File Note: • The industry is a small scale green category unit. • The industry was visited by AEE of this office on 31/01/2022 and observed that the industry was in operation and engaged in manufacturing of industrial packaging bags by using fresh granules (LDPE & PP) as raw material. The industry has installed 01 no extruder and 1 no cuttings/sealing machine There is no source of generation of trade effluent and disposal of domestic effluent is into sewer. • The industry was issued show cause notice for violation of provisions under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 with hearing before Senior Environmental Engineer Jalandhar on 19.05.2022, during hearing it was decided that:- 1. The industry shall supply list of industries to whome packing bags are being supplied, within 15- days. 2. The industry shall apply for consent to operate under the Water (Prevention & Control of Pollution) Act 1974 and Air (Prevention & Control of Pollution) Act 1981 alongwith complete documents through online system within 15-days. 3. The Regional Office-1, Jalandhar shall visit the industry after stipulated period and process the consent application of industry on merit • Thereafter, the industry was visited by officer of this office on 23.09.2022 and during visit it was observed that the industry was in operation and is engaged in manufacturing of industrial packing bags by using LLDPE & LDPE as raw material. The industry is manufacturing bags above 50 microns The industry has installed one extruder (Tubular machine), one cutting machine and one sealing machine During visit, the representative of the industry was guided to apply for consents, however, the industry has failed to apply for consent to operate under Water (Prevention & Control of Pollution) Act, 1974 Air (Prevention & Control of Pollution) Act, 1981 and registration under Plastic Waste Management Rules, 2016. • Thereafter, the industry was issued show cause notice for violation of the Water (Prevention & Control of Pollution) Act 1974 and Air (Prevention & Control of Pollution) Act 1981 with an opportunity to reply within 15-days, but industry has failed to submit any reply in this regard. • Thereafter, the industry was issued show cause notice for violation of the provisions under the Water (Prevention & Control of Pollution) Act 1974 & Air (Prevention & Control of Pollution) Act, 1981 with opportunity of personal hearing on 16/10/2023, wherein it was decided that- 1. The industry shall apply for consents under the Water (Prevention & Control of Pollution) Act 1974 and Air (Prevention & Control of Pollution) Act 1981 within 10-days. 2. The Environmental Engineer, Regional Office-1, Jalandhar shall process the application on merit as and when received. But, the industry has failed to apply for consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and under Air (Prevention and Control of Pollution) Act, 1981. • The industry was visited by the team of officers of the Board constituted at Head Office, Patiala on 03.11.2023 and during visit Sh. Rajinder Kumar was available at site and the team observed that: 1. The industry was found in operation and engaged in the business of manufacturing of industrial packaging bags. 2. About 8 to 10 LDPE bags each of capacity of 25 Kg is being used as a raw material to manufacture packaging material, It was also reported that resins, including colored resins, are openly available for sale in the market to various commodity manufacturers. However, no record with respect to the consumption of plastic was available at site. 3. The average thickness of the sample-1 and sample-2 of plastic packaging material collected during visit was found 28 microns and 42 microns which was less than the 50 microns as prescribed under the Plastic Waste Management Rules, 2016. 4. The industry was advised to apply for renewal of Consent to Operate (CTO) under the Water Act of 1974 and the Air Act of 1981, as well as obtain registration under the Plastic Waste Management Rules of 2016, immediately. • Thereafter, the industry was given personal hearing before the Chairman of the Board on 07.12.2023 w.r.t show cause issued for violation of the provisions of Plastic Waste Management Rules 2016, wherein in was decided that:- 1. The industry shall apply for obtaining registration under the provisions of Plastic Waste Management Rules 2016 on the centralized ERP portal developed by the team CPCB without any further delay. 2. The industry shall deposit Environmental Compensation amounting of Rs. 1,77,500/- due to violation made under provisions Plastic Waste Management Rules 2016. 3. The industry shall apply for renewal of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and under Air (Prevention and Control of Pollution) Act, 1981. 4. Environmental Engineer, Regional Office-1 shall ensure the compliance of the above decisions and submit latest status report within 15 days. • The industry was applied for consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and under Air (Prevention and Control of Pollution) Act, 1981 and the same was refused on 27.01.2024 due to non submission of Environmental Compensation amounting of Rs. 1,77,500/- as per decision of the hearing. Thereafter, the amendment in proceedings of personal hearing given on 07.12.2023 before the Chairman of the Board w.r.t show cause issued for violation of the provisions of Plastic Waste Management Rules 2016 in reference to the request made by the industry to waive off the environmental consumption imposed during hearing on 07.12.2023 was issued by SEE(PWM) vide letter No. 3220 dated 16.07.2024 and decided to waive off the Environmental compensation imposed during hearing given to the industry on 07.12.2023subject to the condition that the industry sh all ensure the compliance of Guidelines on extended producer responsibility (EPR) for plastic packing notified vide MoEF&CC notification dated 16.02.2022 as well as various provisions of Plastic Waste Management Rules 2016 as amended from time to time. This is for your information and compliance at all times failing which the industry shall attract appropriate action under the provisions of the Environment (Protection) Act, 1986. • Now, the industry has applied for fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and under Air (Prevention and Control of Pollution) Act, 1981 through OCMMS of the Board for manufacturing of Industrial Plastic Bags @ 100 Kgs/day by using Plastic Dana @ 100 Kgs/day as raw material under green category and detail of the same as under:- 1. The industry has deposited Rs. 10800/- vide UTR No. N173221295983353 dated 22.06.2022 under Water Act, 1974 and Rs. 700/- vide UTR No. N173221295972300 dated 22.06.2022 NOC regularization fee and Rs. 10800/- vide UTR No. N173221295987219 dated 22.06.2022 under Air Act, 1981 and Rs. 500/- vide UTR No. N173221295927810 dated 22.06.2022 against the fixed assets of Rs. 1.62 Lacs, which are adequate upto 31.12.2024 including 500% penalty. 2. The industry has submitted approved building plan from director of factories act, Punjab. 3. The industry has submitted electricity bill as per proof of date of commissioning. 4. The industry has submitted rent agreement, proprietorship certificate with the application. 5. The industry has also submitted an undertaking in which mentioned as under:- "I TEJPAL SINGH PROP. M/S CHAWLA POLYMERS, E-32 INDUSTRIAL AREA, JALANDHAR HEREBY DECLARED THAT I MANUFACTURE INDUSTRIAL PLASTIC PACKING BAGS HAVING THICKNESS MORE THAN 50 MICRONS" 6. The industry has submitted NOC certificate issued from the General Manager DIC, Jalandhar vide memo no. 9192 dated 14.09.2010 in which mentioned that the site is used for industrial purpose. • The industry was visited by AEE(OS) of this office on 17.07.2024 and observed that the industry was in operation. • The industry has installed 1 no. extruder machine and 1 no. cutting/sealing machine at site. • The industry is not engaged in manufacturing of any type of plastic carry bags and SUP items at site. • There is no source of trade effluent generation and domestic effluent is discharged into sewer. • The industry is complying with the conditions of granted consent to operate under Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981. Recommendation:- Keeping in view of above, it is recommended that the consent to operate under Water (Prevention & Control of Pollution) Act 1974 and under Air (Prevention and Control of Pollution) Act, 1981 may be granted to the industry upto 31.12.2024 with suitable conditions as per policy of the Board with suitable conditions as per policy of the Board and with special condition that:- 1. The industry shall obtain EPR registration within 07 day. 2. The industry will not manufacture any activity related to plastic carry bags/ Single use plastic items.
