It is submitted that the subject cited industry was granted Consent to Establish (NOC) under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTE/Fresh/LDHKH/2023/22920425 dated 07/08/2023, which is valid upto 06/08/2024 for manufacturing of Tile Adhesive @ 200 MTDsubject to the suitable terms & conditions mentioned therein.
Now, the industry has applied for obtaining fresh consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981for the manufacturing of Tile Adhesive @ 200 MTDalongwith requisite documents and consent fee.
The industry has submitted the partnership deed dated 14/03/2023 executed between Sh. Akshay Goel and Sh. Sidharth Bansal. The unit has also submitted authority letter, according to which Sh. Akshay Goel is the authorized signatory of the firm. The industry has also submitted an undertaking regarding completion of installation of APCD with the sand dryer.
The industry has submitted the CA certificate dated 22/07/2024, wherein, the total value of fixed assets of the industry as on 18/06/2024is Rs. 156.05 lacs with value of plant & machinery is Rs. 67.17 lacs. Accordingly, the industry has deposited the consent fee amounting to Rs. 42,000/- vide UTR No. CBINH24185601621 dated 03/07/2024 under the Water Act, 1974 and Rs. 42,000/- vide UTR No. CBINH24185601697 dated 03/07/2024 under the Air Act, 1981. As such, the fee deposited by the industry under the Water Act, 1974 and the Air Act, 1981 is adequate upto 30/06/2029 as per office order dated 29/10/2018.
The industry has also submittedthe building plans approved from Joint Director of Factories, For Director of Factories, Punjab under the Factories Act, 1948 and the Punjab Regional & Town Planning and Development Act, 1995 vide no. DOFPB00024497 dated 21/02/2024.
To verify the contents of the application, the industry was visited by theundersigned on 15/07/2024 and Sh. Akshay Goel, Partner was contacted. During visit, it was observed as under:
1. The industry was not in operation. The representative informed that the industry will operate its unit after obtaining consent to operate of the Board.
2. The industry has installed01 sand dryer for drying the sand. The industry has installed cyclone separator as APCD with the sand dryer and the same was not in operation due to non-operation of the industry. The industry has provided arrangements to carry out the stack sampling.
3. The industry has not installed any DG set; however, the representative informed that the unit has placed on order for DG set of capacity 160 KVA, which will be equipped with canopy and stack of adequate height.
4. The industry has provided 01 submersible pump for abstraction of ground water; however, it has not installed water meter over the supply of fresh water. The representative was advised to install the same.
5. No water is used in the process, so no trade effluent will be generated.
6. The industry has provided septic tank for the treatment of domestic effluent and the same is being discharged onto land for plantation after passing through septic tanks.
Further, the Board vide letter no. 1955-57 dated 18/01/2023 has informed that department of Water Resources (RD and GR), Central Ground Water Authority, Ministry of Jal Shakti Govt. of India, New Delhi under Section 5 of the Environment (Protection) Act, 1986 has issued directions vide order dated 6/4/2022 that “It shall be mandatory for the project proponent abstracting ground water to obtain No objection Certificate from Central Ground Water Authority or the concerned State/UT Ground Water Authority as the case may be in the compliance conditions in consent to operate and consent to establish issued by the State pollution control Board”
PWRDA vide notification dated 27.01.2023 has exempted units from obtaining any permission of the authority, which are extracting not more than 300 cubic meters of ground water per month.
In the subject cited case, the industry has mentioned ground water extraction @ 4 KLD. Considering 30 working days in a month, the ground water extraction will be 120 KL/month, which is less than 300 KL/month. As such, the does not require permission from PWRDA.
In view of the facts mentioned above, if approved, it is recommended that the fresh consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981may be granted upto 30/06/2029 (upto adequacy of consent fee)for the manufacturing of Tile Adhesive @ 200 MTDwith suitable conditions and following special conditions:
1. The industry shall install water meter over the supply of fresh water and shall submit the record of daily withdrawal/ consumption at Regional Office, Fatehgarh Sahib on monthly basis.
2. The industry shall comply with the guidelines of Punjab Water Regulation and Development Authority (PWRDA).
3. The industry shall obtain NOC of the Board, if it changes any of its product or raw material or enhances its production capacity in future.
4. The industry shall not generate and discharge any kind of trade effluent and shall not start wet process in its premises without prior written permission of the Board.
5. The industry will operate & maintain its air pollution control device (APCD), regularly and efficiently.
6. The industry shall promote use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic, through their Corporate Environment Responsibility (CER) activities.
7. The industry shall ensure that there are no usages of single use plastic- thermocol disposable items such as water bottles / water pouches/water cups, plates, forks, spoons, straw etc. and single use decorating material made of plastic-thermocol or any other non-biodegradable material in the premises.
8. The industry shall properly handle and manage the solid wastages as per the provisions of the Municipal Solid Waste Rules 2016 and ensure that the solid waste is segregated & disposed of in an environmentally sound manner.
