Subject: Application for obtainingvaried consent to operate under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 – M/s Swami Food Industries, Village Daftriwala, Tehsil Patran,Distt. Patiala.

It is submitted that the industry was granted consent to establish (NOC) of the Board vide no. CTE/Fresh/PTA/2023/21358277dated 06/04/2023, valid upto 05/04/2024 for manufacturing of Rice (Saila/Steamed/Dry) @ 4.0 T/Hour by processing of Paddy (For Saila/Steamed/Dry Rice) @ 6.0 T/Hour as raw material and discharge of trade effluent @ 120 KLD, washing of driers/boiler blow down @ 1.0 KLD onto land for plantation after treatment in its ETP and domestic effluent @ 4.5 KLD onto land for plantation after treated in septic tank under red category subject to conditions mentioned therein.
Thereafter, the industry could not provide adequate plantation area for utilization of treated waste water to be generated from Saila plant. Hence, it was granted partial consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 & under the Air (Prevention and Control of Pollution) Act, 1981 for operation of only STEAM PLANT to manufacture Rice (Steamed/Dry) @ 4.0 T/Hour by Processing of Paddy @ 6.0 T/Hour as raw material and discharge of domestic effluent @ 4.5 KLD onto land for plantation after treated in septic tank and boiler blow down @ 1.0 KLD onto land for plantation under red category along with requisite documents.
Now, the industry has developed plantation area around one acre of land within the unit and again applied for obtaining varied consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 & under the Air (Prevention and Control of Pollution) Act, 1981 for manufacturing of Rice (Saila/Steamed/Dry) @ 4.0 T/Hour by Processing of Paddy @ 6.0 T/Hour as raw material and discharge of domestic effluent @ 4.5 KLD onto land for plantation after treated in septic tank, trade effluent @ 120.0 KLD onto land for plantation after treated in ETP and washing of driers/boiler blow down @ 1.0 KLD onto land for plantation after treated in ETP under red category along with requisite documents.
The industry had already deposited online Rs. 103000/-vide online receipt No. 680587989dated 08.02.2024as consent fee under Water (Prevention & Control of Pollution) Act, 1974and Rs. 103000/-vide online receipt No. 852324809dated 08.02.2024as consent fee under Air (Prevention and Control of Pollution) Act, 1981,and now the industry has deposited Rs. 100/- vide online receipt No. 124940970dated 10.07.2024 as consent fee under Air (Prevention and Control of Pollution) Act, 1981,which is adequate upto30.06.2028against the fixed assets of Rs. 593.33lakhas on 31.03.2024 as per CA certificate submitted by the industry.
The industry has also deposited Rs. 3600/- vide online receipt No. 124940970dated 10.07.2024 as NOC regularization fee against the increase in the value of fixed assets
The industry submitted compliance report of consent conditions earlier granted to it alongwith other requisite documents.
The industry had already submitted stack emissions sampling reports analyzed by Centre for Environment and Food Technology Pvt. Ltd., Mohali on 05.02.24. As per the report, the concentration of particulate matter is 264 mg/Nm3 (Boiler) and 307 mg/Nm3 (paddy pre-cleaner), which are within the permissible limits as prescribed by the Board.
The industry has submitted completion certificate dated 15.01.2024of its ETP from M/s Shiva Aqua Enterprises, B-XXX, SCO-3, Gurbagh Colony, Chandigarh Road, Ludhiana, in which it was mentioned that ETP is adequate for handing wastewater generation up to a capacity of 200 KLD.
The industry had already submitted approved building plan dated 21.12.2023 from competent person Er. Adarsh Vir Gupta, Patiala.
The industry has submitted letter dated 07.02.2024, which is reproduced as under:
I, Gobind Singla, partner of the firm, submit as follows :-
1. That on dated 19/03/2024, consents under the Water Act, 1974 and Air Act, 1981 were granted to the unit, which are valid up to 30/06/2028, for the manufacturing of Steamed/Dry Rice @ 4.0 T/hr. by processing of Paddy @ 6.0 T/hr.
2. That now, we have developed plantation area around one acre of land within the unit. Further, we are in process to for developing another one acre of land, which is to be taken by us on lease. In this regard, we want to submit and undertake that before manufacturing of saila rice, we will develop another acre of land under plantation, if fail to do so, we will operate only 2 driers to manufacture saila until the adequate area of plantation is to be developed by us.
So, keeping in view of above, we are applying for obtaining varied consents to operate under the Water Act, 1974 and Air Act, 1981 for the manufacturing of Saila/Steamed/Dry Rice @ 4.0 T/hr. by processing of Paddy @ 6.0 T/hr.
3. That the gross value of fixed assets of the unit as on 31/12/2023 was at Rs. 567.69 lacs. (Land : Rs. 94.73 lacs, Building : Rs. 123.29 lacs, Plant & Machinery : Rs. 309.12 lacs and M.F.A. : Rs. 40.55 lacs).
4. That the gross value of fixed assets of the unit as on 31/03/2024 is at Rs. 593.33 lacs. (Land : Rs. 94.73 lacs, Building : Rs. 127.80 lacs, Plant & Machinery : Rs. 324.25 lacs and M. F. A. : Rs. 46.55 lacs).
5. That there is an increase of Rs. 25.64 lacs in the gross value of fixed assets of the unit, which is due to transfer of pre-operative expenses under the heads, Building, Plant & Machinery and M.F.A.
6. That at present, the unit has 4 (Four)Driers of 24 MT each, 8 (Eight)Handis of 12 MT each, 6 (Six) Handis of 4 MT each, 1 (One) Sortex, 2 (Two) Silky, 1(One) Petti, 2 (Two) Pneumatic Rulae, 5 (Five) Polisher, 1 (One) Boiler of 8 TPH and 1 (One) D.G. set of 400 KVA.
7. That approved building plans from Competent Person of our unit along with completion certificate of APCD/ETP has already been submitted in your office.
8. That for disposal of boiler’s ash, an agreement with Sh. Kulwinder Singh S/o Sh. Gurbhej Singh & Sh. Arwinder Singh S/o Sh. Gurbhej Singh, resident of Dera Gobindpura, Village Shutrana, Tehsil Patran, Distt. Patiala has already been submitted in your office.
9. That we have already deposited Rs. 2,06,000/- (Air Consent fee : Rs. 1,03,000/-, Water Consent fee : Rs. 1,03,000/- adequate up to 30/06/2028.
10. That we are depositing online Rs. 4,200/- (Air Consent fee : Rs. 100/-, Application Form fee : Rs. 500/- and NOC Regularization fee : Rs. 3,600/-).
So, you are requested to grant us consents to operate up to 30/06/2028 for the manufacturing of Saila/steamed/Dry Rice @ 4.0 T/hr. by processing of Paddy @ 6.0 T/hr.
The industry had already submitted disposal of boiler’s ash agreement with Sh. Iqbal Singh S/o Sh. Jagjeet Singh, resident of Village Burar, Daftriwala, Tehsil Patran, Distt. Patiala.
The industry was visited by AEE of this office on 16.07.2024 and contacted Sh. Gobind Singla, partner.During visit, it was observed as under:
i) The industry was not in operation.
ii) The industry has ETP in its existing unit.
iii) The industry has provided new plantation in around 1 acre of land under plantation area for discharging the treated wastewater from its ETP. The representative of the industry informed that the said plantation area will be properly developed before start of next season, as per karnal technology.
iv) The representative of the industry also informed that they are in the process of taking another land around 1 acre on lease, which will also be developed under Karnal Technology.
v) The industry has installed 4 no. driers of 24 MT each, 8 no. handis of 12 MT each and 6 no. handies of 4 MT each., 1 no. sortex, 2 no. silky, 1 no. petti, 2 no. pneumatic rulae, 5 no. polishers, 1 no.boiler of 8 TPH.
vi) The industry has installed 2 no. cyclone as APCD with the 2 no. paddy pre-cleaner and separate cyclone with the milling section to control process emissions.
vii) The domestic effluent is being discharged onto land for plantation after septic tank.
viii) The industry has installed boiler of capacity 8 TPH using rice husk as fuel. The industry has installed multi cyclone as APCD of adequate stack height.
ix) All the dust emitting points have been properly hooded and passed through cyclone as APCD. The pre cleaners are also provided with APCDs i.e. cyclone with stack of adequate height.
x) The industry installed one no. D.G. set of 400 KVA capacity equipped with canopy and adequate stack height.
xi) The industry has installed two no. submersible pumps and has provided mechanical flow meter on it.
xii) The industry has completed its ETP. However, the same is yet to be in operational mode.
The industry is complying with the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
Keeping above in view, it is recommended that Varied consent to operate under the Water (Prevention &Control of Pollution) Act, 1974 and under the Air (Prevention and Control of Pollution) Act, 1981 upto 30.06.2028 for manufacturing of Rice (Saila/Steamed/Dry) @ 4.0 T/Hour by processing of Paddy @ 6.0 T/Hour as raw material and discharge of domestic effluent @ 4.5 KLD onto land for plantation after treated in septic tank, trade effluent @ 120.0 KLD onto land for plantation after treated in ETP and washing of driers/boiler blow down @ 1.0 KLD onto land for plantation after treated in ETP under red category may be granted to the industry, subject to certain condition only that:-
1. This consent is valid for manufacturing of Rice (Saila/Steamed/Dry) @ 4.0 T/Hour by processing of Paddy @ 6.0 T/Hour only, if the industry is able to develop adequate plantation area for utilization of entire treated waste water. Otherwise, the industry shall only operate on its 50 % capacity.
2. The industry will use only 2 no. of driers for the manufacturing of Saila rice as per undertaking submitted by it.
3. The industry shall develop more than 2 acres of land under plantation area before manufacturing Saila Rice at its full capacity.
4. The industry will give full details to the Board in advance of additional land to be used for plantation in addition to its existing plantation area.
5. The industry will intimate to the Board in advance before operating its saila plant at its full capacity.
6. The industry shall continue to abide by the new code of practice notified by Govt. Notification no. 10/48/2004-STE (4) /932 dated. 15/10/2013.
7. The industry plant shall put in place all the hoods, ductings & enclosures and other components of the APCD at all the times.
8. The industry shall provide additional plantation all along the boundary wall of the unit and submit compliance in this regard to the Board.
9. The industry shall keep the APCD/ETP in good running conditions at all the times and shall also operate the same properly and effectively so as to achieve the standards prescribed by the Board.
10. The industry shall dispose of the dust contained by APCD/ETP in an environmentally sound manner.
11. The industry shall apply for permission of abstraction of ground water from Punjab Water Regulation and Development Authority (PWRDA).
12. The industry will amend its APCD as per amendment (if any) in policy of the Board.
13. The industry shall provide proper and permanent approach to the sample collection facility and the same shall be maintained in proper conditions at all the times.
14. The industry shall comply with the stack emissions standards as laid down by the Board and as amended from time to time by the Board/MoEF and shall be bound to upgrade/replace the APCD to achieve such revised standards.
15. The industry will ensure that there shall be no stagnation of treated wastewater in the plantation area.
16. The industry shall bound to get its building plan approved afresh from the Director of Factories, Punjab in case there is any change in the building after grant of approval of building plan by the Director of Factories, Punjab and submit the same to the Board.
17. The industry will shift to designated zone within the stipulated time or any amendment in the timeline as per the policy of the Govt.
18. The industry shall inform the Board in writing as and when any change is occurred in the Partnership Deed / Proprietorship / Memorandum of Article of Association, especially with regard to the name and address of the Partner / Proprietor / Director / Subscriber etc, and in any case the industry fails to do so and later on it comes to the notice of the Board that there is any change in Partnership Deed / Proprietorship / Memorandum of Article of Association, action as deem fit under the provision of said Act shall be taken.
