The project proponent was granted consent to establish (NOC) from Invest Punjab under the Water Act, 1974 & the Air Act, 1981 dated 24.03.2022 (valid upto 28.02.2023) for construction of the commercial project for developing 54 no. of showroom, 1 no. food court (100 person) and 02 no. drive though food courts (100 person each) and for discharge of domestic effluent @ 25 KLD onto land for plantation and 15 KLD for reuse for flushing purposes. ………..
The project proponent was granted consent to operate under Water Act, 1974 and Air Act, 1981 vide no. CTOW/Fresh/FDK/2023/21241615 & CTOA/Fresh/FDK/2023/21241568 both dated 04.08.2023 expired on 31.03.2024, subject to the conditions mentioned therein. ……………
Thereafter, the industry had generated “auto generated consents to operate” vide no. CTO/Renewal/FDK/2024/24956299 & CTO/Renewal/FDK/2024/24956134 both dated 02.03.2024, valid upto 02.03.2029 under Water Act, 1974 and Air Act, 1981 with self-declaration that the industry will comply with conditions of previous consent to operate and always comply with provisions of the Water (Prevention & Control of Pollution) Act, 1974 or Air (Prevention & Control of Pollution) Act,1981. …………….
To check the compliance, the site of the Project was by officer of the Board on 19.04.2024 and it was observed that:-
1. The commercial project was in operation during visit….
2. The project proponent has increased the land area from the earlier reserved area at the backside of the project. As informed by the representative during visit, the Washrooms, Electric panel room, DG set area, STP space, open area and a new building i.e Multiplex have been developed in the extended area…..
3. No permission/CLU submitted by the project proponent from the concerned department regarding increase in land area of the project and neither submitted any approved building plan mentioning the alteration of the layout plan…….
4. The PP has installed Sewage Treatment Plant of 100 KLD capacity and same was not in operation during visit. The representative has failed to show proper distribution network for reuse /utilization/ disposal of treated effluent. The untreated effluent was found collected in the collection tank as well as in the components of the STP.
5. The project proponent has developed plantation in 3-4 kanal area for utilization of the treated effluent. ……
6. The PP has constructed compost pits for in-house management of solid waste generated from the project. However, same were not properly maintained. Solid waste generated was found scattered / dumped near these compost pits……..
7. The PP has installed 2 no. DG sets with canopy and adequate stack height. ……………
Accordingly, the PP was issued show cause notice before the revocation / cancellation of consent to operate under the Water Act, 1974 and the Air Act, 1981 with an opportunity of personal hearing before worthy CEE (B) on 22.05.2024, wherein it was decided as under:-….
1. The 'consents to operate' obtained under auto generation by the project proponent under Water Act, 1974 & Air Act, 1981 are revoked…..
2. The project proponent shall operate the STP regularly and scientifically and shall provide adequate disposal arrangements alongwith documentary evidence, within 07 days……
3. The project proponent shall submit the complete revenue record regarding the total land area along-with approved building/layout plan and CLU of the same, from the Competent Authority in the matter, within 15 days……
4. The project proponent shall provide compost pits for management of the bio-degradable solid waste in compliance to the Solid Waste Management Rules, 2016, within 15 days……..
5. The project proponent shall apply for obtaining varied 'consents to operate' under the Water Act, 1974 & Air Act, 1981 after ensuring the compliance of decisions no. 2 to 4 above, immediately after 15 days……..
6. Senior Environmental Engineer, Zonal Office, Bathinda shall constitute a team from Zone Bathinda to visit the project site and submit the detailed report that whether the project is covered under the purview of EIA notification dated 14.09.2006 or not………
7. Environmental Engineer (Computer), PPCB be directed to provide a patch in the OCMMS system to restrain the unit from obtaining auto renewal under the Water Act, 1974 & Air Act, 1981 in future……..
8. Environmental Engineer, Regional Office, Faridkot shall visit the project immediately after 15 days, process the application to be submitted by the project proponent under the Water Act, 1974 & Air Act, 1981 on merits……… ……
Now, the PP has applied for consent to operate under the Water Act, 1974 and the Air Act, 1981 Commercial project having 56 no. of showroom, 01 no. restaurant, 1 no. food court & 02 no. drive through food courts. Details of the case are as under:-
1) The PP has submitted certificate from CA showing the gross fixed assets Rs. 2276.01 Lakhs. PP has deposited additional fee amounting to Rs. 68900/- vide online R. No. 286063136 dated 09.07.2024 and Rs. 57600/- vide online R. No. 758831821 dated 09.07.2024 under the Air Act, 1981, and Rs. 10800/- as NOC Regularization fee. This fee alongwith earlier deposited is adequate for a period upto 31.03.2029…….
2) The PP has submitted land lease deed of one acre additional land for disposal of wastewater generated from the project. ………...
3) The PP has submitted approved building plan showing total land area of 8.0696 acres. ……………………………….
The project site was visited by undersigned (AEE) alongwith EE on 14.07.2024 and it was observed as under:-
1. The commercial project was in operation during visit. ..
2. The project proponent has increased the land area from the earlier reserved area at the backside of the project. As informed by the representative during visit, the Washrooms, Electric panel room, DG set area, STP space, open area and a new building i.e Multiplex have been developed in the extended area. ..
3. The PP has submitted land lease deed of one acre additional land for disposal of wastewater generated from the project. The PP has planted saplings in this area. ..
4. The PP has installed Sewage Treatment Plant of 100 KLD capacity and same was in operation during visit. The PP has provided network for distribution for reuse /utilization/ disposal of treated effluent. Sample from the outlet of STP was collected during the visit and sent to the Head Office lab for analysis, result of the same is awaited. …
5. The PP has started maintaining record of operation of STP. ….
6. The project proponent has developed additional plantation in 8 kanal area for utilization of the treated effluent. …..
7. The PP has constructed compost pits for in-house management of solid waste generated from the project. Solid waste was lying disposed off into these compost pits. …..
8. The PP has installed 2 no. DG sets with canopy and adequate stack height. ….
The project proponent is now complying with the provisions of the Water Act, 1974 and the Air Act, 1981 as well as decisions of the personal hearing. ….
In view of the above, it is recommended that consent to operate under the Water Act, 1974 and the Air Act, 1981 may be granted to the project proponent for a period upto 31.03.2029, subject to the suitable conditions please.
