File Note: It is submitted that a complaint was received regarding noise pollution caused by hammers in residential area. The industry was visited by the officer of the Board on 22/04/2024 and was found violating the provisions of Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974. The industry was given personal hearing before Senior Environmental Engineer, Jalandhar on 21.05.2024 and it was decided that:- 1. The industry shall apply for consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 and authorization under Hazardous & other wastes (Management & Transboundary Movement) Rules, 2016 along with requisite documents within 15 days. 2. The industry shall take the necessary measures to control air, water & noise pollution, so as to achieve the prescribed standards. 3. The industry shall ensure that with the operation of its industrial activities the nearby residents shall not be aggrieved. 4. The RO-1, Jalandhar shall verify the contentions made by the industry, collect stack samples, monitor noise levels and submit the report/recommendations within 15 days. After that a complaint was again received in this office on 05.06.2024 regarding noise pollution created by the industry in the surrounding area. Accordingly, the site of the unit was visited by Er. Manvinder Singh Hundal, AEE (OS) and Er. Surbhi, AEE (OS) of this office on 26.06.2024 and it was observed as under:- 1. The industry was in operation during the time of visit. 2. The industry is engaged in casting and forging of scaffolding by using MS rods as raw material. 3. The industry has installed 02 nos. of hammers out of which one was in operation and other was not in operation. The hammer is connected with oil fired furnace with hood and stack. The noise monitoring of the industry was also carried out and report as below:- Sr. no Noise level measured from the house of Sh. Sita Ram (complainant)when hammer was not in operation. Above results shows that the industry is contributing to the noise levels more than 10 (dB) (A). 5. The industry has installed one no. of induction furnace of capacity 100 kg per heat with APCD and the same was without any stack and sampling arrangement. The industry has also installed 02 nos. of pit furnace without hood and stack (Chimney), 01 no. of rotary furnace, 01 no. of shot blast machine with APCD and adequate stack, 06 nos. of Lathe (Kharads) and other general machinery and all are in operation. 6. The industry has installed one no. of cooling tower and the water was being re- circulated after cooling the furnace. No trade effluent is generated by the site and only domestic effluent is being discharged into sewer. It is pertinent to mention here that a complaint no. 2184/8/2024 filed by Sh. Sita Ram, Raja Garden, Gadaipur, Jalandhar before the Hon’ble Punjab State Human Rights Commission, Chandigarh. The complaint was fixed for hearing on 14.06.2024 and vetted reply of the Board has already been filed in the Hon’ble Commission. The next date of hearing in this case has not been updated. Thereafter, the industry was issued direction u/s 31-A of the Air (Prevention and Control of Pollution) Act, 1981 that the hammers installed by the industry be sealed. In compliance of the directions issued by Competent Authority the two power presses each capacity 1.25 TPH were sealed in the presence of representative of the industry Sh. Manish Gupta on 05/07/2024. Now, the industry has applied for fresh consent to operate under Water (Prevention & Control of Pollution) Act 1974 with and Air(Prevention and Control of Pollution)Act,1981throughOCMMS of the Board for manufacturing of Scaffolding, Castings etc @ 3.5 T/day by using M.S Rod @ 2.0 T/day, Pig Iron @ 2.0 T/day. The industry has submitted approved building plan from Competent person under Factories Act, Punjab. The industry has submitted classification of area certificate issued from DTP, Jalandhar vide No. 230 dated 13.02.2024 in which mentioned that the site of the industry falls in General Industrial Zone as per Master Plan 2009-2031.The industry has submitted proprietorship certificate, rent agreement, manufacturing process, completion certificate of APCD, GST certification, Site plan cum location plan and APCD installation bill with the application. The industry was visited by AEE of this office on 17.07.2024 and observed that :- 1. The industry was in operation and is engaged in manufacturing of Scaffolding, Castings etc. 2. The industry has installed one induction furnace of capacity 0.100 TPH with bag filter house as APCD and adequate stack height. 3. The industry has installed one Coal Fired Pit Furnace of capacity 0.05 TPH with adequate stack height. 4. The industry has installed one shot blasting machine of capacity 100 kg/day with bag house as APCD and adequate stack height. 5. The industry has installed one Oil fired heating furnace with hammers with stack. 6. The industry has installed two Oil fired annealing furnaces. 7. There is no source of trade effluent generation and only domestic effluent is discharged into M.C sewer. Entire cooling water is being re-circulated. 8. The industry have made necessary arrangements for control of noise and provided acoustic sheets on one side. During visit, the representative of the industry informed that the site falls in industrial zone and they have made complete arrangements for control of noise and requested for de-sealing of hammer. Keeping in view of above, it is recommended that:- 1. Consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 30.09.2029 with usual condition as per policy of the Board subject to suitable conditions. 2. The matter regarding de-sealing of the hammers may be decided by the Competent Authority, please.
