File Note: It is submitted that the rice sheller was granted consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Fresh/FGS/2023/23536532 dated 21/09/2023 and the Air Act, 1981 vide no. CTOA/Fresh/FGS/2023/23536515 dated 21/09/2023, both are valid upto 30/09/2024 for Processing of Paddy @ 3.0 TPH (with drier) to produce Rice @ 2.0 TPH in the name of Sh. Hardeep Singh, Partner, subject to the suitable conditions mentioned therein. Now, the rice sheller has applied for obtaining fresh consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Rice @ 2.0 TPH by processing of paddy 3.0 TPH (With Dryer) in the name of Sh. Harinder Singh, Partner with requisite documents. The unit has submitted the partnership deed dated 04/04/2023 executed between Sh. Mandeep Singh, Sh. Harinder Singh and Sh. Hardeep Singh. The unit has also submitted authority letter, according to which Sh. Harinder Singh is the authorized signatory of the firm. The industry has submitted the CA certificate dated 27/06/2024, wherein, the value of fixed assets of the industry as on 31/05/2024 is Rs. 129.11 lakhs with value of plant & machinery is Rs. 38.5 lakhs. As per the record file, the fee deposited by the industry under the Water Act, 1974 and the Air Act, 1981 is adequate upto 30/09/2028, as per circular dated 29/10/2018. The industry has submitted stack emission sampling report of stack attached to milling process APCD and stack attached to pre-cleaner APCD carried out by M/s Evop Tech Technical Service and Consultant, C-5 Model Town, Patiala on 09/02/2024, as per which the concentration of SPM is 207 mg/Nm3 and 311 mg/Nm3, which is within permissible limits as per prescribed standards for rice shellers. The rice sheller has submitted building plan approved by the Er. Swarneet Singh, Competent Person of Director of Factories, Punjab. To verify the contents of the application, the rice sheller was visited by undersigned on 15/07/2024 and observed as under: - 1. The rice sheller was not in operation due to off season. 2. The rice sheller has installed cyclone separator as APCD with rice milling plant and with mechanical drier, separately, which is adequate. 3. The industry has provided pucca vehicle movement area from the main gate to rice storage room. 4. The industry provided proper rice husk storage facilities inside the factory premises and the height of brick wall inclusive of wind screen in front of the discharge point of rice husk is more than 15'. 5. The minimum diameter at the outlet of discharge pipe of rice husk is 15'' and length of pipe is 3'. 6. The domestic effluent is discharged onto land for plantation after passing through septic tank. 7. The industry has provided plantation along the boundary wall. As such, the rice sheller is complying with code of practice notified by the Govt. for rice shellers and with the provisions of Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981. It is submitted that the Govt. of India, Ministry of Jal Shakti, Deptt. of Water Resources RD&GR Central Ground Water Authority, New Delhi has issued directions u/s 5 of Environment (Protection) Act, 1986 vide letter no. CGWA-21/6/2020-CGWA-101 dated 06/04/2022 “that it shall be mandatory for the Project Proponent abstracting ground water to obtain NOC from CGWA or the concerned State/ UT Ground Water Authority as the case made be in the compliance condition in consent to operate and consent to establish issued by the State Pollution Control Board.” Accordingly, the Board vide letter no. 1955-57 dated 18/01/2023 has informed all the officers of the Board in continuation to earlier circular no. CEE(HQ)/2018/7956-84 dated 03/03/2018 and 768-97 dated 13/01/2021 to ensure the compliance of the said directions. PWRDA vide notification dated 27.01.2023 has exempted units from obtaining any permission of the authority, which are extracting not more than 300 cubic meters of ground water per month. In the subject cited case, the industry has mentioned ground water extraction @ 2 KLD. The unit has submitted 180 working days in a year, considering 30 working days in a month during season, so ground water extraction will be 60 KL/month, which is less than 300 KL/month. Therefore, the unit does not require permission from the PWRDA. Keeping in view of above, if approved, it is recommended that the fresh consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Rice @ 2 TPH (With Dryer) by processing of paddy @ 3 TPH may be granted upto 30/09/2028 with suitable conditions and following special conditions: 1. The industry shall submit the stack emissions analysis report from Board's lab in the upcoming season. 2. The industry shall be bound to comply with the provisions of Master Plan of Fatehgarh Sahib, prepared by the Department of Town and Country Planning, Punjab. 3. The industry shall comply with the guidelines for Abstraction of Ground Water from the Punjab Water Regulation and Development Authority (PWRDA). 4. The industry shall discharge its domestic effluent onto land for plantation after treatment in septic tank. 5. The industry shall ensure that at any time the emissions do not exceed the emission standards laid down by the Board from time to time. 6. The adequacy and efficiency of the air pollution control device will be the entire responsibility of the industry. 7. The industry shall not discharge any fugitive emissions. All gases shall be emitted through a stack of suitable height, as per the norms fixed by the Board from time to time. 8. The industry will comply with the following code of practice notified by the Govt. i. All the processing sheds be covered and have minimum ventilation as per the recommendations of Director of Factories. ii. The industry should plant thick plantation of spreading crown varieties of evergreen trees al along the boundary wall of the rice sheller. iii. All dust emitting points should be properly hooded and dust extracted to a common point. At this exhaust point, dust coming here will be passed through a dust control system and air will be emitted through a stack of height 3 meters above the roof of the building. iv. The management and handling of rice husk in the rice shelling units should be done as under:- a) All the rice shelling units shall provide paved / brickroads /cement concrete roads/ metal led roads inside their premises for movement of vehicles, so as to prevent the generation of dust. b) The industry shall provide proper rice husk storage facilities inside the factory premises and the height of brick wall in front of the discharge point of rice husk area should be at least 10’ high or3.5’higher than the discharge point of the rice husk pipe (whichever is more) and the length of aforesaid brick wall should beat least 35’one ach side of the rice husk discharge pipe. c) The industry shall provide a layer of wind screen of mild steel or some other similar material of at least 5’ height above the brick wall. The wind screen system should have a porosity of ~30% to lower the wind velocities, thus reducing the amount of air borne particulate from storage, handling and loading/unloading areas of rice husk. d) The minimum diameter at the outlet of discharge pipe of rice husk be kept as 15’’ which can be maintained by extending the existing discharge pipe with the help of a conical shaped pipe of at least 3’length. e) Wherever the height of rice husk is 3’ or more, the industry shall cover the heap of husk with HDPE warp knitted fabric completely, except the area near the discharge pipe. The HDPE warp knitted fabric be made of 100% virgin high density polymer of at least 70gm/m2 weight having 40-45hole/inch 2 to prevent wind blowing of stored husk. f) During transportation of rice husk through vehicles, it shall be covered from all sides with tar Pau line prevent blowing of husk by winds. 9. The emission standards given in the order dated 13/9/2006 will remain operative for Rice Shellers and Saila Plants. These emission standards are reproduced as under:- Emission Standards for Rice Shellers & Saila Plants in the State of Punjab will be applicable as under: - i. Emission standards 750SPM (mg/Nm3) ii. Inside the building TLV of air SPM (mg/Nm3) NOTE: The existing units not meeting with the prescribed sitting guidelines will meet with stack emission standards of SPM 500mg/Nm3.To be controlled by the Director of Factories. 10. The industry shall continue to comply with the new code of practice notified by Govt. Notification no.10/48/2004-STE(4)/932 dated 15/10/2013 at all the times. 11. The industry shall abide by the fresh directions (if any) issued by the Hon'ble Punjab & Haryana High Court/ Govt./ Board for compliance of code of practice of rice sheller. 12. The industry shall not cause any nuisance/traffic hazard in vicinity of the area. 13. The industry shall shift its location to designated area as per directions issued by the State Govt. / Board from time to time and time frame stipulated in Master Plan for industry located in Ml limits. 14. The industry shall upgrade/ replace the APCD as per latest notification issued by the Ministry of Environment & Climate Change, New Delhi to achieve the revised emissions stands as amended time to time. 15. The project proponent shall not throw, burn or burry any solid wastes in open, outside premises or in drain/water bodies. 16. The project proponent shall promote use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic, through their Corporate Environment Responsibility (CER) activities. 17. The project proponent shall properly handle and manage the solid wastages as per the provisions of the Municipal Solid Waste Rules 2016 and ensure that the solid waste is segregated & disposed of in an environmentally sound manner. 18. The industry shall provide thick plantation of spreading crown varieties of ever green trees all along the boundary wall.
