permission from Head office.” …………………………………
Thus, the competency to decide the case falls with Worthy Chairman of the Board. ………………………………
As proposed by Regional Office, may if approved:
1. ‘Consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 = be granted for period upto 31.12.2024 for operation of dyeing unit for dyeing of cloth @ 600 Kgs/day along with the discharge of trade effluent & domestic effluent @ 50 KLD into conveyance system of CETP 50 MLD subject to the condition that:
a) The industry should either take measures to control its inlet parameters by good practices and selection of good chemicals for processing or shall operate and maintain its existing effluent treatment plant (ETP), regularly and efficiently, so as to achieve the inlet effluent standards of CETP as per DPR.
b) The industry shall stop discharging its effluent in case due to any reason the CETP is not operational or dedicated conveyance system is overflowing.
c) The industry shall maintain the record of flow meter installed at outlet leading to CETP.
d) The industry shall not generate/discharge trade & domestic effluent more than 50 KLD.
e) The industry shall not install any new dyeing/ water polluting machinery without permission of the Board.
f) The industry shall discharge the whole consented effluent into dedicate sewer line leading to CETP for final treatment in accordance to the shares allotted to the unit.
g) The industry will also dismantle any other connection available for discharge of effluent either into public sewer or PDA conveyance system.
h) The industry will install EMF at inlet water supply also within 01 month
i) The industry shall make adequate arrangements to minimize the consumption of fresh water………………………………….
2. Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 may be issued to the PSPCL Authorities for restoration of electricity connection of the industry temporarily for six months………………………………….
3. Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 may be issued for sealing of excess machinery of the industry………………………………….
